Unauthorized Charge after cancellation
I ordered the free trial of Acai Berry Pro on 1/6/2009, and I received it a week later. That left me 7 days to try the acai berry supplement before the 14-day trial would end. I ended up being allergic to the product - broke out in eczema on my legs after three days' use - and I called the company 1/18/2009 to cancel, following the instructions which are in the Terms and Conditions, and they told me that no charges would be made to my credit card. I was checking my bank account today, and they had charged $78.81 to my bank account on 1/21/2009. Three days after I told them I was sending it back because I was allergic. I even went to the post office the day after the MLK holiday to ship it off - it was snowing! Anyway, I shipped it off according to their directions, using the RMA number they provided, and they haven't received it yet, but it's on the way. (For anyone returning the product, make sure you get a confirmation of delivery. I wouldn't put it past them to deny they received the product I returned!) It took me over 25 minutes to get them to erase the charge. At first, I was offered $45. Then I was offered $50. I threatened to have a lawyer call them to talk to them if they were refusing to stick to their very own Terms and Conditions, which I read to the customer service rep verbatim :-o . Once I read him the whole list of Terms and Conditions, the rep finally talked to his manager (I'd requested a manager twice by that time) and the manager was obviously listening in when the rep told me they would refund the entire amount - and that he did it while I was on hold. Then he asked, "Are you happy now?" repeatedly. Of course I was. I asked him how he'd feel if he got a defective, unusable product from a store shelf but was only getting half his money in return when he complained? Then to finally get what was really fair - a refund of the whole price - of course I was happy. He kept suggesting that they get a lot of free trial customers who aren't legitimate customers, and that I sounded "genuine". I lost count how many times he said it, but it was more than 10. So, finally, I am supposed to get a full refund of the charges that were made three days AFTER I'd canceled. I'll complain here again if they lied and didn't refund my money. I have three lawyers in the family. One of them would be more than happy to send them a letter telling them to obey their own Terms and Conditions. In a way, I'm disappointed that they won't have to deal with him, but, hey, at least my money is supposedly refunded.
