Claim
Tammy Wright (972-871-6583) head of the claims department just informed me that her people were trying to settle my claim without having the doctors notes.
Chris Chadwick (972-871-6560) and her associate Eric of Allstate have been working on my case since April 2010. They contacted me on January 18th, Tuesday with the settlement amount. Chris and her associate Eric are wanting to compensate me from 4-21-10 to 6-29-10 because it was the date of my lastest doctor's appointment. I experienced pain and suffering from the date of the accident, 4-21-10 until 10-06-10.
I informed Chris that my doctor, a specialist, prescribed that I wear a hand splint during heavy activity. That it would take many months to heal, up to four months. The doctor's notes say, "Advised to give me a call if the injury is still bothering her at the end of October."
I called my doctor's office in October and told them that I was feeling better. I also asked if there was anything else I needed to do and they said no. I then called Chris Chadwick and told her that I was finally feeling well and that we could start the settlement process.
Chris Chadwick was totally unprofessional and rude when I told her that I would not settle with the amount that they were suggesting. I have never been treated so poorly in all my life.
Furthermore I recieved a phone call from Eric (972-915-2196). He told me that he didn't think my hand should be included in the settlement. I told him I was hit directly on the driver's side door. I told him that I went to the Emergancy Room and told them that I was experiencing pain and numbness in my neck, left shoulder, arm and hand. He asked me why the didn't the emergancy room x-ray my hand. I told him that I don't tell doctors what to do, I just explained to the doctors what pain I was feeling. He asked me why I waited three weeks to see a doctor about my hand. I told him that I was recieving treament for my hand since the accident and got an x-ray on my hand on 4-28-10. So he lied saying that it was three weeks later. He is suppose to be the medical examiner.
He then asked me if I wore a splint from 6-29-10 to 10-06-10. I told him that I wore the splint as the doctor advised me to do. He then said that he once he had his fingers hurt and that HIS doctor didn't have him wear anything for that long of a time. I told him that him and his situation is entirely different to my situation. He then asked how wearing a splint would heal my hand. I told him that he could call my doctor if he need specifics on the healing process.
Then today, January 20, 2011, I spoke with Tammy Wright (972-871-6583). She tells me that they only have the insurance papers from the Hand Specialist but that they do not have the doctor's notes. She said that they requested them twice and never recieved them. She said, "Maybe there is something wrong with the fax machines."
I spoke with the Hand Specialist on Wednesday, January 19, 2011 and they said that Allstate had all of the doctors notes.
So Allstate has called me and given a settlement amount without reviewing the doctor's notes. When I spoke with Chris and Eric on the phone I talked to them about the notes that the doctor had written and they said that they knew about them. It has been three months since I called to settle. On top of that they are trying to lie and bully me to settle with vital information that should be taken into consideration.

BAD CHECK REFUND
YES I USED TO A ALLSTATE CUSTOMER FOR ABOUT 8 YEARS AND I DECIDED TO GO WITH ANOTHER COMPANY DUE TO THE INCREASE IN MY INSURANCE. I NEVER HAD A WRECK AND I ALWAYS PAID MY INSURANCE. SO AFTERCANCEL MY POLICY THE COMPANY SENT ME A REFUND CHECK FOR 3, 985.50 . I WENT TO THE BANK AND DEPOSIT IT AND GUESS WHAT THE CHECK WASN'T ANY GOOD THE BANK CALL ME AND TOLD ME THAT THE CHECK WAS FICTITIOUS AND THAT I NEEDED TO PICKUP MY COPY. SO ISN'T THAT A SOMETHING. ALL THAT MONEY I PAID INTO MY POLICY AND THEY RETURN THE FAVOR BY SEENING ME A BOUNCING CHECK. I STILL HAVE THE COPY OF THE CHECK IF SOMEONE EVER CALL FROM ALL STATE FOR PROOF.

Home Owners Policy
While on vacation I was notified that my house was flooded. More than 2 inches of water in the home and more than 3 feet in the crawl space. I called 1-800-ALLSTATE to get the claim started since it was a covered loss from a broken water line under the kitchen sink. Now, over a year later we are still not in our home, have had to file suit due to Allstate's ridiculous payment of less than $11, 300.00 to repair our home which was never dried correctly by the company they sent out. We were kicked out of our temporary housing by ALLSTATE, so we now live in a completely different city. I don't see my grandchild, whom I use to see daily; I didn't get to spend the holidays with my family since it is normally held at my home; and I had to take off work to travel back to our home town for the funeral of my grandmother... something I should have been in town for, since that is where I purchased my home and intended on living.
Not to mention that our ALLSTATE adjuster has never been to our home, nor has he seen the damage. He sent a wet-behind-the-ears young kid who tried to tell me what my policy stated. But yet I had just received a letter from ALLSTATE days before telling me that I shouldn't listen to anyone but the ALLSTATE claims adjuster as the adjuster is the only one who knows my policy.
We now have mold due to them hiring an incompetant company to extract the water. They state our policy only covers $5, 000.00 in mold. My point... IT WOULDN'T BE THERE IF YOU WOULD HAVE HIRED A COMPANY TO DO THE JOB RIGHT THE FIRST TIME!
Don't use ALLSTATE. We've had them for about 16 years to cover everything we've ever required insurance on and have never put in a claim. Now, after this many years, so many policies and continued coverage without submission of a claim they want to deny a covered loss.

Allstate motor club is the worse company to have tow your car. they don't respond to calls and are very rude. I canceled my membership after only 2 months.

"Recoverable Depreciation"
During Hurricane Ike, an Oak Tree fell on our house. The tree hit the roof over the spare bedroom which I used as a Computer/Music room. After much fighting and wrangling, they finally paid enough (barely) to fix the damage to the house. When it came time for the Contents Claim to be settled, I submitted a claim for $21, 000. I had lost computers, albums, CDs, Amplifiers etc. They sent me a check for $4500, citing "Recoverable Depreciation" as the reason for the discrepancy. What this means is, if you claim an item is worth $100, they will pay you a small percentage of that $100, and pay you the balance when you submit a reciept for the remainder showing that you have bought the replacement item. This is another Insurance Industry scam, helped along through the Texas (and other states) Legislature with many lobbying dollars.
When I pay my premium, I expect to be paid if I have a claim, not run through hoops all so Allstate can maximize their bottom line. Shame on our lawmakers for taking lobbyist money to pass laws that are only in the best interest of the insurance companies. A soon as I get what I can of my "recoverable Deprecitation, We will be switching insurance companies. I know they are all the same, but they have a choice whether to take advantage of this law or to play fair and pay claims in full.
Allstate is a criminal enterprise and should be investigated, along with all the insurance companies that look for ways to screw thier clients out of their deserved claim payments.

Replacement of Hardwood Floors
I recently experienced a flood in my condominium, and my hardwood floors, which are only 4 years old and were in excellent condition prior to the flood, were severly damaged. I have requested that the floors be replaced; however, Allstate claims their position to be that "if a damaged floor can be sanded & refinished, that is what their policy will cover." They then referred to their customizer policy, which they state was in force at the time of the loss, specically pg. 19, coverage A, Conditions #3, which they state says "we have the option to repair, rebuild or replace damaged or destroyed property."
I have spoken with several contractors who have told me that the entire floor needs to be replaced due to the fact that the floors are interlaced. Allstate states that they will only pay for the replacement of some of the wood in the floor and the rest can be sanded and restained.
I am requesting that the entire floor be replaced so it will be put back into the original condition it was in prior to the flood.
I would appreciate your response on this matter ASAP since the contractor is scheduled to begin work within the next few days.

non repair of roof damages
allstate adjuster came out to our home due to storm damages to our roof. We have had excessive leaking in the closet and den.Brown spots are on the ceiling due to the rain leaking in from the roof. There are loose shingles on the back side of the house that were caused from wind damage. we've had two adjusters from allstate to come out and inspect the roof. The first adjuster said we had wind damage and cracks around the chimney. The first adjuster also instructed for us to put tar around chimney and it should fix the leak in roof. I told him it was further damage in the attic but he did not care to look at it.We were given an estimate of $643.92 which did not include damages in the attic due to him not caring to go up in the attic and examine it. We contacted Allstate after doing the suggested repairs to inform that the leakage had worsened. The claim agent Mrs. Stephanie Jackson said she would send out a second adjuster to reinspect the roof and attic. The second adjuster came out and met me and mr. corey barbee who owns a roofing company to go over the damages mr. barbee discovered a week prior to the allstate agent meeting us at my home. the allstate adjuster mr, montgomery and mr.barbee went up on the roof and both agreed to hale and wind damages seen on the roof. mr.montgomery and mr.barbee were shown pictures of the inside of the attic taken by me.when the mr.montgomery with allstate called back he stated that he saw no damages and denied coverage. he also implied that he felt as if mr.barbee was a friend of mine who was gun ho about getting me new roof and a check in my hand. THen my wife spoke with mr.montgomery's manager mr.woods and he stated that the first adjuster from allstate that came out must have been trying to help us out with money because from the pictures he was viewing he did not see wind or hale damages.

refund issues
we have been around the bend with allstate for 2.5 months and we cancelled our policy in may for 2 months so they owe us 252.00 we got 29.00 so they still owe us 223.00 they arent willing to pay us they keep lieing and lieing we want our money

non payment of medical
I was in an auto accident which totaled my car. The EMS and ER attendants were amazed that me and my child only suffered minor visible injuries. The car was totally smashed in the rear while I was sitting at the red light waiting to proceed. As mentioned above I had no visible injuries but the backaches were soon to come. I initially began rehabilitative therapy but couldn't afford the co payments and discontinued the treatment. I was not well, but I had t go back to work to take of my kids. Suffering through the pain for quite some time, I decided I would contact ALLSTATE to find out if there were any funds available on my medical claim, they said yes and disclosed the amount. I found a doctor to resume treatment and it eventually my back began to feel much better. Then I got a letter in the mail from ALLSTATE insisting that I go to a doctor of their choice to determine whether or not I needed this treatment. In one visit this doctor determined that I did not need the services I were receiving and that they would not be responsible for any future bills from that point on. Needless to say they didn't even pay for the bills that I had already received and now my crdit is a wreck. My credit score is awful. Shotrly there after, I sat on a personal injury jury, the same doctor who said I didn't need the medical treatment I was receiving at the time, was sitting on the stand saying a woman who's car had barely been touched, needed the screws or what ever she had coming out of her neck to compete with the pain she was in. This lady admittingly stated she got out of the car rasing hell and checking her car for damage and discovered none. When she realized it was a pharmacuetical company vehicle that had hit her she decided she was in great pain in my opinion. This doctor determined in one visit that I needed no treatment, but was able to determine that this lady had been injured to such a degree she had rack up nearly a million dollars in medical bills. This doctor's outcome is decided on who is footing the bill which happen to be ALLSTATE in my case. Is there anybody out there who can tell me how to get this bill paid and attorney fees for the collection agency that is harrassing me.
