Below is some of the numerous evidence of how America Home Mortgage lured us into their business using deceptive practice.
1. Prior to 5/1/2009, Mortgage Broker Art Hidalgo falsely claimed that they are whole sale LENDER and able to offer lowest rate and can beat or match any rate other lender offer.
We initially did not want to do business with America Home mortgage because of the high interest rate they quoted, However, Art Hidalgo called back several times and told me that he can match and beat any rate other lender s offer because they are whole sale lender and able to offer the lowest interest rate. He also promised fast loan approval, fast (15-20 day) loan closing, free rate extension until closing. Because of these fake promises and aggressiveness, I was lured into their business.

2. On 5/1/2009, Mortgage Broker Art Hidalgo Failed to honor the first rate locks agreement one day after we signed the rate lock agreement. However, I was further lured into their business because of Art Hidalgo emailed us stating the RATE IS GURANTEED.
On 5/1/2009 morning, Art Hidalgo agreed to match the rate other lender offered us. He later agreed to lock the rate and emailed us the initial GFT/TILt at 10:50AM. We took half day off from work and delivered the rate lock fee and signed the first rate lock agreement around Noon. In the office, Art Hidalgo guaranteed that his good faith estimate and rate lock agreement is actually what would occur. He also promised that the rate was guaranteed for 30 days, and they would offer free rate extension if the loan was not closed on time because their commitment of 15-20 day loan closing on his company advertisement on the Seattle Time Newspaper . However, at the end of day, he called and said they he would not honor rate lock and he would not refund the check to us because the check has been processed in his loan process/underwriting department (Several month later I found out from DFI, his wife is running the loan process one person department and she was using alias name to conceal the relationship and size of the business). We realized that he lied to us and gave us fake rate lock agreement. However, he was able to pull us back by promising that the second rate lock he emailed us is guaranteed and there would be no more rate increase.

3. On 5/11/2009, Loan Originator Christine Hidalgo (Alias Christine Pense) Lured us to keep committed to their business by falsely claim that our loan is approved and further guaranteed that they will not decline our loan.
On 5/1/2009, Loan originator Christine Hidalgo told me that they would run our loan under desktop underwriting system on 5/4/2009, and they would order appraisal once the loan is approved. Otherwise they would refund the rate deposit right away. However, she never kept her promise and never informed us the result of desktop underwriting result. On 5/11/2009, we felt the loan was not progressed as Hidalgos promised and wrote a very long email to complain about it. However, the Christine Hidalgo was able to lure us back into their business by leaving her false loan approval message on my home phone machine. The next day, she further guaranteed that the loan was approved and it would never be declined.

I attached the sound file from Christine’s phone message left on Monday 5/11/2009.

4. On 5/15/2009, we complaint the delaying of their loan process, Art Hidalgo further lured us that our loan is good and they would extend the rate lock for free until the loan close.

5. 6/1/2009, Art Hidalgo called us and told us that the loan cannot be closed on time but he would continue to honor the free rate extension promise. Because of his continued fake promised, we stay committed to the company and never applied loan with any other lender. This can be approved by reports from the credit bureau.

Evidence:
The second rate lock confirmation submitted by Art Hidalgo to DFI (Washington department of financial institute) showing the rate was extended 15 days until 06/16/2009.

6. 6/10/2009, Art Hidalgo issued a loan decline letter and informed the rate increase will be expire on 6/16/2009. The decline letter says the reason for decline is: not eligible for DU program. They never funded the rate lock fee to us as promised. On the other hand, according to document submitted by Art to DFI, the loan was approved on 6/10/2009 and the rate increase was due to expensive 15 day rate extension.

Evidence:
According to Art’s email on 05/15/2009, they applied other program for us. Why our loan was denied under a program that we never aware of and never applied for.
The official letter from GMAC bank to FDIC dated November 2009, stating the loan was never declined and rate increase was due to 15 rate extension offered to Art Hidalgo on 6/1/2009.

Art Hidalgo and his wife Christine Hidalgo not only used deceptive sales practice to deceive us and lure us into their business, they also use four pages of desperate, untruthful and unsupported statements to deceive the Washington Department of Financial loan examiner, as a result, they received limited scope of investigation and reduced government actions. In addition, in the response to DFI, Art Hidalgo made up several unsupported statement to attack us personally in order to complicate and deter us from the government investigation. There are lot of evidence and I will upload such them include the government actions soon.
