fraud company and a rip off
Americas Servicing Comany came in and bought the loan from New Century Mortgage and started increasing the rate of interest without letting us know what was the rate increase base on or what the next rate increse will be.It went from $1039.00 to $ 1759.00 and I ended up paying this company over $ 8000.00 over and above the original mortgage amount of $1039.00. .I asked for a modification since May 2009 and they will not respond to me later after a month they want me to send them a financial worksheet.I send them all copies of my paystubs, Insurance of house, tax returns two years, copy of all my utility bills as supporting documents along with the hardship letter showing a deficit in my balance sheet -on June 18th via certified registered mail receipt .I have the sighned copy of the letter of receipt sighned by their rep. I received a call from another rep on the 13th of Aug 2009 andthey say they have lost my papers and then I was asked to resend the papers via fax on 07/15/09 .THEY TRASHED THE PAPERS NEXT DAY. I sent it again on 07/19/09 they called me last friday saying we cannot modify your loan because that too much money for them to give up so if I cut down some expenses they will bring down the loan rate to modify. Today I received a letter from ASC where they want to do forbeareance and want me to pay $ $671.87 three times in for August September and october and in November 2009 they want $3579.96 totaling to $ 5595 for three months @ 1865 / month.( please note that I am presently current in my payments to ASC and never missed a payment and am suppose to pay $ 1359.00 with their new reduced rates at 7.25% for the month of August) your interference has made them so mad that they wrote to me that I should not have complained to you and tnow they want to go for the kill and get me so under that I - being current, mailing regular payments, with excellent credit will have to loose my home, credit, my business, and my sleep because of no fault of mine...they ar threatening of foreclosure.

Absolutely No Business being in business.
After a messy divorce, I refinanced my 3.9% mortgage to a 6% mortgage with Integrity Mortgage Co. After less than 30 days my loan was sold to these jokers. If I am to believe the ASC employee's blog on this site, it is because I am a 'deadbeat' and ASC only gets the worst of the worst. (this is a prime example of the business ethic embodied by their employees as he makes fun of their customers in a public form like this). After 4 misposted payments in 8 months (they eventually found 3, and I had to stop payment on the 4th) they proceeded with foreclosure and told me I'd have to come up with $11, 000 in cash to bring myself out of this situation. I borrowed 401k money to do what they demanded, and they returned $8k back to me for 'overpayment'. Are you kidding me? A ridiculous collections agent wouldn't accept my payment by phone until I gave him a 'good enough reason' why my payment was past due during the misposted payment fiasco as well. Really? A collections rep who won't accept a payment? Isn't that what they do? I get a statement about every 3rd month, and I can't access the website because it doesn't play well with my ISP. So...the dance continues with these idiots.

Fraud
I have had over $28, 000 taken from me illegaly by asc. My property had a small fire while in foreclosure. Asc not only foreclosed on the property but also kept all the insurance money. At the time of the foreclosure sale the obligation was deemed to be satisfied in full along with all other fees, costs and expences to the tune of $113, 000 and change. That is exactly what I owed the lender in original loan amounts and foreclosure fees and the like. Here's what I intend to do and everyone who is on this complaint board shpould do to some extent.
ASC are the biggest crooks in the housing industry. They are also the least visual aspect of the industry. If you want action here is what I am going to do and you must do. Go around ASC, that's right, do not talk to them again. Send all your payments by certified registered mail signature needed so you have a record of them accepting them before the due date. Then go directly to Wells Fargo and US Bank themselves. They are very visible and unlike ASC, have a image that they do not want tarnished. I am a Realtor in Oregon. The first thing I am going to do is send an e-mail to all the real estate agents in the state asking them to go to this site and review the complaints against ASC and against Wells Fargo and US Bank since they are the parent companies, and remind them that if their clients take out a loan because of the agents recomendations or even on their own accord, the clients rath may reach the agent in the form of no referrals and no repeat business. This I will also send to Wells Fargo and US Bank so as to make sure they know that their image is being tarnished. Next, I am going to spend at least 4-6 hours a week in front of various Wells Fargo and US Bank banking locations talking to their customers and asking them to review this website. Let's see how the rats will react when someone actually turns the light on them.

Foreclosure
After dealing with this company in regards to a foreclosure on my home, submitting paperwork, calling every other day, trying to get information from people that do not know what they are doing, they offered a modification that was totally unrealistic. Even though my payment should have gone down through the ARM, the modification they offered was over 450.00 more than the regular payment. I finally found someone to help me out with dealing with them and resubmitted all the new paperwork for a revision on the modification. After an internal error on ASC's part, my home was sold in foreclosure, even though I am being reviewed for modification. This company is a nightmare. Nobody there knows what they are talking about, everyone has a different story and they are rude!

Fraud
America's Servicing Company gave me a Forbearance Agreement in August 2008 stating they would not foreclose on my home if I made the agreed payments. After 2 months of making a total payment of $6700.00, they still foreclosed on my home not even intending to keep their end of the agreement. I have opened a Federal Court case against them, Wells Fargo, and a few others involved in this illegal foreclosure of my home.

Mortgage
We have contacted ASC, who is part of Wells Fargo Group. We have written to them with all our details and explain our situation, we contact a Consumer Credit Counselling Service who help us to put a letter together outlining how ASC could help us save our home from foreclosure as the CCCS said not to do a Forbearance Agreement we asked ASC to lower the Mortage Rate from 7.875% and to add our mortgage arrears on the end of our mortage but all they keep coming back are Forbearance Agreements. I have contacted the The White House via e-mail I have also contacted my local Governer Charlie Chris but they are not able to help or they are unwilling to, they need to take a closer look at this companies practices. ASC is not a nice company to deal with can nobody in the USA Governerment help!

Arrogance
ASC epitomizes everything that created the current economic chaos. If that weren't enough. they are now the brick wall standing in the way of any sort of recovery, repair or improvement of the system. The fact that they would charge me $20 to pay the bill on the internet is outrageous. As a protest, I make sure that they get the payment at the latest possible time of the 16 day grace period. I think everyone should. A 16 day float on funds multiplied by say 100 people is a major hit. DO IT!!! It is the only way to hurt them!!!

Raised interset rate 7 points
We have a 80/20 and America's Servicing Company has our 80 loan. Our 20 loan interate went down and we get notified that our 80 with ASC went up 7 points to 15%. We did a modification with them and it took over a year with all those payments and interest of coarse being tagged onto the loan and all the they did was go down to 14%. Bless there hearts!Whatever!!! Like that help at all! We called again after my husband lost his job and then found one but at a $10, 000 pay cut and to see if we could modify again because there was no way that we would be able to pay at that rate still and they said we had to be 2 to 3 month behind before they would consider. So now we are 3 months behind which has killed our credit, and I called and they said that we have a deficiat of $400. and that we don't pre-qualify for a loan modification but we will have someone review it and she told me that we needed to try to lower the deficiat. I told the lady at ASC, well yes it is high because my house payment is so high because of the high interest rate, that's why I'm calling . In the mean time I got a letter from a lawyer to start foreclosure but no sell date yet. I called ASC and asked why I got a letter and she said that they can still procide anytime they want. So ASC raised my interest rate to 15%, then modify down to 14%, then tell that I have to be 2-3 months behind for them to talk to me, and then send me a foreclosure letter. President Obama were is the help that you said there is because I can't find it ANYWHERE!

Fraud
This company is such a joke that it probably has thousands of dollars stashed away somewhere. We were on a special payment plan to make up for a missed payment. Well, this has been nothing but problems since the beginning. First they have you send your payments to some stupid other address and then they don't tell the main office about it. We thought we had it worked out until we got a phone call saying that we missed a payment. Somebody at the company changed our due date without notifiying us first and then told us that our agreement had been broken and that we needed to pay the missing amount. Well, we have the bank statement saying that we did pay the amount and that they cleared the check before the due date. Then, they decided to return our next payment to us and then told us it was late and not for the correct amount. These people are such a fricking joke, it's a wonder that they don't get the death penalty.

Murderers, Theives, Scam, Fraud
America's servicing company is a fraud. The government needs to investigate this company and shut it down. I hope they are not paying the governement off so they can keep on killing people. I beleive that Wells Fargo is affiliated with them and they too needs to be shut down. There have been over 366 complaints to BBB for this company and yet they haven't shut down this company. What they are doing to people is allegal. Every one that has complain against ASC needs to come together so we can have these people lock up for life. They are murderers, theives, fraud, scam, and needs to be in jail. They need to give the home owners the money that they took from them. Please join me in taking our lives back from these theives. I am going to do what ever it takes to get this done!
