Money Hungry Crooks
How could a company be allowed to scam hard working people out of their homes. They post payments late in order to charge late fees. We have been harrassed with foreclosure several times which forced us to file bankruptcy. With all the charges of late fee, we can't take out a second mortage to get a lower payment. They also say that they don't do refinancing. They bought our mortage from Chase without us knowing until the last minute. We have had problems with this company after the first month. Someone should really look into all the scams about this company. We are tryting everything we know how in order to get out from under them.

Predatory practices
HI all,
I'm in North Carolina and I would like to put together a Class Action Lawsuit against this company. I need North Carolina residents and residents from other states to come together...everybody's complaining but the beast is still devouring. We need to join forces to take this monster down. Please email me @ [email protected]. ASC is in my opinion a phantom operation and it's strong possibility(20% chance) that if your original mortgage was with another company that ASC doesn't have a legal right to collect mortgage payments from you because they don't have Title on your property. Anything in the name that says "Servicing Company" is extremely suspect.
I'm not an attorney but I would like to be able to nail down one for a class action lawsuit.

Mortgage Fraud
So, here’s my sad tale about ASC. I wanted to help my son buy a house in March 2006. His credit was poor so the mortgage broker suggested that I get a 2 year arm with a 2 year prepayment penalty mortgage AND after the 2 years get the loan refinanced in my son’s name. Good idea… So early 2008 comes around and the mortgage guy calls telling me that we need to start the process of refinancing in my son’s name. We start the paperwork and when the guy gets the payoff amount, he finds that there is an additional year prepayment penalty! Yes, I signed that at closing even though it was not the loan we discussed. Of course the original mortgage company is out of business but we track down the manager of the funding company (also out of business) and he says that the loan was definitely supposed to have been a 2 yr arm w/ a 2 yr prepayment penalty - not a 3 yr prepayment penalty. So I started calling ASC and they offered absolutely no help - telling me that I signed the paperwork and tough luck. Back to the manager of the funding company, he gets copies of all the closing documents including his handwritten notes to the mortgage company confirming the 2yr/2yr - he sends that to ASC and they still say tough luck. The payment has gone up by almost $600 per month and the kid can’t afford anymore money so Mom (me) gets to pay the extra plus all the taxes and insurance. I can not afford the extra expense - if the creeps at ASC would just refinance the loan to a 30 year at current rates, my son could afford it and ASC could keep the loan. As it is, we are considering letting the house go back to the mortgage company. So many big banks getting bailed out and all I’m asking for is to have a good loan refinanced at current interest rates - without a prepayment penalty of $18, 000.00.

HOLDING OF IVALID DEED OF TRUST
This company is stealing my home of twenty years, through a reported SCAM that was organized through a venture capitalist business that never produced.
The CON ARTIST that organized the SCAM intentionally did not perform their contractual agreement after stealing the home equity from my home. The CON ARTIST were able to remanufacture documents that looked authentic, making their business look official, my loan was sold many times whereas ASC has received it and they do not want to recognize that they bought a FRAUDULENT, GRANT DEED OF TRUST!!!
The CON ARTIST were trusted with private financials and accounts making me a strong candidate for FRAUD! The DEED OF TRUST was used in the business venture upon services rendered, the grant deed was filed stating that I owed money to these thieves from NickelTown Pizza Inc., StartUp Capital Business LLC. and Private Fund Partners LLC.
I have shown ASC proper paperwork showing the fraudulent signatures and other areas of where there was tampering with my loan documents. ASC refuses to look into the situation or correct the matter, their defense is you signed the documents we have the right to sell the home. We don't care, there is no fraud, you signed the documents the case is closed.
I have asked to show proof of funds that I supposedly received from these CON ARTIST, they have failed to produce such documents. I have tried to show them of the other victims that have been deceived by this SCAM and they still do not want to find a solution to resolve the matter.
This company is absolutely crooked and deceitful, they are only looking out for themselves because they have a sh_t load of bad loans that they have to correct.
How can you sell a stolen home legally, when it is ILLEGAL to purchase stolen goods? The financial world is going to h_ll with the thieves and deceitful business practices from the banking institutes. Innocent consumers that rely on their expertise in Home Mortgage are getting ripped off, and the authorities aren't doing anything about it. We as consumers need a CLASSACTION LAWSUIT to be heard of all the different issues that are going on at the high level of "WHITE COLLAR SCHEMES, THEY ARE PROFESSIONAL THIEVES!!!"

Unfair dealing with customers
This Company is a mortgage servicing company for Wells Fargo. They are using their position to take advantage of homeowners. Homeowners that contact them for help are lead down a road of shams. People that own homes are not crooks; they are hard working people that have gotten into a dilemma. The problem with America's Servicing Company or (Wells Fargo) is that people for them have become numbers on a balance sheet. These banks go on the news and to the US government and ask for help. But went help is asked of them they offer their back hand. There was a time went people knew the bank manager and they would work out a plan to get things in order. But at last these days are gone. What we have left is a system that has failed us and will lead to more problems for the banks.

Rip Off
My loan was transferred to ASC in 9/2006. I'm in the process of trying to refinance my loan now. ASC will not provide my mortgage broker with my payoff balance because I haven't made this months mortgage payment. Also, after reviewing my payments I noticed that in 2yrs only $912.17 has been credited to the principal on my account and the rest has been interested. Since I pay $650/mo. there should be more paid down than this. This company is a fraud & strives to snatch homes away from american families.

loan servicing
after reading these and other complaints on related websites, I can say that none of you understand the commitment you made when you borrowed the money to purchase your home. you are all under the belief that the loan servicing company and/or mortgage lender is required to accept late payments and provide you with options to bring your loan current through payment plans and loan modifications. you need to sit down and read the terms and conditions of your deed of trust. an escrow account can be established if you do not respond to the servicer when they ask for proof of tax payments made or current hazard insurance. they are required by the deed of trust to ensure the integrity of the property. you need to remember, until you make that last payment on the note, you do not own the property. the lender has a right to protect their interest. also, if you are being serviced by ASC, it's because you are considered a high risk, subprime borrower. your credit scores are in the high 500s to low 600s. this is considered poor credit. the bank or lender has every right to protect themselves from default by charging higher interest rates because you have proven in the past that you will default on your obligations. your note states your payments are due (usually) on the 1st day of the month. there is no grace period (again, read your documents) on a mortgage payment. technically, you are in default on the 2nd day of each month if you have not made your payment. the servicer is not required to accept short payments, interest payments, payments of principle and interest if you have an escrow account. you agreed to the terms of the contract when you wanted funding for your home; but once it became inconvenient to make your payments, you start blaming your servicer for all your troubles. I will agree that any large corporation can and does make mistakes, but certainly not at the level these complaints would have you believe. read these complaints, these people admit they are in default, admit they missed payments and admit they wanted ASC to fix their problems. banks do not want your house. it costs more to foreclosure on a property and have to refurbish it and make all payments for taxes and insurance and maintenance while waiting for the property to sell. the bank makes its money when people perform their loans. that is what the interest is for. I'm sure the majority of you chose to take vacations or buy Christmas presents rather than make your mortgage payments on time. or you lost your jobs and expect the servicer to feel sorry for you. banks are not charitable organizations, they're not your mother. if you can't continue to afford your home, sell it or work two jobs or whatever you have to do to satisfy your obligation. stop whining and grow up. and by the way, ASC is a 'doing business as' of Wells Fargo. Wells Fargo did not purchase ASC; ASC is not a division of Wells Fargo; ASC services all subprime loans, not just Wells Fargo originated loans. if you're going to whine and complain about a company, you should at least know what you're talking about.

Poor Practice
Some of you may have seen me on msg boards like this, anyway I am going to tell you a little more about my situation with the great ASC... My house was going into foreclosure, like everyone elses, long story how we got there its was 50/50 fault, so we filed for chapter 13 and got back on track with our motgage payments, then Febuary 2008 our interest rate went up 1.5 % ($311) may not sound like a lot but it was when they never added tax and insurance in... Well we asked if the would do a modification on the loan in I thought March, they say May, either way we didnt get a letter from them till July 19th, Letter was dated July 11th . The Auction on my house was today July 22 @ 1pm So I called first thing monday am and did exactly what the letter said (in part) "...or to file for an extention you have to fax a hardship letter and finacial statement to us with in 10 days..." OKAY so I did. I faxed it over monday AM. I called about 8pm that night and they said they received it and to call in the AM (tues) to find out if the extention went thought. SO I DID, they bounced me around only to tell me nothing had happened as of yet to call about noon remind you the auction is suppose to take place at 1pm.. SO I called yet again at 12:30 to get bounced around a little more and I got SAMANTHA again (who I originally talked to on monday am) and she was such a ***, she said nothing was signed, which im sorry but there was this glimmer of hope and so little time to get everything faxed I did forget to sign it... She and the other people I talked to said that it usually takes 48-72 hrs for the extention... GRRR SO my *** is WHY DID THEY EVEN SEND ME THE LETTER!!! and tell me I had 10 days! My house is gone... and I except that.. but it infuriates me that they would even send that KNOWING that it takes 2-3 days for an extention to go though.. I know alot of you out there know what I am going though and by the looks of it there are going to be a lot more!!! I should add that I didnt get the letter untill the 19th becasue of the foreclosure we were having our mail held at the post office because we were moving... GOOD LUCK TO ALL THAT HAVE TO DEAL WITH THESE SERVICING COMPANYS!!!

Now suing them for 7 million
I refinanced my principal residence in 2004 with Peoples Choice Home Loan, Inc, who promptly turned the servicing over to America's Servicing Company, a division of Wells Fargo Bank. In January 2008, I contacted ASC and requested a loan modification refinance. On January 31, 2008 I was approved. I was to have my $85, 500 ARM rewritten to a 6.2% 30 year fixed starting March 1, 2008, with no payments for January, February and March - until my first payment April 1, 2008, with the interest for the 3 months without payments added to the loan balance.
Now it is the end of June, they have supplied no loan documents, and their attorney (who was supposed to handle the closing on the new loan) now having filed a foreclosure action on behalf of HSBC which has NOTHING to do with my loan, and ASC has added nearly seven thousand dollars to the balance of my old loan!!!
I have rescinded the loan and declared it void and unenforceable, and sued for over 7 million for the racketeering these people are engaging in. I welcome anyone with problems with ASC to contact me and possibly join my lawsuit and seek recovery and damages for their unconscionable fraudulent conduct. I will be glad to furnish you a copy of my lawsuit. I have been in the mortgage business since 1965 and know what they have done wrong and what the remedies are.
Their conduct is an outrage and everyone should seek to recover the injury they have done to you.

They’ve stolen thousands of my money
Since late 2005, ASC has added bogus charges to my mortgage, falsely claiming that I did not have homeowner insurance, had not paid my property insurance, etc. they even set a letter that Wells Fargo had cancelled my insurance! Not true!
I have been on the phone with them several times weekly...they promise they will refund my money if I send proof of insurance, which I have done so repeatedly. When I check that they have gotten it, they have, but the next time I call, they claim I have never sent it! What a nightmare!
Their latest trick is to claim that the terms of my original mortgage require hurricane insurance. It does not. Now they say that the terms "wind insurance" and "hurricane insurance" are interchangeable insurance terms. They are not. They now say they will "review" my mortgage terms, but that will take a while. Meanwhile my mortgage payment is about $1, 000 more than my original payment!
Naively, when I had provided them with all the insurance proof they had asked for, I asked them to credit the money to my mortgage payment. They did not do so. Too late, I found that they had reported me for non-payment to the credit agencies, and ruined my credit!
I have had continuous homeowners insurance and paid my property taxes, and provided them with plenty of proof, plenty of times. I have concluded that they are a thinly disguised insurance company, and have a whole battery of tricks to deceive and manipulate the consumer to get money illegally and not give it back. These are monsters! This is my HOME they are threatening!
I am at my wit's end...I should not have to spend all my days fighting thieves!!!
