I'm filing bankruptcy cause they cost me my home!
I am 25 and this was the 3rd place to get my loan. They constantly posted payments late. They didn't escrow my taxes and homeowner's on time which cause them to up my payments to make up for it and then they blamed it on me. My payment went from 580 to 820 in less than a year and a half. Now I have to file bankruptcy and move to an apartment because they took over 3 weeks to assign anyone to my case for loan modification and still haven't gotten it figured out and I have received my foreclosure summons. I don't know how they get away with this.

Forged signature on a refinance!
My husband and I began to search for our first home in 05. My credit score was a 628 which enabled my ability to be a borrower or co-borrower on the home. However he was able to purchase the home through their former company title Mortgage Lenders Network. the first mortgage did not include myself as any borrower but i was added to the title. On July 19 of 06 the house was refinanced through Mortgage Lenders Network. On this document I became a a full "Borrower". More disturbing in the contract there is a form dated 6/20/06 indicating I had signed a waiver of Marital Rights. this is bullshit!!! Never ever would i agree to such a poposturus agreement nor would i comply to refinancing a home without escrowing property taxes or home owners insurance. The house has now gone into foreclosure. I called the new ASC lender to get information on the property and was told i was not a valid person on the account. so which is it ASC do i co-own the property or not. I have hired a real estate attorney to clear this manner up.

Fraud and cheating!
As many of the other complaints I have read about, it is impossible to pay a bill on line or by phone, without a high fee. My loan too was sold to ASC, and it has been a problem ever since. Not only when you call their toll free number, do you sit on the phone waiting for anywhere from 15 to 20 minutes to talk to a live person, but when you do it costs you money to do so.
This company needs to change how it operates! They are making millions off of the various fees that they charge to people, and have really nothing to offer or show for it. You would think with what they do, they would have the means to have a better web site, and easier ways to make payment arrangements.

Charging incorrect payments to our checking account
America's Servicing Company tried to take out a payment that was three times the amount of the original check we submitted to them. We called to try to get the payment reversed and to get them to send our bank a letter of error, and all we got were stalls and run-arounds. One customer service representative told me that it would take up to 2 weeks to submit a letter of error. We're extremely angry because they caused the error and we're being penalized for something they did. We were told two different things by two different agents. They tried to tell us that they were having problems getting in touch with the department that normally handles these types of problems. When we asked for the number for that department, they told us they couldn't give out that information. This is our first bad experience we've had with this company, and if they handle business this way, they're in for a rude awakening. We as consumers need to learn how to combat these problems and take action against companies like this one. We will not take "NO" for an answer when it comes to our finances.

I gave up my house to get rid of ASC
I thought I was the only one having problems with ASC, until I was informed to come on this site. The more stories I read, the more it sounds like my current situation with this horrible company. I can’t express the heartache and anger they have created in my life, not to mention the damage they have done. All my problems began when my loan was SOLD to them. JUST AN FYI to those who have a choice to get rid of this company, do it now and quickly. It is only a matter of time before they trap you. Unfortunately, I was too late and had to sell my home!!!

Poor service!
I had my mortgage loan with GMAC mortgage when it was sold to America's Servicing Company. The first payment due to ASC was July 1, 2007. On July 3, I was called by one of their collections representatives, telling me my payment was overdue and I had assessed late charges already. I tried telling her that due to the transfer/sale of the loan, I would not have late charges on my loan for the first 60 days of the loan. She got very belligerent and started yelling. She said there was no such thing and I already had late fees assessed. I again tried to explain to her, but she started yelling again and I hung up on her. I hit redial on my phone and the number went to a private residence. I called their Customer Service number and talked to a rep there and told them what happened. The rep apologized but could not tell me who had called me. He said they might out service their collections but that I should not have even been called by their Collections department, but should have received just a "courtesy call."
Last month, I made my payment online. When I got my loan thru GMAC Mortgage, I was told that they don't often sell their mortgages, but mine was sold off 8 months after I got it. With GMAC, there were no fees for making payments online or making them over the phone, however last month, I find out that ASC charges outrageous fees for payments done both ways. Seems that checks are more paperwork and manpower than online and direct debits. In addition to the outrageous fees they charge, I found out they "accidentally" set my escrow account up incorrectly and I wasn't getting any interest on the balance in there. On top of that, I got a letter from ASC, telling me that I had to have a minimum of $832 extra in my escrow account at all times and said that my deed of trust said the mortgage company could request this. I have never had a mortgage company doing this. I called ASC about both issues. They were supposed to be sending me the paperwork showing where they could request a minimum extra amount. It's been 3 weeks and I'm still waiting. As far as the interest on the escrow, they said it could take 45 days to figure out.

Insurance payoff due to loss
My home was destroyed by a fire in June 2007. I received a check for the home from the insurance company. The check was not enough to cover the entire loan amount. I called ASC to see about sending them this check and when I sell the land paying off the rest of the loan. I was told to sign the check and send it to them and they would put it into an escrow account until I could pay off the loan in its entirety. I questioned this (because I know that escrow accounts are interest bearing accounts) I was told that this is their"policy" I don't understand why they cannot apply this amount to the loan leaving me with a much smaller balance. I suppose when it comes to big business they can eat us up and spit us out and have no feelings of regret for doing so. I was devastated after losing my home and now to have these morons saying they will hold the check just pisses me off. Does anyone know who I can call to help me with this situation. I live in Florida and I am at a loss,really at a loss.
I think for now I will hold the check and send them the entire pay off amount when my land sells. Play hard with me and I will play hard back keeping them from gaining any more money in my name.

Bogus 30 day late
On June 28th 2007 I called America’s Servicing CO (ASC) to confirm that my June payment was received on time because I mailed the mortgage payment that month only to learn that it did make it on time but it was applied to my May’s payment, which now was considered 30 days late and my June’s payment was still due. I asked the rep how could this happen and he stated “maybe your May’s payment was returned do to Non Sufficient Funds.” Not fully comprehending what the true cause was and without hesitation I quickly hung up the phone, got on the internet and paid the full June’s balance with May’s late fees.
As I finished my online transaction I began to research the scenario and discovered that my May’s payment was received on time (via online confirmation number ) and there had not been any payment issues with my bank neither. I called ASC back and enlightened the phone Rep supervisor BRANDY G2U with my new information, she conducted a phone conference with my bank, myself and ASC and she also discovered that my information was accurate. That being revealed she submitted an investigation request, asked me to fax in any information I had to support the case and informed me to call back in 15 days.
I called back on the 18th of July and the investigation was complete and ASC discovered that all the confusion was for my April’s payment and not my May’s payment. The Rep informed me that after they received my April’s payment it was was revoked in June by my bank. After speaking with the Rep I contacted my accountant and bank and researched the details in full and learned that I had submitted my April’s payment on time (via U.S.P.S.) and the full amount was deducted from my account. After concluding my own investigation I discovered and recalled that in Mid-May my accountant contacted me asking information about a check payment that was made to WFHM (Wells Fargo) on April 16th and did I have any knowledge of the payment because I have never made payments, nor have I conducted any business and I have never had a mortgage with Wells Fargo Bank in the past. Ignorant and confused at the time because of the growing ID theft problem, we quickly contacted my bank explained the situation and SunTrust Bank began an investigation on the check. Unbeknown to me at the time that check was my April’s Mortgage payment to ASC. After concluding their investigation nearly one month later my bank deposited the money back in to my account. We attempted to gain more information at the time to find out whom the Wells Fargo mortgage belonged to but my bank wouldn’t disclose any information, stating it was for “Privacy reasons.”
I absolutely had no Idea that at the time that Wells Fargo and America’s Servicing Co. were affiliates. When America’s Servicing Co. purchased my mortgage from New Century a year ago, they never informed me formally or informally that the two companies were connected.
I have contacted ASC constantly over the last two months to resolve the matter and wipe the blemish from my account and credit file but they denied me. Also, my mortgage is due to begin adjusting this December of 2007 and if I don’t refinance it I’m afraid I won’t be able to afford the payment.
I understand the growing mortgage problems in our country at this time and I fully understand ASC’s concerns and position but this was a very honest and rare mistake that could have happened to anyone at anytime. I have never been late on my payments in order to build my credit up. When I purchased my home in 12/2005 I had a 610 credit score. Over the last two years I haven’t incurred any new debt, I have paid off all credit card debt and the only thing on my credit is student loans and my mortgage payments, which I have paid on time and consistently. Before the thirty day late from ASC hit my credit file I was comfortably at a 692 middle score credit rating 6/6/2007, perfect positioning to re-fi my home to a fixed rate.

Rip off!
This is the worst company i have ever been with. They bought out another lender and call at least 5 times a week asking me to make a payment. Their rates went up within a couple of months without letting me know about it. Never deal with this company.

Promise to work with you, then cheat you
This company promises to work with you. You fax them all the information they ask for. In the end they do not work with you. They add hundreds of dollars to your payment when you get behind. I borrowed money from my 401k according to the paperwork they sent me. I then got a letter saying i was already behind 2500!! If they had sent me the correct paperwork then my 401k would have sent the correct amount. Since the check was already mailed I could not get the rest to catch up. They make it hard to catch up because they add hundreds of dollars. This coming is a nightmare and am sure there are many that have lost sleep over this. I use to think they want to work with you, I no longer do. I think they want to foreclose. They dont care about the people. They are not willing to work with the people to save their homes. I wish you all well and hope that you can find another way to get your life back, be sure it will not be with this company.
