Americredit recently repo'd my car. I was shocked to wake up one morning and see a missed call on my cell phone @ 3am. I wondered who would have called me @ that hour. I didn't recognize the number of the missed call. I listened to the voicemail. It was mortifying to hear a man's voice on the other end saying, 'Cass, I'm here to repossess the vehicle! You must contact Americredit for further instructions'.

This was a horrible mistake. My first call to Americredit was not pleasant. I spoke to someone in the reinstatement department who felt it was a laughing matter. She suddenly stopped laughing, when I reminded her that this was no laughing matter. In February 2008, I deferred Jan 2008, and February 2008 car payment. My plan was to trade the car in for a new or slightly new. When I called to ask why the vehicle was repo'd, the first thing they said was ' why are you so far behind in your payments' I explained That I wasn't behind. Only marchs' payment was behind. April's payment was 6 days late @ that point. Americredit was adamant that the payments I deferred were for Nov/Dec.2007.

Do the math.If I would've waited until February to make a payment, I would've expected the car to be repo'd. That would've been 5 months without a payment. I asked for a copy of this deferral but was told 'no', 'we don't give copies of this in writing'. So this is their word against mine. They have nothing with my signature stating any acknowledgment that this deferral was for Nov/Dec. The next day, I went to retrieve my belongings from the repo'd car. The most valuable item in the car was my fairly new digital camera. Yes, it was stolen. Americredit could care less that the company that they chose to come and repo the car, removed items from the car that didn't belong to them. I don't care about the approx. $40.00 in loose change, my laundry detergent, bleach, large bag of naval oranges and antifreeze that they took from the car. But at least they could've left my camara. If not the camara, my memory card. I asked Americredit if they were aware of the local laws required to repossess items from the consumer. 'Barb', from Americredit stated that she was not aware of any laws regarding repossessions. I will be proceeding with filing a police report for the missing camara. That is the only way that I will feel some type of closure from my stolen memories, aka pictures.

I paid my car off in Feb. 2008. I was never late with a payment nor have I ever had any previous dealings with AmieriCredit. I have yet to receive the title to my car, a refund check, or a "Gee, I'm sorry for the inconvenience". On the contrary, they act as if it is my fault. They keep telling the same thing over and over, "The title was mailed out...» The irony is AmeriCredit never missed sending me a monthly statement, showing how much I owed them. Now, I am just another annoyance that they have been putting off for nearly three months.

I called in to make my truck payment via check by phone, I spoke to a really nice lady and with in 15 minutes My payment was made she then asked me would you like to set up next months payment with a post dated check? I responded with O no thank you I 'm pregnant with twins a 3 yr old a 9 yr old and my husband is over sea's in Iraq so I don't know exactly what day next month would be a good day, but thank you for asking and trying to save me time, She responds with O my I can understand and good luck to you abd y tell your husband I said thank you for serving our country. That was the end of our call.

Then 2 weeks later my husbands grandmother had a stroke and blood clot in her head so the kids and I flew to Florida asap, that was on the 28th well since we are military we are paid the 1st and 15th so here comes the first I paid our bills online and withdrew some cash still leaving 400.00 in our account, then the next day I went to put gas in the rental car and my card was declined WHAT I THOUGHT NO WAY, so i called my bank to find out americredit withdrew 530.00 or tried to anyway but them trying held my account 530.00 that wasn't there for 2 days that caused my bills to bounce and left me pregnant with 2 kids in florida with 0 money to get home I called americrredit and asked why after I said no to a post dated check by phone was it done anyway they responded with no you agreed to the transaction I said bs i did and yall just cost me 600.00 in nsf fees and bank fees they responded with o well we don't care what we cost you we still didn't get our money (for a payment that wasn't due for 13 days). Then they continued to try and with draw money every 6 days only costing me more money each time.

I had to close that account and open a new one at another bank all because in the state of Texas if you owe a company money and give them access to your account they can legally with draw at there pleasure. Over all this cost me $2000.00 in fees. and even after I gave americredit all the proof from the bank of what they cost me they said they would credit my account that was 8 months ago and they still have not!

Unfortunately for me I have been a client of this company for about 16 months.

The problems are as follows:

I make payments for a car loan timely, using the Americredit website to make the payments, but yet Americredit either loses my payments, holds my payments until atleast the 16th of each month, (which is 9-10 days after the payment is due), or does not credit my account.

I have sent proof to this company of my timely payments numerous times and yet they still have not corrected my account.

It is now about 16 months 13-14 of which I have been arguing with too many of the Americredit supervisors, proving to them our payments were made timely and correctly but yet the account is still wrong.

I have demanded the correct payoff figure for the vehicle but it is like I am talking to a wall.

I too am 1 of possibly 100,000 people this company is abusing with these business practices, and harassing collection calls and horrible business practices.

Americredit is also listed with the BBB due to it's horrible business practices.

I have personally sent the BBB 3-5 letters complaining about Americredit, but Americredit seems to ignore my complaints.

Americredit has called me from Toronto, Canada, which makes me think they are trying to by pass American Consumer Protection Laws.

As a last resort I am asking both of your offices for guidance, and if possible would like to start a class action lawsuit. If you know of a legal firm that might be interested in handling a lawsuit against Americredit please recommend it.

In summary I have demanded the payoff amount to be correct and the account be up to date and correct. I would think that there are numerous people in the same situation as I am in and we would like to sue or be part of a class action lawsuit against Americredit and the dealer that processed my loan with Americredit VIP Auto in South Plainfield, NJ

AmeriCredit charges the most fees of any loan company ever. Now they have started charging $5 to make payments online (after two years of making payments). In addition, if you are late, they charge a late fee and then, interest EACH day you are late.

God forbid you are ever late. They hound the hell out of you with at least four calls a day. If there is any way around it, DO NOT DO BUSINESS WITH THIS COMPANY. The way they do business has to boarder on illegal.
