last year, a driver for apache moving and storage here in austin texas, STRUCK MY VEHICLE with their moving truck. driver, helper, witness, all saw and corroburated (?) my story to the owner of the company. i took pictures, etc., and the storage facility (Uhaul) manager also saw my truck damage and spoke with us after the incident. after months of trying to negotiate and get mr. oliver to pay for the damage caused by his driver, now i am having to sue them in small claims court. i had to have my truck repaired, paid for the damage, now suing him cuz he still refuses to pay for it. he said the drivers fault so he should pay, told me to call his insurance company, etc., etc. but he was on company business, so his insurance wont pay. but apache movers insurance wont pay either cuz damage not caused by the trailer door swinging open, caused by the driver leaving the door open. HOW STUPID IS THAT????????? owner, mr. oliver, said he would pay on couple of occassions, then said no cuz going thru bankruptcy so didnt care, would get dismissed anyway so stop calling. tried better business bureau and mediation, but still to no avail. "not my fault, sue the driver, he's quitting anyway." then contacted his attorney, bankruptcy cleared a yr ago. WHAT A LIAR!!!
now suing in small claims court but they cant make him pay either.
SO GOOD LUCK to those who use ANY BUSINESS without contacting better business bureau and checking on complaints first. i should have and didnt. (he already had complaints and previous moving license pulled by tx dept. transportation) what a costly lesson i learned ($1700.00) UUGGGGGHHHHH!!
