I have realized that when a person goes to rent an apartment or house of any kind, it is best that you have a lawyer on hand. First of all, the way that the agreement is laid out, it makes it easier for companies to leech more money from hardworking individuals in an already broken economy.
First: Rent is due on the first of the month and is late after the fifth of the month. After the fifth, if rent is not paid, there is a late fee of 5% affixed to your rent. If I am not mistaken we as the working people cannot dictate the day that we want to be paid. I know that I get paid every two weeks and my payday doesn't always fall on or before the fifth of the month. The Apartment Association of North Carolina which will be referred to as AANC states that: You will owe Us the late fee without Us having to demand it from you. (And yes they have Us capitalized.)
Now check this out. AANC Lease Agreement states that if you are in default of this agreement in You owing a debt to Us, the debt should accrue interest at an annual rate. Which for my landlord is a cool $100.00 bucks. They think that money is easy to come by when the minimum wage is what it is.
Third. Do not get the dreaded eviction notice to go to court. If they go there they tack on an extra $90.00 to $200.00 bucks for court cost. Yeah you must pay that to if the judge rules in their favor. Money must grow on trees in these people minds.
Check this out. AANC lease agreement states that you must give a 30 day written notice to your landlord before you can move out, but you can not break the lease before the last day of your rental term. What does this mean for you? If your lease ends on July 31st, don't turn in your notice before that day because your landlord can deny it. You must turn it in on August 1st. But surprise. If you turn it in on the 1st of August you are responsible for August rent because you are still there. That also includes month to month leases. What a crock of dog po.
What if you find a better place and want to break your lease? Do you have more money for the leeches? If you are on a 12 month lease and want to break it and move, you are responsible for the rent payments until the end of the lease term. Why you ask? They may not be able to rent it out right after you leave. So the AANC lease agreement wants people to pay for a dwelling that they are not staying in. Money for nothing.
Next the AANC lease agreement states that your landlord has the right to enter your dwelling at anytime at Our sole discretion. Even to show the dwelling to potential renters in the last 30 days. Breaking and entering legally I guess. Instead of giving you rental insurance if someone is going to be entering your home, they suggest that you get your own.
There are tons of complaints about landlords and apartment communities online, but I think that progress would be made by the rewriting of these screwed up lease agreements. After leeching money from under paid workers, they send this information to credit bureaus to tarnish your person and make it hard to live. 9 times out of 10 if you are evicted you can get another apartment, house, or condo, without paying a full months security deposit and the rent depending on the day you move in. That is not an easy task for someone making minimum wage and paying other bills.
These rental agreements are made for the landlord to win the battle, leaving the tenant broke, with no credit, and no where to live. Making more and more homelessness. We elect political officials to change these things, but I guess they forget that they are elected by the people for the people.
