I discovered my rental deposit not being returned tome from the Owner(he was holding the deposit), only 6 months after we moved out of the house, due to the agent keeping quiet that she had not had the deposit returned to use a deposit on the next place we rented.
To add to this, tyhe owner did not want to return it as he felt that the inspection was never done with him being there and thought the existing damage to the house was done by us when it was not. Therefore the agent kept quiet about this for 6 months until I brought it up with her(Marlene of At Home Letting).
Recently I discovered that At Home Letting used a completely fraudulent ID number of the owner on the contract, which could potentially casue me problems to claim for my deposit back. The agents decided to use the owner's partner's ID number on the contract instead of the registered owner's ID number as should have been used. This indicates to me that they never got a copy of the owner's ID before completing the contract, however tyhey made a copy of my ID. This does not protect me, the Tenant, and in a previous case I had at the Rental Housing Tribunal, which involved this agent to, she told me I lied about never receiving information updates on the deposit not being returned from this agent, however this is not true as she has no proof of registered mail asking for a new deposit as the previous deposit was never returned to me and left for me to follow up on it.
This does not protect the tenants deposit and the agent never did the Inspection properly, otherwise we would never have experienced these problems, and now I am in the process of legally getting my deposit back from the owner as the agent tried to dismiss any responsibility they have of this problem.
Please inform me as to what I can do, as I do not take it kindly that the Id number was never correctly recorded in the first place, yet mine was. This only adds trouble to the tenant when all I try to do is be a good tenant and do the right thing.
