I purchased a 2002 Explorer Sport Trac from Autowise in May of 2010 (Policy/Contract No. AEFL200158), along with a 5 year, 100, 000 warranty. I was involved in an accident and the truck was totaled in August of 2010. I immediately reported to the warranty company that the truck was totalled and that therefore I would need a refund.
Today is past the 8 week mark indicated in the contract as the maximum time before a customer will receive the refund. At this point in time, Autowise LLC has my funds at their disposal and is refusing to issue a check to me "until mid-November." This is unacceptable to me. That is my money, and the dealership has absolutely no right to hold it from me past the eight week mark indicated in the contract. Both the dealership and the warranty company are refusing to tell me the amount of my refund ($1100, minus a $50 cancellation fee, minus proration for the amount of time I had the vecicle before the total loss.) The dealership staff and owner are repeatedly giving me different stories regarding the process - first, the dealership has nothing to do with the refund, then they did, then I could have my money the same day they received it from the warranty company, then I have to wait until mid-November. This company should value my business as a customer, and should honor their own policies when they sell a contract. They are keeping a large sum of MY money in their accounts, and causing me undue financial hardship by doing so. It is unacceptable.
Chad at this dealership has done nothing but give everyone the runaround since day 1. I have heard continually different stories from himself and his staff regarding when I can get my refund. He told me to expect my refund in the middle of November of all things, and after numerous phone calls to himself and the warranty company changed his tune and told the warranty company he only said 10 days. A lie.
Yes, I do believe my set of circumstances supercedes all other parties in this matter, this is MY money we're talking about. I will not accept any hardship upon the welfare of my family so that this man can hold my money in his accounts and collect the interest on it. I cannot walk into his dealership and drive away in a car without paying, I cannot tell him I will pay him when I pay the rest of my bills. I payed in cash for the warranty on the same day that I purchased it. I was in contact with the dealership and the warranty company from the day following my accident, and was assured by both companies that my refund would be delivered to me within a reasonable amount of time. The warranty company assured me that it would be within eight weeks. They have delivered on their promise, and despite the fact that 8 weeks is a ridiculous amount of time to transfer funds, they did deliver as they agreed to. I was assured by the dealership more than once that I could come get my check as soon as they received it. Both companies have continually refused to provide me with the amount of the refund, a fact which I find to be dishonest, unnerving, and shady to say the least.
On top of the fact that this man is holding my money in his accounts for absolutely no good reason, he is rude and sexually discriminating. A phrase like "Well, SWEETHEART, that's the way a business works." should never come out of any professional persons mouth. In fact, it seems to me that only someone very ignorant would dare to use such a phrase with me, someone who is most likely far more educated in the field of business than himself. I know how a business works, and this man has no idea what good business practice is. The customer is always right, go the extra mile to make them happy. Keep your prices reasonable and fair, and stand by the word of yourself and your employees. A good business owner will hold himself and his employees to the highest moral standards, stand by his promises, and not take anything that he didn't honestly earn. A good business owner does not falsify reasons to keep someones money and lie to anyone who asks him about it, as Chad has done.
This dealership is nothing more than a building full of theives, and the owner, who should be worried about his business more than anyone, is the biggest theif and rudest person there by far. This would explain the countless complaints about their scandalous business practices that I have found in my further research. This explains why they will get many more from me. This explains why I will make it a point to tell anyone and everyone I know that Autowise of New Port Richey is the last place any sane person would want to buy a car.
This man has absolutely no right to hold my money from me, I know from the warranty company that the funds have already cleared their accounts. I have heard nothing but lies and degrading statements coming out of this mans mouth, and he ought to be ashamed to call himself a man or a business person of any kind.
I will be in the dealership on the 22nd of October, after I leave work, to pick up my check as Chad promised me numerous times I could do. Although Chad has lied and changed his story numerous times, this is the shortest amount of time he was willing to budge on this issue, as ridiculous as that is. Any further harrassment of me or my family by witholding my money will result in continual complaints to anyone and everyone who will listen.
I do not take being taken advantage of lightly, nor do I take the matter of sexual harrassment lightly. I did not get where I am in this world by allowing dishonest people to take my money and treat me in the manner that this man has chosen to. I don't care what his "business practices" are - they are wrong. He needs to fix them.
