I was involved in a car accident with a Commercial Vehicle belonging to B & P Jr Fence on the George Bush Tollway in Plano, TX. Their driver was cited for causing the accident. At the time of the accident, the driver had no proof of insurance and once the DPS officer arrived, still could not produce proof. In contacting the Owner of the company, Martin Armendariz, the DPS officer was told that they had insurance, but he had just neglected to have it in his truck. After assessing the accident and issuing the citation to Jorge Armendariz, the officer let them drive off in their vecicle. Though damaged, it was driveable. My car was NOT driveable and was towed to a Body Shop.
In the accident, my foot received an injury, for which I was in treatment for several weeks. My vehicle was nearly totalled, and because I was in outside Sales, had to rent a car for the duration of the time that my vehicle was being fixed.
I contacted B & P Jr Fence owner, Martin Armendariz, and he told me that he would pay to fix my car. When I told him that I was also going to have to have a rental car and had injured my foot, he turned aggresive and asked me why I wanted to get money from him! I explained that all I wanted was the money I was going to be out of pocket from the accident. He refused and hung up on me.
I then contacted an attorney that pursued both the Owner, the driver, and the company. There was no insurance that could be verified and they refused to answer any interogatories that were served to each of them. I was then told by the law firm that there was nothing I could do to recover any money from the company, as they had no insurance from which to claim.
This company obviously is not reputable! They don't even carry liability insurance on their vehicles and refused to step up after their employee caused an accident! This would concern me if I were trying to do business with them. They can pay their illegal family members who work for them, but can't abide by State or Federal Laws and carry liability insurance. Would you trust that they carry insurance to protect you as a consumer? Would your Homeowners Insurance have to pick up the tab if one of their workers got hurt on your property while building a fence at your residence? Most likely, you'd be left holding the bag like I am.
FYI... by the time I was notified by the Attorneys that they couldn't pursue the case, my statute of limitations ran out on being able to file against them in court! Gotta love the system!
