Their home loan modification "Help"
Hello

I hope you can follow along, I know my ranting might get a little confusing.

My name is Jessica. My husband and I purchased our very first home in Temecula, CA in 2006 at the peak of the market. We purchased our house for $362, 000. Our first mortgage was through Wilmington Financial then was sold to Wilshire Credit Corp then recently sold to Bank of America (BAC Home Loans Servicing). We did fall behind on some payments with Wilshire but we had worked out a forbearance agreement in May 2009 that lasted six months. After the six months were up we continued to pay Wilshire on time every month while we worked out a loan modification but Wilshire went out of business and sold our loan to Bank of America before we could work anything out. Bank of America first contacted us in March of 2010 and told us that we would start paying them in April and that since we had a partial payment in our account, from when we paid Wilshire, we had a payment of $573.00 due no later than April 15th. Our regular monthly payments are $2046.22 which were supposed to continue in May 2010 while we worked out a loan modification with BAC. We were told by three different employees of Bank of America at three different times that we only had to pay $573.00 for the month of April and we have the conversations recorded. My husband and I sent out a check in the amount of $573.00 to the address provided by Bank of America on April 9th. On April 15th, the day that the payment is due, we get a call from Bank of America at 8:30PM (they close at 9:00PM) saying that they WILL NOT accept our payment because it is not the full amount and that we are in "FORECLOSURE"!! This is a load of crap! We had been paying our payments on time every month until this month when they refused to take the "partial payment" that THEY TOLD US to send them. Not to mention they call us on the day the payment is due at 8:30 PM, giving us 30mins. to figure out what is going on AND the girl on the phone, Anahi, LIED to us when we asked for her supervisor by saying he wasn't there. Only after repeated demands and after my husband asked her if he could record the conversation did she transfer us to the supervisor that supposedly wasn't there. Supervisor Danny ext. 1213 finally gets on the phone at 8:57 and basically says the same crap and isn't any help at all. Thanks for the three minutes of non-help Danny and Anahi you're a real gem too.

I am left to believe that Bank of America wanted us to miss a payment because they want to foreclose on my house. They probably paid Wilshire a few thousand dollars for our mortgage and they know that if they foreclose on it they can turn it around and sell it for at least what it has been appraised for which is $178, 000. Yes that's right the current value of this house that we are fighting so hard for is $184, 000 less than what we paid for it in 2006. On top of the bail out money from all U.S. tax payers, Bank of America is making out pretty damn good huh? and I love all of this talk about how Bank of America is the first bank to help struggling home owners by reducing principle. PLEASE!! The only people that qualify for this program are people with underwater mortgages through Countrywide Financial. Countrywide was bought by Bank of America in 2008. What about everybody else??

I have now decided that all I will be doing over the next few days is exactly this. I am writing and calling and emailing and faxing everyone I can to let them know that this is going on. I am sick of banks screwing people over like this. I am contacting news stations, blogs, California senators, lawyers and anyone else who will listen. The banks are making it nearly impossible to have any kind of home loan modification done. They are pushing people around and stressing them out until they give up and let the bank have their homes.

We are good people. We are getting back on our feet and are able to make decent monthly mortgage payments. We just want to get a slightly lower payment amount and a fixed rate that we had hoped to get through a loan modification. We have two children and need to make sure that they have a roof over their heads. We are willing to do anything to keep our children in their home including being the loudest, biggest pains in the ass that banks have ever seen. It's sad that it has to come to this to get anyone to listen to you but oh well.
