Irresponsible bank who screwed my credit and my home is in foreclosure for nothing!
I have paid my Making Home Affordable and HOPE trial payments on time and had a perfect credit score until BOA screwed me over and now my home is in foreclosure for nothing. They keep on asking me for pay stub copies, tax returns and I keep on sending them in and then they say oh, they could not find it and now the time is up for the program; so guess what... We will take your home, just sign off on your Deed and hand it to us! Can you imagine? These people are scumbags. I hope their homes go into foreclosure!

Mortgage Practices
Please be advised that beginning in December of 2009, I initially called Bank of America, and applied, and was pre-approved for the Home Modification Affordability Program. I received nothing from Bank of America (BAC) in the form of any documentation pertaining to this application. I called late January to follow up with the application and I was told because it was under 30 days that the representative would be unable to see my application and told me to be patient and that the initial wait for a turn around time went from 30-60 days to 60-90 days. I called back in late March when I noticed that my mortgage payment went from 1800 and change to 2600 and change, luckily I was able to procure a reduced flood insurance, and brought my payment to 2100 and change, however, I was already having difficulty making a payment as it was. I failed at making any subsequent payments. (had my mortgage stayed the same I would not have been late on any of my payments) But, I did called BAC and inquired as to what was happening to my Home Modification Affordability Program application, I was told that it got “lost” in the system and that paperwork would be sent to me as soon as possible, within 10 days I received my paperwork, within 10 days I FedEx’s my paper work back—my paper work had EVERYTHING that was requested of me and subsequently sent the information they requested of me, and I have a confirmed date of delivery through FEDEX (tracking number: 798561890243) of May 14th. I have not heard anything as of yet. The following are the barriers that I encountered in attempting to reach someone at BAC to help me locate the status of my application. The following collections of events began on Monday June 21st, I when I called Bank of America. The following took place during 2.5 hours of call time
1. Transferred 11 times
2. Given several wrong phone numbers
3. Disconnected 5 times, including once by a supervisor in the HOPE department.
4. I was told the following: a. my application shows a missing document., however no one's system can tell them or me what that particular document is. B. the HOPE department who is supposed to be in charge of that particular information, well, "I am not showing up on their systems at all' and when I spoke to the supervisor he advised me to "hold on" while he contacted some people, I was disconnected. Again, I called and spoke with a woman, who would no longer assist in the transfer and gave me another phone number; this number 800-669-6050 is also a non working number.
I called again on June 30th at 1:10pm, I have been transferred twice, and disconnected twice (one woman Sheryl actually called me back) and retried the transfer, I was on hold with Niesha for over 20 minutes. She confirmed that I have missing documents but cannot view them (she works within the loan paperwork department), she also confirmed that the HOPE department does not have me in the system, and that my loan is being reviewed (but can't tell me by who nor when I can expect assistance--even though online it states that I was supposed to hear from Bank of America 10 days after they received my documents). I was transferred again and once I was put on with the Home retention/delinquency department I was again...disconnected!!!
Now I just tried calling again today August 14th, I called the number provided on my bill 800-669-6654, after going through the virtual system I was being transferred to a representative, and once again was disconnected!!! I only called this one last time so that I could see if BAC wanted to keep me as a customer, because at this point I have acquired an attorney to conduct my home assistance application, because BAC has failed to do so or even help me on more than several occasions. To give you a little insight on how dire my situation has been, I will inform you that I was injured in November of 2008, my salary went from 120K + to 24K annually (funding came from workman’s compensation), my wife a full time graduate student began teaching as a professor at CUNY in order to try to make ends meet. We initially called when the injury first occurred and we were told that to receive help we must be late on a payment, now it is more than oblivious we tried everything in our power including cashing in our retirement funds, borrowing money from family, to never miss a payment, but when push came to shove and I attempted to reach out for help, I was kept hanging from a thread for over 7 months, and even now I can’t even get through to anyone!! This to me is very poor business and service on your part. We were good customers who were actually ahead of our mortgage payments by a month, for the past two years prior to the injury. We were failed by your bank time and time again.

Harassment
I'm not even a customer of BOA Home Loans and never have been. Some woman who shares only my 1st name is and for some reason my phone # is in her file. They call me at least once every day and some days 3 or 4 times a day. Every time I answer the phone I go through the whole thing over and over again. They say I've been taken off of the list and then an hour later or the next day they call me again. I even got a prerecorded solicitation call the other day telling me there was some conference in Las Vegas. AHHHHH!!!
BOA please if you read this, the phone # ending in 4600 on Elizabeth Martinez's records is not hers. It is mine, STOP CALLING!!!

WAS IN A LOAN MODIFICATION WAS REMOVED WITHOUT KNOWLEDGE AFTER 1 YR...PAIDALL MONIES THAT WERE DUE BUTNOW THEY SAY I AM IN DEFAULT, , SENT IN FEB. 1, 266.00 AND WAS ONLY BEHIND 1 MO. ON PROGRAM, FOR MAR. SENT 410.00, AND THEY SAY I AM STILL BEHING1, 649.04...WAS ON A FIXED RATE WITH COYNTRY WIDE BUT BANK OF AMERICAHAS CHANGED IT TO A MODIFIED CONV. ADJ. RATE MTGE..DID NOT KNOW THEY COULD CHANGE YOUR RATE WITHOUT INFORMING YOU..BALANCE ON HOUSE IS NOW HIGHER THAN WHEN FRIST PURCHASED, , DON'T KNOW WHAT THEY DID WITH MONIES SENT TO THEM AND THEIR REPRESNTIVES ARE UNKNOWLEDGEABLE, ONE TELL YOU ONE THING AND ANOTHER SAYS SOMETHING ELSE...MY WAGES HAVE BEEN CUT DUE TO CIRCIMSTANCES, , , BUT THEY SAY THEY CANNOT HELP ME, DO NOT WANT TO LOSE MY HOME AS MY HUSBAND DIED HERE IN 2008...MY MORTAGE WENT FROM 421.00 PERMO. .WHICH I COULD AFFORD, , , , TO 824.52 PER MO..WHICH I CANNOT, , , PLEASE HELP ME, , DO NOT WANT TO LOSE MY HOME HAVE BEEN HERE FOR 8YRS.

Make Home Affordable Program negligence
Bank of America is neglecting and abusing the Make Home Affordable program. They have no desire to help anyone or extend this offer in the way they are supposed to.
I have never been late on anything and had no late payments ever on anything in my credit history, but lost my job due to disability in Jan of 09.
Bank of America refused to work with me, and after many months continued to tell me there were no options and that I couldn't qualify for the MHA program because FHA was not a part of it. Yet they continued to send me letters with options and I would call them every time. When I called they continued to say there were no options for me and that in fact I would have to pay even more than I did before monthly.
I started receiving Social Security Disability and am able to pay my mortgage but BOA refuses to even work with me. Then one time I called they said that FHA joined the MHA program. So I applied - by then it was Sept 09. I meet all the criteria. But I'm still waiting. It is now April 10, 2010. Every two months they send me an identical package to fill out and request the same paperwork that I've sent 5 times. They continue to stall. I'm not allowed to speak to my negotiator and every time I call I get different information from the flunkie who answers the phone.
Once, they even told me that it was incorrect that FHA joined the MHA program (after they told me they did and made me jump through hoops many times). Then next time they told me, no, that person was incorrect and FHA did join.
I can not believe the incompetence BOA is exhibiting with this government program designed to help people just like me - who WANT to keep their home and need a little understanding and a fresh start. BOA doesn't want to help anyone.
Today they told me my negotiator is on leave of absence and my case is now in limbo while they try to assign a new one, but they don't know when that will be.
I feel like I'm dealing with a used car lot every time I call. Their gross mishandling of my case is inconceivable - especially since I've been in my home for 18 years and really want to do a work out. I don't know where to go for help. I got an attorney to handle the foreclosure and hopefully be able to stall that while the HOPE dept of BOA gets off their collective butts and reviews my case. BOA even told me that if a sale date is set on the foreclosure before they get around to reviewing my case for a modification, I will lose my house. I'm HELPLESS against this bank.

BOGUS HOME AFFORDABLE PLAN
In July 2009 I applied for Home Affordable plan as I had lost my job in January and was not able to get another job. Afterwards, I kept receiving calls from them once in a while assuring me they were working on it. But, nothing happened until this February when somebody called me and told me that I would be contacted within a month about this. I thought, at last I would be able to get this, instead of having to walk out and lose all my money. Even through my unemployment period, I was paying my interest only mortgage which is going to end this August. Since I bought this house, I have been paying my property taxes myself.
However, suddenly this month, without any explanation, I received a notification about my escrow analysis from BOFA saying that there is a shortage of escrow and hence, I need to make it up for that and they impounded my property tax with the interest. When I called the bank, they told me that it is required for Home Affordable plan and I would receive a package within a couple of weeks with a reduced payment. But, on Friday, I received a coupon for next month's payment that includes additional $673 for escrow! Probably this is how the BOFA makes your home affordable! Nowhere it told me why it is impounding my property tax with my interest. Neither did I agree or sign saying that BOFA could impound my property tax with my mortgage.
I did not go to BOFA for mortgage. My original mortgage after changing companies reached BOFA. My experience makes me realize that this is the worst bank ever on this earth which does not care for its customers. All my complaints on their website are completely ignored!

Misrepresentation
Making Home NOT affordable should be the name of the program. I've been in contact with various people from BOA since July when I was laid-off and unable to make my mortgage payments. Finally in October I was told I qualified for the Making Home Affordable modification plan and I had to make 3 consecutive trial payments and I'd be receiving a modification packet. The 3rd trail payment was on Jan 1st and nothing came but was told when I made that payment that they were running behind and I would have to continue the "trial" payments until I received the documents. So, I called today 1/30/10 to make my "trial" payment and check on my status. The representative told me that my trial period expired and she needed to update my financial records. I've since gotten a temp job and yippy my income went up $45 a week. So, now with her recalculations my new "trial" payment is $300 a month more and $100 a month more than my regular mortgage payment, which of course I'm no longer allowed to make. What makes matters even worse is that she then tells me that this is all because the original agent I talked to failed to lock in my trial and modification and that there is nothing they can do now. So, now do to their failure to lock me in, even though I spoke to someone no less than once a month for the last 4 months who all assured me that I was approved for the modification, I will now probably loose my home because my payments are now more than before and more than half my income!
HELP!

Bank Error
Yesterday I received a letter from my bank, which gratefully is not Bank of America, informing me that the payment for our mortgage was refused by Bank of America Home Loans. When I called Bank of America Home Loans I was told that my home was in foreclosure and that no payment would be accepted unless it was by money order or cashier’s check. When I asked why my home was being foreclosed on since until my payment was refused I have never missed a payment or been late, I was told she didn’t know and that I had been sent a notice that explained everything. I told her that I had never received any notice. She repeated that I had been sent a notice. No matter how many times I told her that I had gotten no notice, she just kept repeating the same thing. Finally I told her I told her that I have never missed or been late on a payment and that I needed to speak with someone about this. She transferred me into cyberspace somewhere and I was cut off. I proceeded to call again and the exact same cycle repeated.
Since we did not want to be in arrears, my wife went out and bought the necessary money orders (formerly I had simply sent payments online, and again with never a problem or a single NSF), and went to the local Bank of America to make the payment in the “required” funds. Again, Bank of America refused to take our payment saying that our loan was in foreclosure. She asked again why we were in foreclosure since we had not missed payments or been late, only to be told that they didn’t know and that we’d have to talk to someone at yet another telephone number. Then she was told that she would have to wire the money by Western Union to Bank of America with a special code which was given to her. When she went to Western Union, she was told that they would charge her 10% of the amount of the loan payment, in our case $114.00 plus the $12.99 to wire the money since the funds were in money orders (as I had originally been told was required), and Western Union had to cash them before sending the money. My wife called me in tears and I told her to come home. We had spent more than three hours (not to mention a very sleepless night) between the two of us trying to straighten this out.
This morning my wife called the telephone number the local Bank of America had given her and spoke with a woman who finally found out that our home had been routed to foreclosure in error. She said that they had removed the foreclosure code so that we could finally make our payment bringing our mortgage up to date. So this afternoon we went back to our local Bank of America to make our payment and were told that the foreclosure notice still was not lifted on our account. The Assistant Manager told us that Texas and California are on two different computer operating systems and so it probably just hasn’t made it through to the Texas system. He said our only recourse was to send our payment by Fed-Ex, which we did, but we are now in the position of having to wait until at least Tuesday of next week to find out whether or not our payment will be accepted and whether or not our home is still marked incorrectly as in foreclosure. Someone at Bank of America’s mistake has made our life a nightmare.

Short Sale Approval Letter Canceled
For 6 months, we provided Bank of America every document required for a short sale on HELOC. We got a full approval letter with all the details. We called to set the closing, and they canceled the approval for no reason ( a glitch) they called it.
No one is willing or capable to invetigate what happened. Our negotitor says it is a mistake, but no one knows how to fix it. We are told that 6hese is no dept to check this out!
Buyer sold his house, we secured new housing.
Who at the Federal Goverment is willing to check these guys out?

account screw up
My account was transferred to Bank of America in August after the mortgage company I was with, Taylor, Beand & Whitaker, got into trouble. This occurred ater my mortgage payment was made to and cleared my account by TB&W. Ever since Bank of America has had my home loan I have received phone calls and lstaqtements saying my account is a month behind. All of this is due to the fact they did not receive my August payment which, once again, cleared through TB&W. I have send them copies of cancelled checks and bank statements TWICE and I am still getting sttemenst and phone calls saying I'm a month behind. They have put this on my credit report and with this blemish no one wants to refinance my mortgage. If you are contacted by them about a home loans, RUN as fast as you can in the opposite direction.
