Woke up this morning with $50K less on my account
This is a real story. I went to work this morning and I was checking my email. I saw an alert form BoA stating that my balance is zero on my checking account. I logged in to online banking and almost had an heart attack. My checking was $0 and my savings was all gone. I immediately thought, somebody compromised my account. There was a check taken out of my account. Check was amounted to $51, 815.28 and taken from my checking and rest from my savings, since I have draft protection backed by my savings account, everything was swept. Check was not mine, signature was not mine, name on the check was not mine. It turned out that this was a legitimate check sent out to a real person. Teller said the digital reader (optical reader) has failed to read the "8"s in the check so it matched my account number, and funds are drawn. After spending 5-6 hours on the phone and speaking to countless people, they said they are very sorry and they will fix it in 24 to 48 hours. And by the way they said they are going to send me an apology letter with a $50 gift card from amazon.com
This is just insane, I have no words to describe how bad this bank is. Stay away!

Failure to release lien on car for 7 years
I purchased a car in Florida in 2001 with an auto loan from Bank of America. I repaid the loan in May 2004. When I recently (June 2011) attempted to sell the car, I discovered that Bank of America had not released their lien on the car. The first BoA agent I spoke with wanted to charge me $20 for a lien release statement. I declined and called the Florida DMV to determine what exactly I needed. They told me that BoA needed to release the lien electronically via the FL DMV system.
I then attempted to get back in touch with BoA (7/12/2011). After being hung up on multiple times, I finally got through to an agent named Diane Washington. She initially told me that it would take her a few minutes to put the information into the system. When I pressed her to clarify whether she meant the DMV system, after several rounds of Q&A, she said: no, she was just keying in a ticket for someone else to address. When I asked her when I could expect this someone else to actually get onto the FL DMV system and release the lien, she said it would take 7-10 business days. When I told her that was completely unacceptable - they had already had 7 YEARS to release the lien, she said she would put a rush on it and have it resolved within 48 hours.
It was not. I called the FL DMV four business days later (7/18/2011) and was told that BoA had not filed the lien release.
I called BoA back this morning (7/19) and spoke with an agent named Jacob Landrum, who said that BoA filed the lien release yesterday, though he could not tell me what time it had been filed. He offered no explanation or apology for not meeting their promised turnaround time of 48 hours. I then called the FL DMV back, only to be told that the lien had not yet been released by BoA.
I then called BoA back and spoke to an agent named Kia Collins, who was unable to provide any further information. I then requested a supervisor and was put in touch with Tonnisha Taylor, who told me that Diane Washington could not have promised me a 48 hour turnaround because their typical turnaround was 7-10 days. I assured Ms. Taylor that Ms. Washington had and that even Ms. Collins had seen the promised 48-hour turnaround in the system. She then said that if Ms. Washington had promised me a 48-hour turnaround, she should not have done so.
I then asked Ms. Taylor why a two-minute task – filing the lien release in the FL DMV system – should take that long to complete and she replied that “the agent needed to research the matter before releasing the lien.” Note that all call center agents and the supervisor had complete access to my repayment date and all other vehicle and loan information they needed. So it is still unclear to me why filing the lien release should even have taken 48 business hours, let alone the 96 business hours that it appears to have taken … and at this point, I only have BoA’s less-than-credible word that they have actually filed the lien release.
I am completely disgusted with BoA. Not only have they not been proactive in addressing their 7-year old error (they took my phone numbers but never called back to inform me that the matter was delayed or resolved), but at each stage, agents have been downright ignorant, made excuses, prevaricated, and simply attempted to get me off the line as quickly as possible without any concern for resolving the problem. Given everything I read about the company and my own past experiences with them, I probably shouldn’t be surprised, but I am … that a company this unprofessional continues to stay in business.

foreclosure procedures
in 2009, Boa increased my monthly note by $250.00 per month and did not inform me why it was increased. I fell behind in my note because of a work slowdown. When I tried to make partial payments I was told that they did not except partial payments. I would have to pay all the back notes to bring the loan up to date but that I may be able to qualify for one of their modification programs. I applied and was denied on a modification loan a total of 5 times, all the while the monthly note kept adding up. We tried to send a partial payment and even sent a full month house note, which they returned. Long story short, my home is now in foreclosure and I am being told that I could have made payments and they would have gone into escrow till my payments were caught up. They had asked for the same paperwork on numerous occasions, never gave me a single contact person, never informed me of other loan programs, they kept trying the same modification program, never gave me a single contact so I had to tell the same story at least a dozen times since no one was familiar with my situation and got conflicting info on numerous occasions. BOA IS A BUNCH OF THIEVES THAT TAKE EVERYTHING YOU HAVE WORKED FOR BECAUSE OF THEIR GREED. They don't care about us at all

mortgage servicing and modification
BAC did not complete the closing of my modification(which was a terrible 1 and 1/2 year process) correctly and now they are trying to foreclose on my mortgage that is currently $67000.00 on a home now valued at $23000.00. I received a statement from BAC in Nov. 2010 stating that my next payment wasn't due until July 2011, I didn't receive any other statements or correspondence from them until Feb. 2011, by certified mail that I was behind on my payments. When I contacted them in Feb. 2011 the associate stated to ignore the letter and that my next payment wasn't due until July 2011. I have been trying since Feb. 2011 to get this worked out without any luck. They call me 8 to 10 times PER DAY from the collection dept. I tell them to look at the notes on my account and that it is under review but still NO ANSWERS. I now am working with the Fannie Mae Mortgage Help Center in Tampa but so far no luck.

bank did not address fraud issues
n 2008/2009, it was bought to my attention that numerous (13+) unknown internet companies were debiting my checking account (acct 8866). In 2008/2009 my it was bought to my attention that my bank account was being debited by unknown internet companies. I went into a local bank and called #800 to notify the bank of what was going on. The bank manager suggested that I open another account until things were corrected (FEB/MAR 2009). Bank of America did nothing to help me stop these constant debits from happening. They refused to close the account as requested. As a result my new account & savings account were attacked. Funds were taken out of the active accounts to take care of the negative balance in the account with the fraud activity. After, I stopped depositing my payroll deposits, the bank sent my accounts to collections. I was never compensated for the fraud on my account and was hit with outrages fees $1400.00. I paid what I felt was fair $100.00. The second checking account was paid off. My issues is with the outstanding $1300 (paid $100.00) I want this account issue corrected so that I can open another account. I went into a banking center and no one can give me any back history on this account. I had my account with BOA for 10 years. Sadly in my time of need the bank has dropped the ball and forcing me to carry the burden of not being able to open another account. This entire ordeal has been extreamly stressful and time consuming. Not to mention, it is very fustraighting to be told something totally different every time you speak with someone from BOA. I feel BOA dropped the ball with this one & now I am paying the ultimate price for their lack of customer service.

tellers not serving customers
Bank of America, please get more training for the individuals at the branches in east TN as it is desperately needed. When the house is packed to the point that folks are lined up out in the parking lot it is NOT appropriate for the "merchant tellers" to be sitting there at empty windows staring into space. They should be taking the next customer in line! I dont know why merchants are so important that someone needs to just sitting there waiting for them, while the rest of us are packed into that hot building like cattle. All our money spends the same!
Furthermore, I was unable to voice my complaints to a manager at that particular time. I became enraged by the situation and unfortunately had to excuse myself. You see, this was the second time in two weeks I have been packed in this place like
sardines while the merchant tellers sat at their windows looking out
at the crowd. I did not wish to escalate the situation to violence so
I left.

Poor business practices
We have been dealing with Bank of America for over nine years. In Fall of 2008, my spouse and I lost our jobs. Feburary 2009, I called Bank of America informing them that by June of 2009, we would fall behind in our mortgage payments, therefore wanted to be considered for the home loan modification program.. From Feburary 2009 to May 2011, we have gone through 22 bank representatives and $180.00 in resending duplicated documents. Because Bank of America employees kept losing the orginals. We agreed to a reduce mortgage payment and now we are in the rears for $50, 000. Which Bank of AMerica says not to worry because they will absorb the balance when the house is sold. In the meantime, our credit is in the toilet!
May of 2011, we were approved for short sale. Our house went on the market May 27th for $ 244, 00o and an offer came in @ $235, 000. That offer was submitted to Bank of America on May 28, 2011 . On June 1, 2011 Bank of America requested that we send copies of the offer because they lost the orginals. My realtor complied and resent the docs. July 11, 2011 Bank of America counters the offer wanting $244, 000. Both the sellers bank and Bank of America apprasied my house at $235, 000...What in the hell are these people doing at Bank of America? I can not believe that they would lose $235, 000 over 9, 000 gap! This is poor business practice and decision making at its best. I am sick of dealing with Bank of America...SOMEBODY PLEASE PUT THEM OUT OF BUSINESS... FIRE EVERYONE ONE AT BANK OF AMERICA THEY ARE TOO STUPID TO BE IN BUSINESS...TOTALLY UNFAIR IN THEIR BUSINESS PRACTICES..

Loan Modification
Since March 2010 I been dealing with a rate modification. I have been calling for status almost every three weeks. They have requested the same documents over and over again because they are due... Now I have been told that the same was denied for lack of documentation. I made an appeal and the same was denied. They put me on a regular Bank of American loan modification but has been told that I do not qualify for any modification on my loan because I do not file tax return. They did not requested from me a tax return copy when I apply and was approved for the mortgage loan back in 2000 and later on my rate modification on 2008. I have never paid late since 2000 and they put me on a trial period since July 2010 paying my mortgage and the escrow amount, which I did not paid it with my mortage because I did it at the end of the year. Is that so, that you have to have a tax return filed in order to be approved a loan modification?

not crediting insurance check against mortgage
Our 4, 000 square foot barn burned down February 19. We called BoA within 72 hours to let them know there was a loss. They told us at that time they would send us a property loss kit that would explain all of our options. We were told it would take two weeks. Two weeks later, we called asking where the kit was. They told us they'd send one out to us right away. Repeat two more times. We gave up. We called and tried to have the options explained to us over the phone...couldn't get anyone to do that. This interaction helped influence what we chose to do with the insurance check for the building. We read online of how homeowners were having the work done, but the mortgage company was not writing the checks from the insurance amount to pay the builder. We decided to put the entire amount against our mortgage and rebuild with the contents check in hopes it would make things simpler and easier. Because they were named on the check and the amount was so high, we had to sign it and send it to them. This was told to us by several people in the banking industry, our insurance lady and friend who work in insurance. It did not matter what we chose to do, we had to get them to sign it. We called them and asked them how long it would take for them to deposit it to our account if applied to our loan. We were told 14 days. It's been two months. We made them sign for the check when ti was delivered, so we know exactly when it was put into someone's hands. When we call and ask how much longer, we are told "soon." We have requested and had noted on our account for over a month now for a manager to call us. They never have. When we ask when we will be able to speak with someone who knows something, we are told they will call us soon. Everytime we call, it is like talking in circles..there is no point and nothing is accomplished. We have filed a complaint with our state SCC and the BBB hoping for resolution. If you have a choice, do not bank with Bank of America. They are absolutely horrible!!!
