Late fees for CC payments arrived on time
And here we go again:

For the 3rd time I catch BofA trying to sneak late payment fees for credit card payments that had arrived on time, in ALL cases TWO DAYS ahead of the due date. No "buts" or "made a mistake" or nothing. The payment and ITS CONFIRMATION NUMBER clearly shows the payment was posted ONLINE on the date it was made. No question.

Yet, I had to spend two hours calling back and forth between their "banking" division and their "credit card" division (which apparently have no way to check each other's systems) to get this changed. No idea how this affects my credit record.

I am filing my THIRD complaint with the FCC, which probably amounts to nothing, but I HOPE WikiLeaks exposes them FULL ON.

Scum bags and nothing else. They suck the sweat out of dead man's balls.

Changing credit records with false information
Dear Officers of the Federal Trade Commission and Officers of the Office of the Comptroller for the Currency;
Fair reporting is defined on the FTC website and is echoed on each of the credit reporting agencies’ web sites. The rules are not equal for the consumer and the agencies. When I provided proof of my claims, the Equifax agency informed me they called and spoke with the reporting company and found the posting to be correct. How? I asked them to provide data backing up the claim on the report after calling the company myself as informed to do so by the Equifax employees. I was then informed that these companies do not have to provide proof, since they confirmed the accuracy of the report by phone. I check my credit reports annually and last year the data was accurate with a small error that would not affect me in any way. This year I find my report looks like someone else’s, the companies taking over previous reporting companies were able to change the report the way they wanted to report the data. My report was allowed to be changed to reflect what the creditors wanted to show and this was permitted. This does not follow the FTC guidelines of reporting rules and the data should be deleted as inaccurate. The looming question of why we are not progressing out of this recession is answered by this very document. I am not the only person affected by this improper activity.
The taxpayers, through the government, help bail out companies only to find that we the people are now at the mercy of each of these companies. I am being threatened, intimidated, and have had my entire credit report changed. We all must be told of what these companies are being allowed to do and why we cannot get the help or loans when we apply for them. Double standards in applying the rules should also not be allowed and silence by our governmental offices cannot be allowed. The governmental leaders in my state of Florida all tell me they want to help and can see my point, but the companies are outside his or her jurisdiction. Each representative did inform me of my records being forwarded to the respective governmental department believed to be proper. I sadly discovered this to be one of the only truthful statements made by the banks involved.
Now I am told I can only dispute in writing to Equifax, with no more than 100 words, while the companies posting are allowed to exceed this rule. The employees also threatened me with filing a “frivolous” claim and sternly told me to call each company myself. I did call each company and found that some did not know what I was talking about since they had no record of me. The financial institutions informed me that they could change the postings since they took over the previous reporting companies and I could do nothing to change this. Each company displayed no compassion or even gave me any indication they would go further in even reviewing my claim.
Now I did read that we the people could seek legal steps to fix the errors if all other measures failed (FTC Web Site). The problem is that even my political leaders are unable to assist me and have to refer me to the FTC. The reporting agencies and the creditors are all telling me that no one in government has legal jurisdiction over them. This presents the question of how can I get help when the FTC employees tell me to contact the Office of the Comptroller for the Currency. WHAT? Not even the bank employees all knew what the office was or how this office even has the ability to intervene in the bank matters. I am attaching my last letter to amicably fix this serious fault in the creditor’s or the credit agency’s policy. If further proof of my claim is needed, please ask me since I have records dating back to 1984. I am asking for help in resolving this problem or help me understand how I seek legal representation. My next step is to post this online for all to see so we the people, can all fix the unfair and highly questionable actions by the very companies helped with bail out money.

The third day I spoke directly with a supervisor, who like the woman on day one, was well within the guidelines of the FTC. He assured me he would review the previous days records and find out who I spoke with and insure she would not be so incorrect and insensitive to people with “health obstacles.” I asked how to get a letter on my file to prove my claims; he told me the letter must be less than 100 words. He never told me how to fax or how I could challenge the incorrect claims within my records, or even have a rebuttal to what is posted. I want to know all these questions since the economy is so bad that simply sending erroneous information to the credit bureaus could prevent anyone from getting any type of loan. If these companies are operating outside the U.S., then compliance with FTC guidelines could take a huge amount of time to investigate or enforce.
Now, let me PROVE that data from some of these companies are wrong and that they cannot possibly have any data to back up their claims posted on my credit report. First, my home mortgage with Countrywide disappeared after 2009 to 2010; when Bank of America (BOA) bought out Countrywide. The data posted below is inaccurate and copies of my 2008 payments to Countrywide reveal that I did not have two mortgages or BOA was in fact involved with me at any time up to the present. This challenge for BOA is to prove they had my mortgage in 1993, and Countrywide who posted a good payment history with autopay from my bank is not listed after 2008. The Countrywide loan information dated “04/20/2009, Account Number: 045813996 is attached and contradicts BOA claim of having my home loan since 1993, or 1994. PLEASE note that I WAS NEVER late with a payment. If anyone would like my copies of the amortization schedules including the original with inclusive dates start to finish, please let me know and I will provide them with bank statements to be posted in my file. Now, look at the following incorrect data from the Equifax database:

I am a builder using a line of credit. The bank I originally took the line out with was bought by BoC. I had the credit line for six years with all payments having been paid on time at both banks. A line of credit loan is typically renewed every year, when the renewal date came up, BoC stated they were not going to renew the note ( the note is for $1, 000, 000) they gave no reason except, they were not making that type of loan to builders any more, and I should find some other lending institution to get a loan from to pay BoC. Until they get paid BoC also raised the interest rate to 9%. They wanted me to put up more collateral in order to keep the loan with them. They already had $1, 800, 000 as collateral. I'm still fighting with them. BoC did extend the line due date six months, and lowered the rate to six and one half present, even so, too short of time and very high interest rate. Don't ever give more collateral, that just makes it easier to foreclose on more property. I believe the bank should be named BANK of ASS.

Bank of America

Were I a stockholder in Bank of America I would be very concerned. We recently tried to buy a foreclosure owned by Bank of America. The Bank of America Asset Manager listed the property requiring pre approval for a mortgage from Bank of America. We applied and were approved for a little more than a third more than our offer on the house. The house needed some repair (and will need substantially more if B of A doesn't put a tarp on the roof), and including the retail price of the needed repairs our Bank of America approval was still 20% more than what the house would need. Our actual costs would be less because I am a contractor. We submitted the high bid for the house, ($12000.00 above the asking price) and received a counter offer from Bank of America accepting the price, but requiring that we show proof of available cash for all closing costs, the down payment and the retail price of all repairs, even though B of A had already approved financing to cover the repairs. Appraisal values should not be an issue, repaired the house should be worth at least double the investment. Essentially, Bank of America won't accept a pre approved mortgage from Bank of America as payment for a house owned by Bank of America. So they loose additional money on the property, as well as on the revenue that they would earn on the mortgage. Even having taken Trillions in TARP funds, with irrational management how do they expect to stay in business and compete? Also, if they don't take the best offer for the property that they need to dispose of, how can we expect the housing market to ever recover? If I were a stockholder, I would be very concerned about the banks ability to maximize my value. Do they need to be broken up, so that somebody accountable actually runs the operation?

Mistake
I just discovered the IRS put a levy on my account. I am in noncollectable status being totally disabled. Bof A chat through online banking with an IRS agent on my land line phone. Bof A would not give me the fax number for release of the levy. IRS agent waiting. No number. Then gave me a state number I can call tomorrow. It is not an 800 number and I do not have long distance on my phone. Still trying to get the fax number. Now on hold with the generic Bof A number ... Will have to wait on hold for an IRS agent who knows what they are doing.

Unable to contact
I am a disabled Veteran, and lost my job and had to get a new job with less pay. I fall behind and was able to give some money to bank of america but still have not been able to catch up. I get all this mail from them on contact us for help and all I get is a computerized system wanting to collect a payment. If there is no way to contact them why offer it. Bank of america gives you a form to fill out for a representive to call you in 3 to 5 business days it has been almost a month. It seems to me bank of america only wants to put families on the streets then try and help them.

foreclosure
My home is in foreclosure. My income was drastically reduced, applied for a loan modification. After months of going back and forth with BAC, submitting the forms twice, being told to just keep checking, being told by three different reps on three different times my paperwork was finally with the underwriters, then being told by another it wasn't, I was then denied and told to try again. By this time, I'm three months late. I truly believe I got this mortgage that I really should not have been approved for to begin with. When my numbers didn't fit, the rep told be how to "fudge" it and what to write. When the appraiser came, the numbers were inflated to meet the requirements. Now I'm in a mess and I think that's were BAC wanted me in the first place. Anyone else who is in the same position and feel that they "helped you along" when getting approved, please contact me. Maybe there is strenght in numbers.

Making Homes Affordable Loans
We have been dealing with BANK of AMERICA since March 2010. We are current on our morage payment, but not for much longer. Our payment went up $500 since Sept. Escrow is and has been from the start (March 2010). That's another story. My husband has lost $800 a month for a year now, due to cut backs. I'm self employed and have lost clients as well. We've just cut back on everything to keep good credit.
We have gotten the run around from BANK of AMERICA for way too long.
We got into one of those 1oo% financing loans in 2005 for 5 years. So we knew with or without my husbands hours cut who will give use a loan when your UP SIDE DOWN ON OR HOUSE. We have even paid two other out side company's to help. One of them Pro City Loan Modification. Which pre- approved us and that's what got use going into this process in the first place. If we didn't have a chance to quailfy we would never paid that company, and start the forcloure.
They loose faxed papers over and over again. Even when they copy each incoming fax. Tell you your approved financially and waitting for a trial payment to telling you your credit will get hit while on trial period. To getting Fed Ex from BANK of AMERICA telling you your not approved because we are current on or loan and don't have a hardship.
THEY HAVE KNOW FROM THE START WE ARE CURRENT. IT TOOK ME ALL DAY TO GET A PHONE NUMBER FOR PEOLPE CURRENT ON THERE LOANS. WHAT A JOKE THIS HAS BEEN.
We still qualify for the hardship loan modification and have been told from BANK of AMERICA over the phone time and time again we have been approved and waitting for the next step, to tell us something different.
I HAVE KEPT A PHONE LOG WITH ALMOST 40 CALLS SINCE THE END OF MAY 2010.

As I've been hearing for BANK of AMERICA if you get approved, that the difference in your payment will be put at the end of your loan. Us everyday people don't understand how people who are behind 2 plus years, plus the shortage on the modification will own all at the end. IS IT WORTH IT ? HOW LONG WILL IT TAKE TO GET THAT VALUE BACK?
WHY DOESN'T THE GOVERMENT JUST SELL US OUR HOMES BACK TO US AT FAIRE MARKENT VALUE.
HOW CAN HELP US.
OUR GOVERMENT HAS BLINDERS ON. They need to get off there ass and do something to help.
THEY CAME UP WITH THIS IDEA.
