overdraft fees
This is the 3rd time in a year BOA has assessed 3 $35 overdraft fees at one time to my sons account when there were NO actual overdraft in the account. From everything Ive read the new law regarding fees started July 1.

Im thinking of picketing and filing a complaint with the BBB and Attorney General. Any other ideas????

crappy phone service
I finally had to call bank of america Corporate Headquarters: 704-386-5972 / 704-386-5681 to get any help or semi-normal person.
I wanted to find out if a payment to BofA was late since it was due on a Sunday [7/11] and I paid it through there "bill pay" on 7/11. But, after 4 + different calls, having to answer numerous security questions, being told to call somewhere else, and oh, and having these DOLTS hang-up after I got tired of answering 3, 4, 5 + questions, and still not being able to find out if a payment was late; I called their Corp.
At least I got an answer - that it's not late if paid on the Sunday due date but posted the next day. But, the Exec. assistant did say their people can ask an arbitrary number and type of questions until they "feel good". What a good way to run a "biness" - no standards, arbitrariness of low level employees, and not knowing anything, anyway!
This wasn't the first time, but probably the 20th or more time I've had problems with this taxpayer owned bank. It's very hard or impossible to get anything through their FAT heads.
I'm thinking they ought to just merge with GM, and become "SUCK INTERNATIONAL"!

home equity loan
I owe just under $2, 000.00 on my 8 year old home equity loan and received a payoff demand statement on 7/12 stating I owed a little more than what my balance I check regularly on line stated. I went to the bank and asked a loan officer what this meant as I had not been late but one time in the last eight years (and that was paid within 15 days of the due date). At first she said this was a standard letter sent out stating the pay off. When she called, she found out the loan was a balloon loan and should have been paid off May 10th. I explained that I may have gone over my due date (of which I was unaware of since I had never received a letter until the month of July) because I had used 2 or 3 budget saver coupons that were included in my yearly equity loan coupon book. I explained I had taken those to the bank in person to make sure I could pay only $5.00 for the month and skip my usual $734.00 monthly payment. I was assured each time that I was able to use the budget fitter coupons and there would be no problem with my credit or anything like that. However, yesterday, I was informed those coupons should not have been sent to me since I had a ballon home equity loan. Now I have to pay off my balance and possibly have my credit ruined because of their mistake. I am not sure what to do. I am going to contact the attorney general's office, but I would also like to contact an attorney. Any suggestions?

Two complaints here
Two complaints here, moral of the story I will never do business with BoA ever again.
Bank of America has always been shady with their overdraft fees, but since I graduated from college and "grew up" a bit I've left a buffer in my account so I haven't had to deal with overdrafts for a number of years. Overdraft fees aside, BoA customer service and the interest on checking and savings accounts are dismal compared to Boeing Employee Credit Union (6.75% interest on the first $500 in each account) so I've been in the process of switching banks. The only bill I pay with a check is my rent so I moved everything else over to BECU and changed my bi-weekly direct deposit to half of my rent check until I had the BECU checks in my hand. Twice a year I end up with 3 paychecks in the same month since I get paid biweekly and since rent is due monthly it feels like bonus money. One of these three paycheck months happened during my switch so I ended up with an extra half of my rent ($402.50) in my BoA checking account. I walked into the branch so I could take out the full amount since I planned to close my accounts with them (they didn't know that). I accidentally told the teller I wanted to withdraw $405 (my rent check is $805 so it was my mistake out of habit). She went to a computer in the back by the drive through banking to pull up my account and came back with the money. She didn't say a word that the withdrawal would overdraw my account by a measly $2.50. So I ended up with a $35 overdraft fee. How the hell do they let someone overdraft, in person, without even mentioning that it would incur a fee. This also happens to be the ONLY time in my decade plus of working with BoA that they didn't ask me if I wanted a balance.
Now for the second slap across the face (chronologically this one came first but it seems like overdraft complaints are all the rage so I led off with that one). Bank of America is my oldest credit card, I've had it since I was 18. I've never missed a payment on any card nor do I have any "derogatory" information in my credit history so my credit score basically tracks my debt to available balance ratio (albeit with minor influence from the length of my credit number of inquiries and whatnot). I was recently promoted at work so my income went up and I started making major headway on my credit card debt. I checked my online banking and BoA reduced my credit limit to within $50 of the balance, without even telling me. I sent a message to their CREDIT department through their online form (from within my account so there's no security risk) asking them why my credit limit was reduced. They said they don't have access to that information (umm WHAT? they're the CREDIT department, who else would??). They said I should have received a letter in the mail. 5 days later a letter did show up. They said my credit limit was being reduced due to recent changes to my credit report. I've had credit monitoring for a while and over the last three months (thanks to a bonus that went exclusively towards my revolving debt) my credit score jumped from 650 to 707. Obviously I think their response is pure bullshit. I know there's a recession and a credit crunch and if they need to cover their ass and reduce my limit for internal business reasons that's fine, but I they should have at least said that instead of flat out lying about the reason for the credit limit decrease.
Whew, that said I applied for a credit card at BECU (wasn't my original plan as I don't need additional credit), was approved for a larger credit limit at a lower interest rate and received tremendous service helping transfer the balance (plus I spoke with someone who worked within 50 miles of where I live).
I wish Bank of America would fall like Lehman Brothers so smaller banks and credit unions can fill the power vacuum.

Abusive Banking Practices
A Bank of America branch closed one of my checking accounts without notice, because a few of my customers bounced checks in a recession. Suddenly, my own checks began to bounce, because BoA withheld the $229, 912.37 that had been in the account. I could have stopped writing checks had I been informed immediately – but I first learned of the closing in a letter that arrived several days after.
Bank of America then closed two more of my checking accounts, calling me a “bad risk” – though my credit rating is quite good. Again, I was informed late, my checks were labeled NSF, and I was charged fees, while the bank withheld about $270, 000.00 from these accounts.
To date, Bank of America has returned only less than half of the monies it withheld. For several weeks before, BoA denied me information about my accounts by telephone, cancelled my online banking access, and repeatedly refused to say when I could get my money back.
Were the fees charged for the bounced checks not enough? Did Bank of America have to damage my credit report by labeling my checks NSF, while withholding my money and profiting from it, to my company’s impairment? That is dishonest business, based on a lie told about my finances.
This is more than inconvenience and expense to a business: it is a major disruption to its cash flow, and costs it accounting and managerial time. It is needless punishment, damaging a business under a vindictive cloud of secrecy – a cloud under which Bank of America has unethically, and hypocritically, profited.
How can Bank of America be so inconsiderate of the precarious state of American business, on which banks depend? The government has bailed out the banks, even though they had used their accountholders’ money to buy the political influence to secure the deregulation that allowed them to invest in subprime mortgages. The banks reaped heavy short-term revenues, and the doomed loans left the taxpayer, the investor, and the small businessperson to pay when they defaulted.
Arrogantly, BoA is now attacking customers like me to make more short-term profits, as that same paid-for deregulation allows banks to impose destructive fees and penalties on their accountholders. Despite all the bad press and public animosity earned in the last year, banks will go on abusing us so long as they are permitted free rein by government and banking authorities – and by the press.

inappropriate banking practice
Dear Consumer Advocate,
In 2008 we were victims of a checking account fraud of $4218.15. B of A gave us a week to decide their final offer: pay them $1000 and they would forgive the $3218.15 or pay the whole thing. Since we didn’t seem to have much choice we took it. I have come to find out that B of A filed the loss to the Feds $ State of CA as a 1099-C. Now both want $800 each in taxes as it is recognized as income. We’ve called B of A twice speaking to there customer service, fraud, and legal departments. This was never income for us, rather a cancellation of fraud debt. Oddly, they seem to have no records of the transaction. Yet, they will not countermand the 1099-C. I’m at a loss as to know if there is anything I can do. Can you assist me?

house refinance
Bank of America is the worst mortgage holder we have ever dealt with. We tried to re-finance our house last year with them and they put us off for 5 months and then told us we would have to come up with 1500.00-3000.00 to pay for a termite inspection and treatment before they could go further with the refinance. My husband lost his job right after that so we then put in for the making homes affordable plan and they again took 5 months and I finally called them to see what was happening and they tell me that the V.A. is no longer approving this program so we no longer qualify. To me, they seem like a big bank trying to get more money and keep from helping the little man any way they can. I wish countrywide would have never sold them our mortgage. they stink!

Scam victim check fraud
Bank of America did not protect me and my account. Unfortunately I was a victim of fraud and fell for the online Receptionist scam. I did a few tasks as required, and even looked up and contacted the bank that the cashiers check was from. They told me that they could not verify funds but that it was a guarantee the check had funds if it was from their bank and in cashier check form.
Now I have been with Bank of America since i was 16. I am now 23 and have ALWAYS had my account in good standings. Assuming Bank of America's teller's are trained to recognize fraud and or the process to protect "one" from fraud, I was confident that they would protect my security. When I went to the bank, the young lady placed no hold (which is what usually happens when I deposit or cash any checks with them) on the check and believe it or not cashed it and handed me the money right there and then. I was kind of shocked due to the amount of the check and guessed that she was familiar with that bank. Either way I figured $2500 is a lot of money and questioned the security of the check and if it was possible that this could come back to me for not placing a hold to verify funds?? She told me it was not necessary. So like a fool I sent the money away to some other state and was totally scammed. About five days later I went to take out some money and the teller assisting me tells me that my bank account is overdrawn and I had a negative balance due to the check coming back as fraud. Immediately I spoke the manager and she went on to tell me i was like the 5th person this had happened to that week.
So not only did they not protect me they totally screwed me. Manager gave me some phone number to call in regards to "paying" the balance. When I called to explain what had happened it was totally irrelevant and if I did not pay the balance in full within 20 days, they were going to close my account and I would not be able to open an account anywhere for 10 years!!! This horrible incident may have been my fault for falling for the scam, but I was very upset with the lack of protection I got from B of A. I feel they are to protect me and the didn't. I called the police, filled a report, reported to the FBI because this guy sent me another check. I wanted them to pursue contact with him and try to catch him and or do whatever they could and they told me "hopefully you learned your lesson and won't fall for it again, unfortunately we can't help you".
Example: My father fell for something similar and took a check to B of A, Santa Rosa location (next town over where he lived) and right away the teller that was assisting him told him the check was fraud. Did I get the poorly trained teller or what??? I'm so confused as to how the bank allowed this to happen. If anyone has any advice as to how I can help myself your emails are totally welcome. And please no negative comments. I already realize how idiotic I was to even fall for such a thing.. [email protected]
