The Clegg's (GM C) complaints "Avoid Them" have no merit. You are the Clegg's and you should not have defaulted on your contract, But you did. Your complaint has no merit as evidenced by your reluctance to report it to the BBB or for that matter seek other remedys for relief to recoup the money you say you lost. Instead you choose to use the internet in attempt to smear our reputation with garbage. Your foolish shinanigans should not come as a surprise to anyone that reads your postings and recognizes that your default exemplifies your poor character and lack of integrity in your business affairs. We continue to build high quality inground swimming pools in the DFW marketplace for many happy customers.

I will provide any and all documentation regarding your default to any individual that requests it and is interested in building with Benchmark Pools & Spas in order to protect our good reputation.

Benchmark Pools & Spas never had an opportunity to begin building the Clegg's pool. The Clegg's defaulted on thier contract the day of excavation, which is the same day permits were issued by the city. By thier own admission they found out just prior to their scheduled excavation with Benchmark Pools & Spas that a friend of theirs was in the pool business and wanted him to build their pool. So they called off excavation and chose to default on their contract when our crew was headed to their property. We incurred substantial costs associated with this customer's transaction up to the time of default including but not limited to engineering plans, city permits, layout and more.

The Clegg's still owe Benchmark Pools & Spas in excess of $3, 000.00 as a result of their default. The DEFAULT Clause of their contract clearly states:
In the event of default by buyer of any provision of this contract, Buyer agrees to pay all collection cost, and interest from date of default. Reasonable attorney's fees shall be awarded to the prevailing party in any action brought under this contract. Owner agrees that in the event of breach or cancellation by Owner, Owner shall be responsible for charges to date of breach plus Contract profits.
We want to forgive this transgression by the Cleggs but these deliberate actions to smear our good reputation suggests that a different course of action may still be warranted.

With regard to our past experience, we have previously worked for Blue Haven Pools & Spas and other local pool builders. We observed and gained valuable experience during our tenures with these organizations. It was this exposure to these various pool builders that led to the formation of Benchmark Pools & Spas.
