We purchased a table from this company 11.18.2009. Our credit card was charged $150.95 11.20.2009. The table was NOT custom but had a delivery time of 2 weeks. It is now 3 weeks and we have no table, no communication. We have contacted the company via their online contact form, through staff emails and the owner's email. All of this info we had to "dig" to find as the company's website does NOT list contact info, phone numbers or proper addresses, which may be an issue with the state of NY/credit card processors (credit card processors REQUIRE full business info disclosed). We also called the "business" phone which is nothing more than the owner's cell- found by a web search. We have received no replies to our emails informing us of the order status; no phone calls returned. Are they legal? Did they just rip us off? The day I first emailed the company the table we purchased was listed and with NO WAIT. If I purchased the same table that day, it would ship ASAP? So where is our table from 11.18.2009? After I first emailed the company, they removed the table we purchased from their website entirely. This is what alarmed us greatly- removing the item after we inquired as to its status and then never contacting us. No table, no communication, credit card charged, no delivery of item. This table was purchased weeks ago so it could be delivered in time for Xmas.
1. Is it legal to charge a customer's card before the item shipped for a non-custom item?
2. Upon researching this company it is apparent that they are young kids w/an address that is nothing more than a home on a rural street, certainly not a legitimate business address. A Boulder, CO address was found under Joseph (Jesse)/Suzanne Spiegel/JB Spiegel Inc too- most likely their college address.
3. We intend to contact our credit card company whom will open a fraud investigation.
4. We intend to contact the authorities to report fraud/theft.
We filed a complaint with the BBB and discovered that they have received other complaints as well.
This is pretty serious for these kids and I guess they just don't care... how entitled they must be in this economy to steal from a customer. They have not given us any indication that they have honest intentions such as: letting us know of delays, let us know there was a problem- we could have worked with them or at least they could have offered us the choice of a refund! You just stole our money, refuse to respond to anything, return phone calls... it shows everyone that you had no intentions of following through as a business and shipping the product. Thanks for ruining this Christmas gift, wasting our time and taking our money.
