I am a Silver member of Bluegreen.In my opinion, this company has falsly represented itself concerning the fees that are now sucking our savings dry. I am at this time learning what permits and regulations to follow in order to protest outside of Bass Pro Shops. Scam/Deceptive Practices
We purchased a timeshare with BlueGreen which was supposed to be a great opportunity to have something which would be a "legacy" we could use and pass on to all our children. During the sale pitch, we were told this would be paid for in 5 years and that we could rent out our points if we wanted to, use them for cruises and participate in an additional resort program where we could use "companion resorts" all over the world at very reduced prices. Our maintenance fee was once a year for $450. I should have been suspicious when we went to sign the papers and the agent tape recorded our entire conver yosation. Two years after we bought this, the maintenance fee had risen to $1250/year, my husband's company folded with the depressed economy and we found out (the hard way) that timeshares are IMPOSSIBLE to get out of; we have been scammed 3 times trying to get rid of this millstone. I spoke to BlueGreen and essentially they told us, too bad on you and tough luck that your husband has no income. There was no recourse to sell/refinance/get out of the contract which we found to be for 10 years, not the five the sales person told us. This is the biggest SCAM I ever heard of and, even though I tried to work with BlueGreen, they have no interest in doing anything but collect our money! We can't rent outour points, and the places we might choose to use are never available!
We were unable to pay the 2010 maintenance fee, so they sent us to collections. They are still collecting their monthly fee, but we have no way to use the points. We were told we could use our points (we had 20, 000 per year) to pay the maintenance fee, but when I said go ahead and use them all, I found out that for $400 per month we got only $200 for the entire year's 20, 000 points! What a rip off! If anyone ever is stupid enough to deal with this company, call me first!

I could go on and on, but will make this as short and sweet as possible. All other complaints are just as we are complaining about. DO NOT BUY FROM THIS COMPANY. They promise the luxury vacation anytime you want, but that is a LIE! Maintence fees have doubled since we were scammed into this "club", only 3 years ago. And they fail to tell you that! There is never vacancy when you need it. And funny that if you stop by The Falls Village or Big Cedar, there are empty units all over the place! Oh, but they would have vacancy if you wanted to pay some more cash and use "BONUS TIME." We had an operator tell us that we just needed to "learn how to work the system!" Like there is a secret code or something! Bottom line...These people are liars and have no heart. I seriously do not see how they sleep at night, knowing they are taking money from people. Approx. $500 a month goes to bluegreen for NOTHING!!! If you are already a bluegreen owner feel free to contact us and maybe together we can put a stop to this!

misrepresentation
Have enough of us been mislead by Bluegreen that we can file a class action case against them yet? Anyone interested in joining let us know. We contacted Watson, Crowder & DeGaris for help. Their number is 1-800852-6299. The more people that call the better. We contacted them this morning to see if class aciton is possible, so the more people that join in on this the better the chance we have of getting our money back or at least rid of the life sentence to pay Bluegreen forever in maintenance fees.

Bluegreen lied to us BIG time - it a SCAM
In 2007 summer, we stayed in a hotel next to Blue green’s facility in Myrtle Beach, SC – to be exact the
A guy on the road approached us and offered us a $100.00 coupon for attending a presentation only for 60-90 minutes.

What followed?

A length sales pitch by a guy (whose name and contact information we still have but left the company since then) who provided a lot of empty promises and us deciding to get to the end of it by signing a contract (See the lies at the bottom.).
What then followed later?

The sales person called to check on us (I guess he waited until the prescribed cancellation date expired) which by the ways was not communicated to us).
We do not remember getting the deed and any other details on the contract we signed.
Finally, we decided to stop payment through ACH (automated debit).
Now they are threatening us in many ways including almost daily phone calls and a certified mail via USPS notifying us we can no longer use their property.
Up to now, we have paid about $ 6000.00 in interest only (about 15% APR) and about 3-4k on club dues and maintenance fees, and a down payment of $4, 500.00


Questions:

1. What are our options?
2. What else can blue green do other than hurting our credit history/reputation?
3. Can they not be sued for false advertising?
4. If we find a lawyer who is willing to take this case, can the sales person be called to witness under oath?
5. At least there is one class action law suit that is filed against Blue green in Pennsylvania. Does anyone know
6. Can we claim back our money that they took as maintenance fees and club dues? How about the so-called monthly mortgage payment (about 13 – 15k so far)?
7. Can the contract we signed by legal without having any witness, attorney similar to a closing on a home?
Any information/suggestion is welcome:

LIES BY THE SALES PERSON
8. The sales person lied to us in many aspects just to mention some of them:

a. We can sell it for you and you will get

b. No disclosure on costs other than the mortgage – the maintenance fees and club due were not discussed initially (but see next two as to how he played the materiality of the fees down).

c. Sales person “I do own a timeshare myself and I even make money out of it (by reserving during peak hours) and selling it online). This covers my annual fees”

d. You can easily cover membership fees by recommending friends/family members to attend vs ‘How would one be able to send family member to be slaughtered, and they may not be silly as well. In addition, financial obligation should not depend on ability to send people to attend ‘presentation’

e. You can easily reserve vacation time - no issues Vs very hard to reserve for one’s own use. They have color coded seasons with a lot of restrictions.

f. If you cannot use your points this year, you can use them in the following years vs points expiring

g. About High APR - you can refinance it through your local bank vs timeshare is not even considered a property/asset (the sales person lied to us knowingly given that he is also a licensed Realtor).

h. What Blue green sales is not a timeshare vs what else is it then?

i. If you have any questions and or want to sell it back, just call me on my cell phone vs when we called him he said ‘ I do no longer fork for them, please contact customer service

j. No disclosure on how monthly payment on the mortgage is applied vs looks like from our experience that almost all of it goes to interest and the principal doesn’t go down that much

k. "You can sale it If you do not like it and make profits out of it since it appreciates vs no value at all at the secondary market for timeshares (try to sell it and you will know what I’m saying here).

l. You can rent it and recover your monthly fees and make extra money out if it vs. it’s hard to reserve for one’s own use personal use (they have color coded seasons which covers the entire summer and good seasons for vacations where you can’t use your saved points from prior year and cannot get a free space (By the way, the company allegedly sales rents the rooms to the general public while they appear unavailable for online/phone booking at:

m. No mention of a very restrictive business rule/policy restricting customers in 2 ways regarding points
i. No use of points from prior year during points from prior years expiring right the following year
ii. One cannot use saved points during a good part of the year.


What we did not find out regarding they cannot lie to customers nor can they misrepresent their products.

1. Based on the Code of Conduct of the Company about Fair Dealings - Each director, officer and employee of the Company will at all times deal fairly with the Company’s customers, suppliers, competitors and employees. No employee, officer or director should take unfair advantage of anyone through manipulation, concealment, abuse of privileged information, misrepresentation of material facts, or any other unfair dealing practices.
2. Another individual on ripoff.com posted a detailed article on what code of conduct of the resorts association Bluegreen violated.

I am socked with a huge $ 660.) late fee for dues ( I thought it was on automatic deduction from my checking). It is outrageous!
Also they way they do the points makes it very hard to actually book a trip at all, and rolling over points is a nightmare!
the only thing I have been able to book is trips in my own state to Boyne. I want to sell and not loose my shirt!!!
They also lie about Taveler Plus service-like 50% off hotels, etc.

Went to a presantation, bluegreen said we would get more if we bought from them, , charter bonus time, payed dues, ect, , we bought, , , then we got home and found some resales out there, , pinnacle and timeshare resale, they said we would get all the same things that the company would get so we cancelled our ownership with bluegreen we bought, and bought from a second source, , , 6 months later still no title or papers, , no deed, , no charter, , no bonus time, ect, we should have kept our purchase with bluegreen, , now we are stuck with nothing, , lost our money to, , had to pay cash with the other guys, , , so my advice only buy from the bluegreen company, , , , sighned RESALE RIP OFF

deception, rental, etc
We too got taken. My husband and I had horrible previous marriages. We took this because we thought each year we could treat ourselves to a deserving vacation. He is a corrections officer and I work with at risk children. I cry every time I see a payment go out and no vacation or way out! We were almost out the door and then they bring in the charming, I've been every where, with my photo album in hand, let me share my memories, and oh by the way my husband had cancer and our last trip was... and I’m sad to say he died 3 years ago person. I am so disappointed in myself. We never get to go on vacations because either it’s not available or the resort that we want doesn’t belong to them and we have to pay extra out of pocket money to use it plus our points. We have tried to lock in a couple trips and sorry, no can do, not available and it doesn't belong to us. I asked about their rental policy at the time of purchasing if we don't use the vacation and they said they will assist in the rental of the timeshare, and the list of deceit goes on. It was my understanding that each year we pay our maintenance fee we were to get 500 points. We still have 10, 000. I have paid over 2 years on timeshare and paid the "Maintenance fee" etc and still owe $8, 000. We started at $9, 000. The interest rate is 15%. No one wants to refinance it; BlueGreen won't recommend anyone for refinancing, how convenient. I’m so frustrated. I want our money back and that doesn’t seem like it’s going to happen. I want to just give it back; they can keep the money, and chalkthis up as an expense college course, and just walk away from the stress and frustration. I won’t just not pay it because I don’t want it to mess up my credit. I’m afraid if I don’t pay the maintenance fee it will affect my credit. This has been such a stressful mistake! Is there a class action suite that we can join? My husband feels really bad because he really wanted this for the both of us so that we could take those “Free” vacations. Is there anyone who can give us some good advice? Our timeshare is in Gatlinburg, TN.

lies and rip offs
i have been a owner of bluegreen for over a year and i hell hate it! i think it is the worst mistake i have ever made! i was promised all these things and got none of them! every time i try to book i get the run around! I CAN NEVER GET THE DATES I WANT OR THEY ARE BOOKED UP! they dont have that many members and if they do then they need to get more condos. the customer service SUCKS! you have to pay a large amount of money for them to screw you! then they give you all these restrictions as when you can use your points.they are just awful and you cant do anything about it. if anyone has gotten any help about how bluegreen has done them please let me know. my email is [email protected] thanks ps please people if you are new to bluegreen hurry and get out of it because all they do is lie lie lie
