Refusal to Reaffirm by Loan
Hi, I want to also voice my issues with Capital One Auto -- they are horrible and I cannot stress enough to other consumers never to sign an auto loan with this organization as you will find yourself having the biggest nightmare of your life!

I took out a car loan with them in July, 2008 when I purchased my car from CarMax in Pompano Beach, FL. I have made each and every car payment before due in full and have my bank records to prove it. About two years after taking out my car loan with Capital One Auto, I lost my high paying job and had to file Chapter 7 bankruptcy. However, I reaffirmed my Capital One Loan (excluded it from the bankruptcy proceedings) and my bankruptcy was discharged as such.

Since the inception of my bankruptcy proceedings, I was in contact with Capital One Auto letting them know that I was not including my car loan in the bankruptcy and continued to make each payment on time, in full. To date, I continue to make every payment on time, in full.

Capital One Auto refuses, both verbally and in writing, to acknowledge and accept my reaffirmation and has instead reported to all three credit bureaus that my car loan with them was discharged due to bankruptcy and account closed. I have even enlisted the services of an attorney who sent them a very detailed account of every payment made on time, copy of my statement of reaffirmation, and communicating the negative damage they are inflicting on my credit reports because of this incorrect reporting on their part.

They never responded to my attorney's letter. When I send them a letter, and believe me I have sent many of them, I receive a form letter back from them, basically denying any wrongdoing and confirming that my loan is at a $0 balance and discharged at time of bankruptcy. I have included copy after copy of the Statement of Intent with each letter and they still maintain the position that "I have not reaffirmed my loan with Capital One Auto".

The definition of reaffirm, is to acknowledge the allegiance to a country, obligation, etc. which I have done repeatedly.

I also registered a BBB complaint with the Richmond VA and to date, their representatives continue to assert that I have never reaffirmed my loan!

My attorney has advised that my only option is to file a civil case and that could cost thousands of dollars!

To top it off, I receive monthly account statements showing the remaining balance on my car loan from them, showing last payment made (on time!) and next payment due and the amount. The principal continues to decrease with each new statement.

I also sent them a letter telling them that I would like to surrender the car to them if they will not correct their reporting of my loan to the credit bureaus. They do not even respond to these letters!

So, at this point I am between a rock and a hard place. This company will not acknowledge, nor correctly report my loan to the credit bureaus, and I can't help but wonder if I send in the remaining amount due, just to get rid of this headache, whether they will send me the car title, or just take the car back!

Please do yourself a favor, and never sign for an auto loan with Capital One Auto -- it will be the biggest headache of your life!

Ruined my credit
Capital One auto has ruined my credit!!! I have tried tooth and nail to protect my credit to the best of my ability with all my accounts. As of now I have not been late with anything for over 7 years, so I have relatively good credit. I refinanced my loan with Capital One Auto in early 2008; I went a few days past my due date.

I called Capital One and they wanted to charge me a convenience fee of $15 for paying over the phone. I opted out and decided to go online because the represented told it was free of charge. I went through this entire process to get registered into the online system and sent my payment online. It comes to my attention the next month invoice shows I owe 2 months. I immediately called Capital One to resolve this misunderstanding. Apparently the information I put into the system was incorrect therefore the payment never went through and now I am late 30 Days. I spoke with supervisor and several other representatives they all pretty much gave me the same spiel that it was not a bank error. This was 2 years ago; I have tried diligently to dispute this item with the bureaus but to no avail. Capital One insist the item was correct and they I am 30 days late.


About 2 years later they come up with another late!!! Ok I have to admit for the last year I have fallen behind on my payments but I have never exceeded more than 30days, because at this point my credit would not be affected. I applied for forbearance for my July's payment, which I sent in mid July. They have confirmation of receiving it their form plus the $35 Dollar processing fee, but the application is apparently is still pending. I got a texted on August 2, 2010 please call Capital One, so I immediately did. The representative said that my request was still pending and I am now late 32 Days!!! I was irate to say the least and she said I will have my manager call you tomorrow. I called back and got the run around... Finally, a supervisor called me back and apparently the forbearance is curtsey and the fact remains that I am effectively 32 Days late... Well I still process your forbearance but I can not remove the 30 Day late on your credit because it is not a bank failure!!!

I think this company is full of! $%&^ and they are scum. I feel they purposely ruined my credit so that I remain their client. Preventing me from seeking credit elsewhere!!!

Ridiculous service
I am 40 dollars late on my car payment, which I've been paying ontime for a few years now. There was a mix up and I thought my payment was 210 but I had been paying 230. So for two months I paid 210. They called and I said I would send the 40 in with my next payment which is due 3/20. The are calling me from all different numbers at 8 in the morning and 8 at night, even on Sunday. They call around 5-6 times a day. It is ridiculous. I will never get a loan with them again.

my main complaint is that they won't work with you when trying to catch up on payments.many calls to tell me they are going to come and repo my car. I'm self-employed and i am also a diabetic so sometimes i'm sick and can't work.I told them I would send some over the reg. payment but they said okay but the past due is still due.when we are trying to make up payments why can' they help.

Scam and Fraud
Never, Never go to Capital One Auto for any loan. We have had a loan with Capital One Auto and paid them off. We got another loan with them, fell behind in payments and wanted to refinance through a hardship, they wouldn't allow us because we haven't paid on the car for 24 months, so therefore we either had to catch up on the payments or do a voluntary reposession. They are a terrible company with terrible people who work for them. They are of no help to anyone. Stay clear of them.

Harrassing Phone Calls
I bought a car through a Capital One Auto Finance 2 & a half years ago. In good standing. A few months ago they sold or gave my account to another company owned by them. Ever since that company has had my account, even though my payments still go to Capital One, I start receiving harrassing phone calls on my cell phone (only one I have) BEFORE my grace period is even up for my payment. In my contract I have atleast a 10-15 day grace period. Phone calls start coming on day 9. The harrassment on their part is calling me 6, 8, to 10 times a day, 7 days a week, non stop. They constantly use different numbers (972) area code.

The phone calls are affecting my health. The more calls they make, the more I get stressed. The more I get stressed, the more active my live disease gets. The more active my disease gets, the sicker I get. Which is non reversable without Liver Treatments. The sicker I get, the longer it takes for me to even be able to go out & look for a job. You see what I'm getting at?
I know my payment is late.I don't need to constantly be reminded everyday, all day! I told the lady I talked to, that I do all of my business online & not on the phone any more. The more they call & harrass me, the longer it's gonna take before they get a payment.

Even when I called them today & told them that my payment will be in the mail 3 days from now, via money order, like it always is. Because they don't take payment online via debit card. Which is how I make all my payments now days. It's just convenient for me that way because of my illness.

Not only that! 6 months after we bought the car, the first time I had the oil changed by the dealership I bought it from. The very same day it was changed all the way up to today, we have had nothing but over heating problems with it. Have spent hundreds & hundreds of dollars & still it over heats. I have written Chrystler, I have talked to the loan company & absolutely NO ONE wants to do anything about it.

So we're stuck paying for a car that I can't drive without having the heater on full blast to keep it from overheating. I live in Arizona. Do you have any idea what that's like? I haven't put on 500 miles on my car in a year because of that. It's almost undrivable.

Anyway... the lady I talked to today at Capital One, refuses to stop the phone calls, even though she knows that my payment will be in the mail on Friday 6/6/08.

I have found out that these loan companies & credit companies are nothing but legalized loan sharks. If there's anything you can do about the harassing calls I would greatly appreciate it. My health is at risk because of it.
