Bad service
I have had my phone number for 4+ years. From the beginning of that time I have been getting harassing phone calls from Capital One auto at the number of 972-378-3508 & 3533. There are other 800#'s too from them. As I write this I just got 2 calls within 45 mins. from them. They are looking for a woman named Jennifer Lutz. I do not know a Jennifer Lutz and have never had any contact with her whatsoever. I have told Capital One to please not call me, that I am not that woman, we don't know her and stop calling. They refuse to believe me and sometimes say things like "oh, right, your not Jennifer huh? Just pay your bills". I have had it with them. I've called them back numerous times only to get someone else who doesn't believe me but said they'd take the number out. They didn't. I have emailed their headquarters etc. with no response and I have sent them a letter in the mail telling them to stop calling me. They refuse. I told them to just goggle my phone number and they can see its not this Jennifer person. Obviously they do not care. I am very upset by this b/c my husband and I have excellent credit and we do not deserve this harassment from them. We have never nor would we ever now have any account or anything whatsoever to do with Capital One. Yes, I could just not answer the phone but I also have an infant and other children here and it's a huge bother to have the phone ringing all the time. Plus, its my phone and I am not wrong.
I googled Capital One and found that I am not the only person who has been harassed by them incorrectly. There has to be somewhere for people like us to turn for help. I do not want to change my number b/c I have a home business and it is very inconvenient for me to do that and also unfair to me as a good citizen who pays her bills on time and has excellent credit.

False fees
I requested a pay off amount from Capital One in December, then sent a check for the pay off amount. They quoted me a wrong pay off amount which was one month short, so we mailed in the last payment (again). Come January, we never received anymore statements. We assumed we paid off the loan, but we thought we should call 1 more time because they are sooo incompetent. Once again, they said we owned $117.53 left, and now we are 5 days late. I spoke with Miles, and he apologized and said they were late sending out statements and alot of people did not receive them. But don't worry, we do not report late payments to the credit burreau until you are 30 days late (even if it is their fault). So I said I am not hanging up until I pay off this loan. So I did a payoff over the phone with a check. He assured me I was now paid off. A week later I get another letter from Capital One now saying now I owe $122.68 this is dated a day before I made my $117.53 last payoff. Of course this does not balance. I then call Capital Ones Voice Jail and finally reach a representative and ask them what I show as a balance - it should be zero. He now states it is $34.31 which is the interest and late fee which has accrued. Will somebody PLEASE shoot me???!!! I now speak with Sonny, and try to explain what has happened. He now assures me that he will "put in a request" to have this zero'd out and I will owe nothing, and I should check back in about 15 - 20 days. You have to be kidding me !!!??? I will bet my next 2 paychecks, that this will NOT be resolved, and this will escalated to more late fees and then collections, and there is nothing I can do. All I want to do is pay off my #$#@^%$ loan? What has happened to corporate America today? I am ashamed to be an American, and my ancesters came over from the Mayflower. If I had the opportunity to leave...I would. I'm sick of this Country. Corporations steal from you, and our Government doesn't lift a finger to help out the average hardworking guy. Yes I am pissed. To no end. There should be a law against incompetent stupidity and file a class action suit against this Capital One for being the biggest abuser.

Recent Capital One Solicitation Cases
We are a group of students in Rockville, MD, who are currently working on Capital One’s deceptive and misleading actions towards its future customers.
We are looking for people who within last year had issues with Capital One.
Those issues include:
a. being solicited by Capital One with preapproved credit cards;
b. unawareness of enrollment in “Payment Protection Plan”;
c. unawareness of the true credit limits, origination fees, and late & over the limit fees;

Fraud and scam
Credit Card activity ceased in September 2006. Made last payment in October 2006 along with request to close account.
Was told that the account had to remain open for 30 days without any activity and then they would close.
Called back in November 2006 requesting to close. They said that a charge appeared on my statement. I forgot that I had an old web host that was still charging. I changed the card associated with the Capital One credit card and waited another 30 days. In fact I didn't call them back until March of 2007.
I called and verified that no other activity happened on the card and again requested that they close the account. They said it was now closed and that I wouldn't receive any more statements.
I have received statements every month since. Every other month I call Capital One to ask why am I receiving statements still if the account is closed. I am told that I shouldn't be receiving anything since the account is closed. However, every month I receive a statement along with a blank check to write a withdrawal from the account, which is a scary thought.
Anyway, I'm still working on getting Capital One to close (for real) the account. So to everyone, enjoy 'what's in your wallet' until you try and close the account.

Credit card charges for $4.95
I noticed $4.95 being deducted from my credit card. I did not authorize this charge, therefore, I am arequesting a refund and also an assurance that this will not continue.

Auto Financing
I purchased a car in September of 07 making monthly payments on time and sometimes early. On September 2008, I totaled the vehicle, since then Capital One has given me nothing but hell. On the day of total loss capital one said that my payoff balance was 16, 000 dollars and some change. My insurance company paid off $13000, My maintence plan was reimbursed, and my Gap was supposed to cover the rest. But to my surprise capital one still says I owe them $1397.61. This is crazy. This company has given me nothing but hell since I lost my truck. Someone needs to really stick it to them. In todays economy who has $1400 dollars just laying around not me. And to top it all of, this case was supposed to closed in october, So why am I just getting a letter dated 12/05/08 with 10 days to pay. No phone call saying that I owed them anything. I feel that I have been hoodwinked and bamboozeled. They need to be stop.

dispute resolved years ago
While living in Mexico in 2001 I had a Capital One credit card. I did not use it for over a year. I received in the mail a membership fee charge for $50.that was due the week before I received the notice. I tried to telephone Capital One but the only number on the card was an 800 nimber that was unusable outside the country. there was no other number. Plus it would cost me $3.00 a minute to call the US to try to find a number for them. I sent a letter and the cut up card cancelling my capital one account. I kept receiving letters of nonpayment with fees attached. I called capial one many times during this dispute, at $3.00 per minute. I finally sent them the original membership fee, though the account was cancelled, and they would call it even. Capital One said the problem was resolved. When I returned to the states in November 2002, my credit rating was bad because Capital One now had a $295.00 fee on my credit report based on that $50.00 membership fee. I had to put my first home mortgage in my wife's name due to this, only blemish at the time on my credit report. I called capital one. they apoligized profusely and said it was a gross misunderstanding and guaranteed me that they would take this, their error, off my credit report. This was in 2002 or early 2003. I considered the matter closed until I received my credit report from Experian with this $295 charge from a collection agency all stemming from a $50.00 membership fee for a card I cancelled and had not used for a year prior. Unreasonable Account Restrictions
In August, 2008 I applied for a credit card with Capital One. I received correspondence from them requesting me to mail them a copy of my Social Security Card and Drivers license, since they could not verify my information. Since I still had a limited credit history, I accepted the request as reasonable and mailed the documents. About a week later, I received another letter confirming the receipt of the previous documents, but indicating they also need to verify my address, and I need to send a copy of my utility bill as well. A bit annoyed for not being asked to send this with the first mail, I obliged and sent them a copy of a recent utility bill. About another week later, my new capital one credit card arrived in the mail.
After using my card for +- 3 weeks, while making a purchase at a coffee shop, I had to face the embarrassment that my card was declined for a $5 purchase. I phoned Capital One, only to find out that a restriction was placed on my account due to ‘suspected fraud’. I was requested to send a copy of my SSN card and driver’s license before the restriction would be lifted, since they needed to verify my identity. I was incredibly upset by this, since I supplied ALL this information when I opened the account less than 3 weeks ago. But I was faced with Capital One’s fraud department who just refused to help (they said they had to assume they were not speaking to me until I sent them the documents). So after battling with one of their agents and his manager for about 45 minutes, I gave up, and faxed the documents. I was promised that the restriction would be lifted within 24 – 48 hours. Needless to say, 48 hours later, account still restricted, I had to get back on the phone with Capital One. I was now told that they again needed to verify my address! I was even more upset with this – but the result was the same as with the previous call, so I ended up faxing them the documents. The restriction was lifted the next day.
About a month later (October 2008), Capital One sent me a new card – with a higher credit limit. Once again, after using the card for about a month I, by chance, saw on my online banking that my new card was restricted!! I nearly exploded – again not even a phone call from Capital One to warn me. So, on Thursday, November 20th, I had to face up to the Capital One Customer Service again. Same story… I had to fax a copy of my SSN card and drivers license – and wait for 24 – 48 hours for them to process it. I was again ‘helped’ by an agent who refused to expedite the process in anyway, and because the documents I sent earlier were for my other card, they did apparently not count. After explaining my unhappiness during a 45 minutes call, I just ended up faxing them a copy of my SSN and Drivers license. This time just with the additional problem that my payment was due on the 29th, and I was unable to even pay my account online. I was told by the representative to mail a check, in order to avoid late payments. I did however not have my checks with me and felt that this was a rather unreasonable request, seeing that I did nothing wrong to have my account restricted in the first place. But augmenting with Capital One seems a waste of time. So on November 20th, I faxed the documents, as required to Capital One. Monday, 48 business hours later, I received a call from Capital One saying they received my documents, but needed to again verify my address. I refused to accept this, and asked that the account be closed, since I did not accept their way of treating me as a customer. I was told that they refuse to do that, until I send them my latest utility bill. Again wasting another 45 minutes of my time. I ended up faxing my utility bill to them. On Tuesday I phoned them AGAIN, hoping that they would’ve perhaps processed my documents, but was told that an agent will phone ME within 48 hours to tell me that the account restriction has been lifted. But, on Wednesday afternoon I have not heard back from them, so I phoned AGAIN. I was then told that it was still not processed and can take up to 72 hours!!! This was the first mention of this and completely different to that what I’ve been told up until now. Again a complete refusal to expedite the process whatsoever. Now it is November 30th. No word from Capital One. My account is still restricted. I had to pay $10 to do a balance transfer to my Bank of America credit card to avoid late feeds and negative credit reporting (although one lady told me they would take it into account, another told that I was responsible to get it sorted before the due date).
I am extremely frustrated and really disappointed that Capital One is allowed to treat a customer like this. I will definitely not recommend anyone to ever do business with them.

Unauthorized charges
I have 5 credit cards 3 are mine and 2 my husbands. Our accounts have been charged over the limit fees after they added the annual fees. I been paying the minimum payment they requested and they still are charging my accounts the over the limit fee. I don't understand if I am paying the amount they requested as minimum how they would are can charge my account over the limit fees.
When I phone them they hung up on me and then phone back again after saying I will cancel my cards they stated that won't stop the unfair over the limit fees. Am I reading the HR bill 5422 wrong after you cancel your credit card can they charge your account over the limit fees still?
