1. Visited Carriage Motors on November 28, 2007 to look at new cars, decided to get a 2008 Mitsubishi Lancer, they did he credit check, told us we were approved, signed documentation and the dealer put the white sticker on the car, said we can take it tonight. We advised them what our new address would be, because they insisted that we use our current one, since we actually had not moved yet. Moved December 3, 2009.
We did not want to take the car without any paperwork, they said we could get it tomorrow; it’s so late they want to go home, we decided to leave the car and pickup tomorrow.
2. November 29, 2007, Here to pickup the paperwork and the car, was told something happened, we can’t get the Loan through Mitsubishi, that we could only get a Hyundai, and give us a selection to choose from.
We were never given any documentation to resend the contract for the Mitsubishi on November 28, 2007, just our credit scores and privacy notice.
3. On November 29, 2009 my wife decided on her car, signed the paperwork, however there was other papers with it for service contracts, I told him we don’t want, the salesman said, don’t worry we have to show we offered it, I will document that you don’t want the coverage, and tried to get me signed the contract that was not completed, I said hold on this all needs to be completed, he said, don’t worry you can trust me, it’s late again, you don’t get your loan documentation for 6-8 months, it’s ok, everything will be ok., All you need is the white sticker in the window. We drove off with the car.
4. We got a call on November 30, 2009, stating we got a better deal for you, lower interest rates and everything, and since your wife was talking about a wing, and tint, put you wanted a upgraded alarm, we will offer you this free, since we know you plan to come back for a SUV.
We got there, signed the documentation to rescind the first contract, gave us the same lie about the paperwork, it was not completed, but will be taken care of, and will get everything in six months, then offered free upgrades and told us to setup a date to get installed at the service department. Advised them that one of our cars, is still in out of town, needed a loaner, they said they will take care of it.
5. In on January 28, 2009 to get the so-called free upgrades, we told the service department, if this is not the alarm that has tracking and remote start, we don’t want it, or anything done to this car, we don’t want any upgrades at all.
6. Picked up car on January 30, 2009, looked at everything, there was nothing changed except for the added wing, we told him we don’t want any extras, removed everything, this is not what we wanted, they said they could not.
7. We called various time, came by to talk to management told they are in meeting, or they are out, no one responded, even sent a letter February 1, 2008, requesting any additional items removed, and would not pay for anything other than the basic sticker price.
8. Finally got the paperwork for the loan and the illegally added items sometime in the second week in August of 2008, however I was in and out of the hospital until February 2009, and did not get to look at the loan documentation.
9. February 2009, requested to know what my payoff balance was, when we discovered for the first time that there is something wrong with my loan document balance.
10. Filed with Consumer affairs, and then later told to file with DMV Special Investigations after Consumer affairs sent my documentation to the CA Attorney General.
