Today on 28-4-2011 complaint has been lodged by the Chairman, People for Animals ( PFA ) Haryana Naresh Kadyan, representative of the International Organisation for Animal protection - OIPA in India with the SHO, Police Station, Sector-17, Chandigarh against the Mayer, Administrator and Health Officer along with many more meat shop owners for the violation of the Prevention of Cruelty to Animals ( Slaughter Houses ) Rules, 2000 made out by the Central Govt. as per section 38 of the Prevention of Cruelty to Animals Act, 1960 read with the Chandigarh Municipal Corporation ( Regulation for the sale of meat, fish and poultry ) Amendment Bye-laws, 2010 and section 3 and 11 of the said PCA Act, 1960. It would be pertinent to mention here that animal and birds cruel transportation also violates the Cattle Transport Rules, 1978 amended in 2001.

The sale and supply of unhygienic chicken and meat was high in the past, as per records of civic body. The medical wing of municipal corporation seized 146kg unhygienic chicken meat and fish in last 15 months from January 2010 to March 2011 and authorities issued 268 challans in the same period.
According to information, the seizure was not only done in rehabilitated and slum colonies, but also in shops situated in posh area of the city.
An official of medical office of health, Chandigarh said that most of the shop owners had become adamant after paying repeated penalties thus selling unhygienic chicken and meat to public. This was also one of the main reason, among other prominent, which forced the authorities to bring new bylaws, compelling shopkeepers to bring their chicken to the government slaughter house to ensure hygiene.
Members of meat association of Chandigarh have decided to give memorandum to and UT administrator Shivraj Patil on Tuesday. They have also decided to protest against MC's decision to slaughter birds at the government slaughter house by paying Rs 5 per bird.
The strike of chicken vendors entered into its sixth day on Monday. As shops remained closed, residents purchased raw chicken at high rates.
It's a platterful of unhygienic chicken for city residents as the mayor, bowing before the pressure exerted by vendors, has decided not to enforce the recently-notified meat bylaws in Chandigarh. With that, City Beautiful could give up on the idea of enjoying a stamp-approved, quality-checked dish of chicken at their favourite restaurant.
Municipal corporation had decided to implement the new bylaws from April 20. However, the sellers put up a huge resistance to the proposal by proceeding on a strike. Apparently giving in to the demand, the mayor tossed aside the notified bylaws. With these not enforceable, vendors would be able to slaughter birds at their own workplace, which earlier was described as an unhygienic practice by MC.
Though mayor Ravinder Pal Singh does not seem to mind putting the health of city residents at risk, his move has invited criticism from all quarters. In his defence, the mayor claims that the slaughter house is not ready to bear the pressure of slaughtering 15, 000 birds a day.
However, a senior UT official decried this reason, saying if this was the case, MC should not have sent the draft bylaws for approval to the administration.
Apart from facing flak from the opposition and nominated councillors, the mayor has also invited the wrath of citizen groups. BJP councillor Surinder Kumar Jagota said, ''The mayor should have taken the house into confidence before taking a decision that directly affects people's health.''
FOSWAC chairman P C Sanghi said meat shops lacked proper cleanliness and mayor had succumbed to political pressure as civic body elections were due this December. ''He has risked the health of lakhs to get a few hundred votes. We must launch an agitation against this, '' he said. Sanghi said birds were being slaughtered without their medical fitness being okayed. Claiming that the slaughter house in Industrial Area-I had proper facilities, nominated councillor Dr A P Sanwaria said, ''It is surprising that the mayor has least regard for the notification'.

Taking a decision against slaughtering birds at government slaughter house, situated in industrial area, city mayor said that there is need to improve the facilities there first. He ordered the officials of civic body in this regard on Wednesday and asked them to make the slaughter house well equipped.
When asked why things were not judged earlier before notifying the new meat bylaws in the city, he said that he was not aware of the intricacies regarding the decision since most of them were cleared by UT administration. But now that the matter has come to his notice, he observed that there is need to improve the facilities there.
Significantly, the civic body had invited objections from public, meat association and other groups before notifying the meat bylaws. On the other hand, members of the Chandigarh meat association are also planning to move to the court. Atul Sonkar, president of the association said that meat bylaws are not viable, because people prefer the birds to be slaughtered in their presence, before purchasing. ''We are planning to move to court, ' he added.
Hygiene issues
As per the records of civic body, medical wing of Chandigarh Municipal Corporation seized 1046kg unhygienic chicken meat and fish in last 15 months ' from January 2010 to March 2011 ' from various chicken, meat and fish selling shops of the city. The authority even issued 268 challans to the shop owners for supplying unhygienic chicken, meat and fish to the public during the same period.

Public Notice
The Municipal Corporation, Chandigarh as a part of its endeavour to provide quality & hygienic meat to the public has made arrangements for bird slaughtering at the existing Slaughter House in Industrial Area Phase-I Chandigarh. The amendments in “The Municipal Corporation (Regulation for the sale of Meat, Fish & Poultry) Amendments Bye- Laws, 2010” has been got done accordingly.
Now all the chicken sellers of the city are hereby directed to utilize the services of this bird slaughter house to slaughter birds w.e.f. 20.04.2011.

NOTIFICATION
No. MOH-MCC-2011/ Dated the Feb 2011
With reference to the Municipal Corporation Chandigarh, Notification bearing No. MCC-MOH-2010/7168 dated the 14th day of May 2010 and in exercise of the powers conferred by sub section 1 of Section 399 of the Punjab Municipal Corporation Act, 1976 as extended to the Union Territory, Chandigarh by the Punjab Municipal Corporation Law (Extension to Chandigarh) Act, 1994, the Municipal Corporation, Chandigarh hereby makes the following Bye- Laws further to amend the Bye- laws called the Chandigarh Municipal Corporation ( Regulation for the sale of Meat, Fish and Poultry) Bye- laws, 2002 after having the same approved from the Administrator, Union Territory, Chandigarh under sub -section 1 of sub section 401 of the said Act.
AMENDMENT
1. These Bye- laws may be called “The Chandigarh Municipal Corporation (Regulation for the sale of Meat, Fish and Poultry) Amendment Bye-laws, 2010”.
2. They shall come into force within the limits of Municipal Corporation, Chandigarh from the date of its final publication in the official Gazette.
3. In the said Bye-laws, the existing Bye-law No.5 (e) shall be substituted as under:-
“5 (e) Except in the case of packed or frozen meat, fish and poultry, it is provided with a drain and the whole floor is so sloped to allow all liquids to flow of by the drain to the City Sewer.”
4. In the existing Bye-law No. 15, the words “ The Principal Medical Officer, General Hospital, Sector 16, Chandigarh” shall be substituted with the words “ Any Government Dispensary or Registered Medical Practitioner with M.B.B.S. as minimum qualification.”
5. In the said Bye- laws, the existing Bye-law No. 18 shall be substituted as under:-
“18 (a) The meat/ poultry sold shall be slaughtered at the Municipal Corporation Slaughter House which shall be
duly stamped and meat /poultry used for cooking in a hotel, restaurant, eating house, boarding house, snack bar or any other similar establishment shall be obtained from a Licensee/ Slaughter House. Stale or unstamped Meat / Poultry otherwise found unfit for human consumption shall be seized and destroyed under the order of the Medical Officer of Health, Superintendent Slaughter House-cum-Meat Inspector and Meat Supervisor.
18 (b) The live birds kept for sale will be seized and sold in open auction after slaughter.
18 (c ) Every person incharge of bird shall pay slaughter fee@ Rs.5/- per bird for the use of Slaughter House managed by Municipal Corporation, Chandigarh.
6. In the said Bye-laws, the existing Bye-law No. 22 & 23 shall be deleted.
7. In the said Bye-laws, the existing Bye-law No. 27 shall be substituted as under:-
“The dressed meat, fish, bird shall be kept in a deep freezer or in a wire gauze covering and the premises shall be air conditioned.”
