On February 2, 2007, I entered into a 3 year lease agreement with BMW USA on a 2007 BMW 335i at Chapman BMW on Camelback.
When I had received my first bill from BMW, I called the dealership to ask why my rate was higher than what was originally in the contract, and I was told that the sales tax had increased, thus raising the monthly lease amount. I believed this because the sales tax rate in our area had in fact increased, and I didn't think anything of it.
Fast forward 2 years.
On April 9. 2009 I had BWM Financial Services fax me a copy of my contract because I was looking at the possibility of trading in the car to get another car, so I wanted to determine how much I still own, and what the payoff amount is.
To my surprise, the contract they faxed me has different dollar amounts, and my signature on the contract is clearly a forgery.
The contracted monthly payment (my contract) was $780.46, and the payment I have been maying for the last 26 months is $795.15. The residual amount of the car on my contract is $30, 658.95, and on the copy that BMWFS has, it's $29, 199.00.
What are my options? I want to terminate my lease and get a new car. Since the contract that BMWFS has on file is not the one I signed, do I have to honor the contract?
I scanned and e-mailed a copy of my contract to BMWFS but it's a week, and they claim they have not 'received it yet' even though I immediately got an automated response that said it was received.
Any help or advise would be great. I would be more than happy to furnish a copy of my signed contract and the copy of the signed contract that BMWFS has on file to help this matter along.
