Terrible experience
I was defrauded and sold stolen goods by Circuit City(CC) in North Bergen, NJ where they sold me a Hewlett Packard(HP) laptop that I opened at home and found its contents was a completely different model laptop than that which I paid for. The model in the box was physically damaged as well as an older (2 years), and different model. I repackaged the item and tried to rectify the situation with the store and was denied the return.

I later found out, through direct contact with HP that the merchandise I received was previously registered and REPORTED STOLEN by the previous owner. I unsuccessfully disputed the charge and my final rejection came through today. Now I plan on exploring my legal options and would appreciate any advice as to where to begin.

To recap: I bought a new HP laptop from the CC located in NB, NJ and, upon opening its contents noticed some damage on the case so I repackaged the laptop to return it to the store for replacement. A store employee, upon inspecting the laptop, determined that beyond being damaged that the laptop I was trying to exchange was a completely different model than that I purchased and that they could not accept the return. Of course I was both flabbergasted and irate over the situation and had the store provide me a record of the incident and returned home with the 'packaged' laptop upon which I called CC customer service department. The cust service person opened up a service ticket and instructed me to speak to the Operations Manager who would be in the next day. I was left with a complaint number and the next day

I called Anna the Ops Manager from the store with my situation and she again rejected my exchange and was told to contact HP over the incident. I then reported the above scenario to HP and gave them identifying information on the laptop I was supposed to receive (marked on the box) and that which was packaged (bottom of the laptop) and they opened a ticket.

A few days later I was told by HP that they could not provide any more help and/or details because the 'packaged' laptop had been reported as STOLEN from the previous registered owner yet no police report was ever sent to HP. Since that time I had disputed my charge through AMEX twice, initiated a BBB complaint, and spoke to CC executive staff and they continue to deny any wrongdoing. This is absurd, criminal (at minimal negligent) behavior because the previous owner of the laptop that they sold me as new was registered about a year earlier as Daniel Hernandez from North Bergen.

Terrible experience
I returned one of Circuit City product, worth over $400, 2 days after buying it. I was told to wait for 2 weeks to get my refund through mail. Concerned not getting my refund via mail after 2 weeks of waiting, I went back to store to find out what the problem was. They told me, i should actually have to wait for (21 days & 6 additional days) to receive my check via mail. So I did. After 27 days of wait, i still didn't see my refund in my mailbox. Assuming, it could be error of delay from the postal service, i waited for 3 additional days, but still didn't get my refund. I went back to the store, wondering why i still haven't received my refund. Now, this time i was asked to wait standing in their store for one full hour while they were foiling what the problem was. After waiting for one full long hour, they tell me it's going to take again couple of more days.

Is this even legal... is there a way to fight this? There business practice has left very frustrated. Any suggestions from anyone?

Bad laptop
I purchased a laptop from Circuit City store in east palo alto today. When I opened the box after getting home, I found one of the back cover at the bottom of the laptop was not installed properly, the plastic cover was tilted open with one screw on one edge. Plus the LCD monitor does not have the protection sheet on the surface. So the unit is defective and does not look like a brand new one. So I went back to return the unit, only to find out that there is no way to return it. They want to charge me 15% restocking fee even though they sold me a defective unit in the first place. The store people was very rude, they just point me to the rules printed on the back of the receipt, which says that I can not return it for a full refund because he box was opened. I mean, come on, how can I find if the unit is defective if I don't open the box? I argued with them but they simply couldn't care less. The only other option for me was to swap it to another unit of the same model.

Does anyone have the similar experience? It sounds so unfair to customers. I mean, why cant I return a defective unit for a full refund after only two hours of purchasing it? If they don't allow people to open it before making payment, and then charge 15% once the box is opened and defective is found, is this the same as robbery?

Will not return calls
I took my sons desktop in for diag. on June 30th.on July 8th no one has called so I called them and was put on hold for 10 mins. I called back and got a young girl that said the computer was there but there was no notes and she would call me back. Never heard back from her so I tried to call back and was left on hold again for 15 min. no one seems to know what they are doing there and I don't think they really care. Just a bunch of idiots. I’m surprised Circuit City is still in business, I know if I ran my business like these people I would not last long.

No service
My husband bought a demo laptop after which he was informed the password and screensaver had to be changed and should only be a few min. the firedog guy was told and said he had to certify it and it would take at least an hour at which point he went to assist someone else. He was the only one there. Husband left and returned approx 30-45 min later to find him assisting someone else and not working on the purchase. We told him to remove the screensaver and password and we would take care of everything else. The manager informed me that this was only placed on the floor for sale today and they had not had time to fix it prior to the sale. I do not think the computer should have been placed for sale before being ready or we should have been informed of the situation prior to purchase.

Fraud and scam
I wanted to purchase a laptop from circuit city, and did NOT want their 300 dollar extended warranty plan. The associate tried to explain to me in stilted, poorly-rehearsed words that I would have to buy the plan if the computer malfunctioned, despite it still being under the manufacturer's warranty. Every time I caught him in a lie, he moved on to another matter. Finally, he told me I could not be given a recovery disk unless I bought the plan.

I called bullc**p. A system recovery disk should come with every operating system straight from the manufacturer. He told me that Toshiba no longer does this, and that I would be REQUIRED to buy the plan if I wanted one. I told him I could simply contact the company to receive one if that was the case, and he said they didn't do that anymore.

I refused anyhow, and upon arriving home, opened the box which still had a factory seal. The recovery disk was inside it, just like I knew it'd be. When I called the store to complain and to ask why the employees were coached to tell unwitting customers that they 'can't fix a laptop without the recovery disk, and must buy the plan to get it, ' he did not refute anything, nor did he apologize. He said he would 'talk to the guy' and that was it.

My emails have gone unanswered, and no one at circuit city is interested in the issue. I drove past a best Buy to shop there, and it is insane that with the economy on a downward spiral, circuit city would try to wrangle extra money from already expensive purchases.

Terrible company
I just wanted to let you know that I am extremely disappointed with Circuit City. I bought a sharp LCD TV seven months ago, recommended by your seller. The picture went away completely after seven months. "Luckly", I had a warranty. They told me that it would take 2 weeks to be repaired. Shouldn't I get a new one??? What kind of service is that? Shouldn't they tell me that the warranty would not get me a new TV set but it would instead be sent to repair? I'm talking about a 7 month old TV that broke and then I'll have to stay without it for two weeks?? I've called the manager and he gave me attitude. I will never buy at or recommend Circuit City again.

The store is in Manhattan at 80th and Broadway 3680.

Gave me a used item, paid for a new one
I used Circuit City online to order then pick up a keyboard and mouse combo hoping to save time and money. What I got instead was a refurbished keyboard and mouse not labelled as a return item and sold to me as a new product. The keyboard had dust between the keys; the mouse was scratched up, the software opened, and the packaging even was missing the six AA batteries that came included. I received feeble excuses when calling them. They didn't even offer any compensation for their error except for an exchange, which can be all fine and dandy if you like wasting extra time, money, and gas just to drive back there for the exchange.

Lost my laptop
What the *** circuit city?! I have been waiting for 8 *** months and you *** lose my *** laptop?! What the ***! I want my frickin laptop now find it *** it! It has been gone for 8 *** months now and I keep calling to check up on it and all you *** keep saying is "no it's not back but we're looking for it." it appears to me that you little *** are *** with my patience and that you *** are doing a *** job at your job and you fucktards should be sued.

Scam and cheating
Our problem is that we purchased a TV and warranty from Circuit City in Brick NJ about 18 months ago and the reason that we purchased the extended warranty is that it was sold to us as accidental damage. Since we have 2 little boys we figured it was well worth the extra $659 for a 3 year 'safety net'. Now that we tried to use this warranty we are being given the run around and told we don't have accidental damage coverage. We have been trying to go through all the channels as the store and corporate has told us and they keep changing their answers and policies. Even the store employees stated out right that we did indeed purchase the accidental coverage but to this point, 3 months later, they are not honoring their coverage of replacing the TV.

All that we received from the time of purchase was our receipt with a code on it that states nothing other than their protection policy was purchased, a brochure which states if we can not fix it we will replace it. Upon further searching we found that on their website they state that the warranty will be explained to you before your purchase and that will govern what and how the warranty covers your purchase. Furthermore, they no longer sell accidental coverage on the tvs but they sell the warranty for 3 years at $359 and 5 years at $559. This $359 warranty is what they are trying to claim that we bought but for $659 which is a complete lie since they have the same basic model tv only the newer version of it at $100 cheaper than we paid with the warranty at $300 cheaper. The salesman told us that if we purchase this warranty we could hit the tv with a baseball bat and they would have to replace it. This is the only reason we purchased this warranty and now that we are trying to use this warranty they are giving us the run around.
