Outsource to bad collection agency!
Well, I fell behind on my car note. This is typical of me- I have kids and an unemployed husband, and I'm in a strange city with no family close by. I always catch up though. I used my tax refund to pay a hefty payment to them, and thought I was paying a month ahead. Usually when they have a problem with my payments they call my mom and deliver a message. Not this time. A collector from an outside agency in Texas called her, and scared her to death. She called me at work- where i am not allowed calls- because she was so scared. When I contacted him I explained that i would not provide any info because cfcu already had it, and everything was current. I put my mother's number on notice as a non-contact number, and he continued calling. He weaseled my boyfriend's cell phone number out of her, and left a nasty message for ME on it. He insulted my boyfriend on the message (but they'd never spoken) and said things like "This is why you'll always be paying lot rent on a trailer, but I guess that's ok with you" on the message. When I called him back, he told me that he had 6 agents surrounding my empty house because I had broken the law by infringing my agreement. I immediately laughed, asked him what color shirt i was wearing, then contacted CFCU. When I complained to them, they told me they have nothing to do with his practices and that they simply hired him to get a peaceful resolution. I paid them directly, and I never made any federal or state complaints. Maybe I should have, against both the collector (name Kevin, based in TX, refers to self as investigator), and CFCU. There were serious violations which CFCU did nothing about, and it was damaging to my mother's peace of mind and my boyfriend's self esteem ( he thought I was talking about him behind his back). Plus, as a collector myself, I know the FDCPA guarantees me $1000 per violation, and I would have a nice down payment on a house! Is there an SOL for filing complaints?
