Last year (sept 2007) i was about 3 months behind on my payments. I sent they a payment and a half and they returned my check. Not once did they notify me that my home was then in foreclosure. I have fighting this for the past year and just when i think i am getting some where i am back at square one. So about 6 months ago i had worked with American Foreclosure Specialist (i paid them $1200.00) who worked with Citi Residential to do a Loan Modification. Everything was said and done on Aug 26, 2008 Citi Residential said they needed a down payment of $2000.00 in order to do anything more. I Western Union them the money and Sept 23, 2008 they fed ex me the Loan Modification paperwork and i sent it back to them by Oct 2, 2008 when it was due to them. I also made my first payment of $941.00 to them by Oct 1, 2008. 3 weeks ago i received a letter from the sherrif telling me that my home was going up for Sherrif Sale on 12.4.08. So i called Citi Residential and they told me that everything was ok and that that would be removed. Ok so i believed them. I waited a couple weeks and i called to follow up and 11.4.08 i called and they are telling me that everything has been canceled and my home is back in foreclure because they did not get my paper work in time... but 3 weeks ago they had everything. Is there anything i can do. They took my money $2941.00. and are telling me there is nothing they can do at this time. I talked to a lawyer and they told me that i should find a place to live.
