Hi,
I came in NJ on Feb 2008 and joined an employer A since employer A
had my H1B visa. The day i landed in NJ they had give me one
contract to sign on it. I signed because i thought, i will be
working with them for long. But from feb 2008 to april 2008, i was
sitting idle in employer's guest house with no client and no job.
Meanwhile i started to market myself and went for an interview to
empoyer B for permanent position. Fortunately i got cracked the
interview and got temporary offer letter. They offered temp because
they needed background check.
During background check, my employer A got to know that i am about
to joing employer B and send me to a client to Austin, TX. I have
worked there one month and meanwhile my background check and visa
transfer were being processed. Once i got confirmation for visa
transfer, i had given two week notice to my employer A and came to
employer B. When my employer got this resignation letter, they
started to have negotiation with and pushed me to pay 12000 USD as
compensation regarding what they had spent on me. However, as i know
they have spend only for visa filing and nothing else.
Now, after 3 months later, they have filed a suit againt me. Please
suggest me what should i do.
