preditory lending and foreclosed my house with a new buyer after court
On oct 2000 to july2005 i purchased a home for no money down first time home buyer took advantage of my savings my checking account with a adjusment rate mortage and turned around and sent forclousure information along with a ballon payment of 8, 000.00 after asking for a monthly payment of 1482.00 a month when i moved in my monthly payments were only 200.00 dollars more than my beautiful 1 bedroom apartment in brentridge in Antioch payed every month 600.00 a month never late and ontime.today and now bad credit foreclosed on and a homeless veteran with four kids a wife one income lost house first then my good job in 2006, countrywide ought to be made to pay back that ballon payment of 8, 000.00 just to help me qualify for another home, with another good mortage company, the greed of this all the hardworking people whos been taken advantage of with this type of business.my wife now our wedding had to be postponed until we could afford it, just another hardworking american veteran taken advantage of by the country i served for in the military greed and deception will ruin a world, are there anyone in america honest anymore, my Dream was shattered by this mortage company. Avoid doing business with them
We inherited my husbands grandmothers home in 2008. The home was titled to my husband on July 22, 2008. The house is 165 years old and needs quite a bit of remodeling. It is structurally sound but is living somewhere between the 60' and 70's with its 4 kitchen cabinets, brown paneling, gravity fed heating system, and 100 amp electrical service. So we figured since we inherited it and had no mortgage we would take out some equity and do the remodeling. We contacted countrywide after seeing there ad on tv. We were told that my husbands $50, 000 a year income was more than sufficient to handle the mortgage payments for a $30, 000 loan. We were asked to pay $425.00 to cover the credit report fee and the appraisal fee. We did so right then and there. They told us that it would be about 2 days before the appraiser would call to set up the meeting. two days later the appraiser called. She set the appraisal for the next day. About a week later our loan officer called to tell us that our house appraised at $95, 000 and the loan was a go. They sent all of our loan documents to us through fedex. We signed the papers but held onto them as we wanted 2 small errors fixed on the paperwork. Minor things, our previous landlords name was spelled wrong and my husbands retirement plan amount was incorrect. I called our loan officer every day for a week with no answer. So I started calling her manager with no answer and no return call from either of them. At this point we are now in week 5 of our loan process. So I got an idea, I called the lady from underwriting whose name appeared on our loan papers that we were asked to sign. She proceeded to tell us that those papers are written up at the time of PRE-APPROVAL. I explained we had already gone through the appraisal and were told that it was good and our loan was a go. She proceeded to inform me that she informed our loan officer and her manager that our loan could not be done at the time we applied for the loan. I asked why. BECAUSE MY HUSBAND HAD NOT SAT ON THE DEED FOR 6 MONTHS. The day after I spoke with this woman our laon officers manager called us back. He explained that the loan we applied for requires us to sit on the title for 6 months. When I asked why we were not informed of this in the beginning he could not give me an answer. After about another 5 phone calls to various departments we recieved a refund for our appraisal. Now the next deal with them was probably our own stupidity. But 7 months went by. We went back to countrywide and reapplied for the loan. We were told that we would have to have another appraisal done since the first one was more than 6 months old. this would cost us another $425.00. We paid it again. The man I spoke with assured us that there would be no issues this time. Well, the appraiser came and was not as thorough as the first appraiser. A week later we recieved a call from our loan officer telling us that there were problems. The appraiser said our home was only worth $69, 000 and that value was only good if we completed the repairs that were listed on the appraisal. The repairs consisted of a NEW heating system that was not gravity fed. (estimate from a contrator $12, 000), There had to be carpet in the living room. We ripped up the old carpet and found the floor under it was not in the best shape so we laid new would and then ran out of money. (the reason for getting a loan). There were also a few other minor things. Now when I told the loan officer that the items listed in this report were items that we listed as wanting to be done with the loan money his exact words were 'then fix the things on this appraisal and we will give you the money'. Now, if I had $12, 000 to upgrade our heating system (which we want to do) WHY WOULD I NEED A LOAN? This 2nd process took about another 6 weeks to go through. The 2nd appraisal was done by a different company than the first. There was NO difference in the house from the first appraisal to the 2nd. Except for 1 minor detail. The 1st appraiser said that the outside of the house needed to be repainted due to chipped paint. So we paid almost $400 to buy paint and me and my 17 year old son spent 4 days painting the outside of the house. It was white, we painted it red so that there was no dispute that we painted it. Other than that there was NO change int he status of the house within the 7 months between the appraisals. So again countrywide got our hopes up and then screwed us. We did get our appraisal fee from the 2nd time around back. But it was only after I called the presidents office and threatened to get a lawyer, as I still had all the emails, hard copies, and phone messages that were left with us from countrywide. I do not know what this company is trying to pull but I hope at some point someone will have enough ammo to knock them right out of the park.

I wrote and called every department of Countrywide... even the President of Countrywide... begging for them to help me. There was nothing they could do they said. Then Countrywide's President received $38 million as a bonus. So he did not care what happened to me or anyone else. Not only am I broke, I am humiliated when people in the news say I should have known better... yes, that is probably so but it doesn't help to solve any of this. And now today in the news those same Countrywide Executives are buying up our homes for penny's and going to continue to make millions while I live on nothing.

Foreclosed on me without notice
In preparation for the birth of our daughter in June 2008, my wife contacted Countrywide in Feb of that last year. They told her that they could put us in a Hardship/Forebearance program that would delay our mortgage payments for 4 mos. while she was on Maternity leave. This sounded great as we are a dual income family and without one income it would be hard to make payments. The rep told us that after she went back to work we would negotiate how to catch up. Whether that be adding the amount to the end of our loan or making larger payments. We jumped at the chance for this. When my wife went back to work in Sept. the top item on our list of priorities was to get our mortgage taken care of. We called Countrywide and they told us that a negotiater would be in contact with us. About a month later we called again with the same answer. This is the same thing we have done for the past several months with the same answer every time. They said not to make any payments that it would go to the principal and not to the past due balance. The last contact before now was in January. We were told that they were so busy with the Mortgage Crisis that we would be dealt with soon. On March 17, 2009 my wife was in a Head-On car accident. Luckily by the hand of God, my wife was not hurt. The accident was not her fault, but the car was totalled . My wife called the bank to see about getting a loan and because of this mortgage thing our credit is ruined. At this time she decided to got to a Countrywide branch and sit until she got it taken care of. When she went of course nobody at the office could do anything but her on the phone. The rep informed my wife that our home is in foreclosure, and would be sold May 5, 2009. We were devistated of course. We have the money in savings to pay the arrearages. We just have been told not to pay. Over the past few days we have spoken to an attourney, and contacted several different people at Countrywide with no help. I told them 'I want to pay my mortgage. I don't want to file for Bankruptcy.' I asked for them to tell me who, where, and what to pay. They can't give me any info. They claim we were offered modification. Which we never received. They claim that we were sent notices of foreclosure which we never received. I read that it is the law to send certified mail(signature required)before foreclosure can start. When I mentioned this to the Countrywide rep she agreed then when I told her that we never received it, she changed her story saying that we must have gotten it. I explained to her that this alone was grounds for litigation. She told me to do what I needed. Suprisingly when we got home today there were four diferent letters stating foreclosure. When we called they said our file is still in foreclosure for May 5, but we were being considered for modification. We asked when we would know if we qualified the rep said to call back in 30 days. That is 9 days before our house is to be sold. This is Ridiculous! I just want to pay my mortgage! I can afford my mortgage! We both have Jobs! Why can we not get this resolved! Anyone that can Help please contact me. I am desperate. We don't want to lose our home, we dont want to file ch 13 and ruin our credit for years over a mistake by a Scandalous company.

Scam artists
Countrywide Home Loans is requiring and has taken out a $2, 000 flood insurance policy (which they are deducting from our escrow account) on our property on Mission Beach Road in Marysville because they say it is within a flood zone and it's required by FEMA. The FEMA map we find online through FEMA shows our property in flood zone X which is not in a flood zone. We have called Countrywide and they say it's out of their hands, that their "new" map says FEMA has us in a flood zone. The only way to change it is to get a LOMA (Letter of Map Amendment) from FEMA. We think Countrywide is scamming us and maybe others.

Scam charges
We have a mortgage with Countrywide. We are now being harassed and threatened with foreclosure. Countrywide had inflated my husbands income on the application and also added my daughters social security that she draws from her dad who is deceased. This money is for her care, not for the home but they inflated that also. We have attempted to contact them numerous times to have them work with us to lower our payments so that this would not happen but each time they refused or became so rude that they would eventually hang up. They are charging us escrow when we told them that we would handle the taxes and insurance ourselves and also charging us late charges when on the transaction statement for 2008, under the "late charges" column it is all $0.00. They have raised our payment 3 times. Our contract is for $490.05, then it went to $642.81 now it is $697 beginning in Feb. My husband does not have a job that makes us millionairs, we are just hard working honest people that do not want to lose our home of 14 years but what can we do? We cannot fight this Predatory Lender that is an American Terrorist preying on the hard working people to cause them emotional, physical and mental abuse. There are currently 260+ homes in the state of Tennessee alone that Countrywide has as foreclosures. 15, 108 in the United States, how many more are going to be allowed to become victims? I'm sure we will, we have purchased a 27' camper and plan on moving into that just so that we can get away. How sad is that? America used to protect us against terrorists, maybe we are fighting the wrong ones? I hope that someone will read our story and find it in their hearts to help us so that we don't lose our home and make Countrywide stop all of their illegal and predatory practices.

Awful, awful, awful
First, I want to say that I was in the Title Insurance Industry for 35 years and know my way around the block-but dealing with Countrywide-BOA is like dealing with morons from outer space. It Seems that whoever can figure out what is the 'least they can do' to hang on to their jobs-are the ones who are still employed. I bought my home in 2005 when I was employed. More than 20% down, excellent credit, fixed rate loan. Unfortunately, I became 100% disabled in 06. It took 18 months to get on Social Security (18 months with zero income) and another year to get medical insurance. Somehow from savings and selling off things I was able to keep up, while trying to sell the house. Last year I finally hit a brick wall and entered into a Forebearance Agreement with the bank. The second payment was returned, as some idiot sent me an envelope with the wrong address on it. Everytime I called I got some new nitwit and had to go into the entire deal again. Finally, I had to resort to a short sale. Lucky for me, I found someone who really DOES understand how to go about it. The bank has been nothing buy uncooperative. First offer was rejected (after 6 weeks) they still don't come up with a price, but pay some out of work realtor $75.00 to do an 'appraisal' (never going in, of course). Next offer is in. Price is only off by a few thousand-they are sitting on this offer like a whale in a lifeboat. Calls go unreturned-answers are stupider and stupider as time goes on. If they just let the house go-they are done with it. The shortage is only in the $40, 000 range. (Small potatoes by current standards). I guess the brilliant BOA powers that be would rather pay taxes, hoa, insurance, etc than unload the 'inventory' as they are supposed to do. Do they want to end up with all these houses ?? Who is in charge there? Did they go to the Romper Room school of business? Why are they allowed to get away with this?? If the taxpayers are sending billions to this bank-why are they not being told what to do as are the car companies. It is my understanding that Countrywide/BOA is the worst of the worst when it comes to this. Class Actions-Anywhere out there???

Not posting payment
I made a payment via Countrywide's website to pay my April home equity line in full. After a few days, I realized Countrywide had not posted my payment, and they had blocked online access to my account, with a message that it requires 'special attention'. After calling the number provided on their website, they said they hadn't posted my payment because my account was in the modification process. I told them I was not interested in any modification, and wanted my payment posted. Just for the record, in the 8 years I've been making my mortgage payment, I have NEVER been late, and I have excellent credit.

The representatives are giving me the runaround, saying they will fix my account and post the payment, and for me to call back the next day.

It has now been about 3 weeks since I made the payment, and I have called repeatedly to resolve the problem, and as of today, my payment has still not been posted, and they have given me a late fee!!! I filed a complaint today with the Office of Thrift Supervision and the OCC. I will also be mailing a letters of my complaint to every Countrywide mailing address I can find.
