They tried to board up my property that is occupied
I contacted Countrywide to request a workout plan to help save my investment property from foreclosure. I gave them all of my financial over the phone & they stated that I have a deficit every month. I agreed due to the fact that this is a two family home and I recently lost both tenants due to lay offs.

They told me once my income changes call back. I told them that it is taking me a bit longer than usually to rent my apartments due to the foreclosed board up that are in my neighborhood.

Countrywide then contacted my insurance company & told them that the property was vacant. I soon then received a letter of cancellation from my insurance company, stating that the property is vacant. I asked my insurance company who told them this & they stated Countrywide. I could not believe that they would do such a thing being that this is the collateral that they have a loan against. In fact if the policy is cancelled then the collateral is unprotected against any losses. I write a letter to my insurance provider stating that I currently had someone staying in one of the units as I attempted to rent both units, which is true & I lived next door as well. My policy was reinstated.

I guess that didn't sit well with Countrywide now that my property again has full coverage. This all took place two weeks ago.


Today I decide to go home for lunch in order to save money, remember now I live next door to my investment property & when I got home there were men inside my investment property attempting to board it up. I couldn't believe it! There is no sale date as of yet, so they do not have the right to break into my property, and the law firm handling the foreclosure for Countrywide hasn't even responded to my letter of dispute of the debt. Countrywide seems to just do what every they want when every they want.

I called the police. The men attempting to board up my property told me to call Countrywide home preservation department. I call them & I was told to call customer service. I called Customer service & they didn't see any notes with regards to a board up request and I was transferred to loss mitigation. They stated that the property was reported vacant by there inspectors. I asked how could a home be vacant with a car in mint condition with current tags that's parked in the driveway, and you can hear music playing inside the house from the outside, and the property is well maintained & secure. The representative stated that she doesn't do inspections but she will email the preservation department with my complaint. I asked her to tell theses men to stop their attempt to board up my property. "She stated that she could not do that, and that I would just have to call the police because there is no one here that can help me".

They police came and stated they cant file a report & that the men didn't have a court order. I Then asked the men to take there things and go. The men told me that the property didn't seem to be vacant upon there arrival but they called their boss who is hungry for money & was told to find a way in and board it up. I put a call in to a law firm. I can't believe that Countrywide would do such a thing without contacting me to verify if my property was vacant. Does anyone know what can be done about this because I don't want to waste my money rite now for a lawyer if I don't have to ?

Fraud and cheating
My husband & I bought our home in 2005, right at the Real Estate's all time high. This was are first home together, and the foundation of which we would build our family. (We have 3 biological and 2 foster children)

When Countrywide financed our home they set us up on a 'NEG-AM' loan, which you pay a minimum monthly payment and the Negative balance goes on the back end of your loan. They assured us that we would be able to refinance our loan in 6 months and get a 30 yr fixed. However, this was not the case. After six months we tried to re-fi. Our home already had depreciated 15, 000. We decided that since we could afford to make our minimum payments that we would continue on, in hopes that the housing market would go back up. HAHA... IT only got worse.

In July of 2008, after never missing a payment, I contacted Countrywide to ask about a loan modification. They asked questions and we began the process. They said they would call us in 3 to 5 working days with an answer. That never happened. I called back about a week later and spoke to someone in India. I explained the situation and they said they never received any information about the first call I had made. Once again We started the process again. I called back about a week after faxing all documents to them and The representative told me that they could not help us because we had never missed a payment. She also stated that we do not make enough money to afford our home.

In October 2008, I received a fedex letter from Countrywide. This was the answer to my Prayers. SO I THOUGHT. I opened the docs and read very carefully. It was an interest modification until 2015. My new rate was now to be 4.25% instead of 6.25. This would bandaid the problem temporarily. Here is the catch- it states ' Please be advised that your monthly payment WILL increase significantly when the interest-only term expires and you are required to make principal and interest payments for the remaining term of the loan.' This is known as a 'SHOCK' loan.

At the end of October, I sent Countrywide another HARDSHIP letter along with financial statements, certified mail. I told them in my letter that I appreciated their offer, however in no shape or form would that help us. Once again, I am fighting the fight and not giving in. I followed up on that and guess what? We don't qualify. How is that so? They said they already gave us help, which we denied the offer. At this point, I had intentionally missed 3 months payments, assuming this was the only way they would help. They also advised my husband not pay our credit card companies.

Febuary 2009 rolls around and Countrywide Collections calls for the mortgage payment. We explain the situation to the lady and she asked if we want to try again? OK, sure-why not! I get all the info together once more and fax it to the Home Retention Department. I called back about 4 days later and The lady says they never received the fax. She assured me that she would note my file that I would re-fax the paper work (so they don't close the case) and gave me by the end of the working day to do so. So I did. I felt HOPEFUL with the BAILOUT President Obama had just passed.

On March 17, 2009 the Home Retention Department called my husband. The Man he spoke with told him that we do not qualify and there was nothing more they could do for us. They referred us to the HUD counseling agency.

I am dumbfounded by what Countrywide is doing to millions of Americans. They tell us that they can not help us because we have not missed payments, so we do (which severely damaged My credit- now cant get a loan even if I tried) and then they Turn us down. They constantly play mind games with you. Nobody at Countrywide has a clue about what the hell they're doing. They are a cold & deceptive Company and they should be done away with forever. I feel like anyone who is in the same predicament as Myself, should join forces to take these bastards down. They Are a Company that destroys families and they should be punished!!! PLEASE HELP WITH THE FIGHT!

Mortgage/Escrow woes
This company lost payments, increased payments, took double payments from our personal account, put an unauthorized escrow on our account which included taxes, insurance and water and sewer. There was no need because we were never late on any of them. Then continuously applied payments to the escrow instead of to the balance due, put negatives on my credit report claiming that we were late after they applied it elswhere. After I reported them to the BBB they responded to me by trying to charge me $40 for a payment over the phone. This is a company that is very slimy in how they deal with there customers because according to an Attorney I spoke to, it is legal, Slimy but legal

Fraudulent company
I just realized today that I have not received a bill from Countrywide in the past two months. I immediately called to see if I just lost my mind or what. They insisted that they had sent the bills to the proper address. I immediately made a double payment by phone and was charged a late payment for February. I argued that we have made all our payments on time since 2006.

I told them that I rely on receiving the bill as I not only do my personal bills, I do my fiance's personal bills and I am a bookkeeper for his company, and I have my own business. I process a lot of checks each month. They told me that the paper bill that we receive every month is just a courtesy and that they don't have to send the bill by mail, that I could go online and see everything there. My God, what if I didn't have a computer or I didn't know how to use one? I just hope now, that they haven't messed with our credit by making a report to the credit bureau. If I find out that they did that I will go to every length possible to ruin them. I believe this is how they are making money, if they pull this every once in awhile to a couple thousand people then they can get away with it. They have a very cocky attitude about it too, as if it was all my fault that I never received the bill. I am responsible for paying six mortgages every month, if I don't get the paper I'm screwed.

MISLEADING CONSUMERS
IN OCTOBER 2008 MY HUSBAND AND I CONTACTED COUNTRYWIDE TO OBTAIN HELP WITH OUR HOME MORTGAGE LOAN AS I HAD LOST MY JOB AND RECENTLY HAD A BABY AND WE WERE FINDING IT VERY DIFFICULT TO MAKE OUR MORTGAGE PAYMENT. WE WERE TOLD BY THE EXTREMELY RUDE REPRESENTATIVE THAT AS OUR ACCOUNT WAS CURRENT THERE WAS NOTHING THEY COULD DO TO HELP AND TO CALL IN NEXT MONTH WHEN WE HAD A PAYMENT DUE. WE CALLED BACK IN NOVEMBER AND A REPRESENTATIVE TOOK ALL OUR FINANCIAL INFO AND TOLD US THAT WE ARE SPENDING OVER OUR INCOME THEREFORE THERE WAS NOTHING THEY COULD DO AND WE HAD TO CUT OUR EXPENDITURE IN ORDER FOR COUNTRYWIDE TO HELP US. MY HUSBAND AND I PAYED OFF SOME OF OUR CREDIT DEBT, SOLD OUR CAR ETC TO OBTAIN HELP. AGAIN WE WERE TOLD BY AN EXTREMELY RUDE REPRESENTATIVE TO CALL BACK WHEN WE HAD A PAYMENT DUE ON THE ACCOUNT.
I CALLED BACK ON MARCH 3RD AND WAS TOLD BY A SUPERVISOR THAT ALL THE PREVIOUS REPRESENTATIVES THAT WE HAD SPOKEN WITH HAD BEEN MISLEADING US AND THERE IS NOTHING THEY CAN DO UNTIL THE NEW BILL PASSED BY OBAMA IS IN EFFECT AND YET EVEN AFTER THE BILL GOES INTO EFFECT THERE MAY BE NOTHING THEY CAN DO TO HELP US.
WE HAVE BEEN SACRIFICING OUR HEALTH. WE DO NOT HAVE HEALTH INSURANCE, WE DO NOT HAVE ENOUGH MONEY TO BUY FOOD OR DIAPERS FOR OUR BABY AND WE DON'T HAVE A CAR TO TRAVEL WITH. WE LISTENED TO COUNTRYWIDE AND THEY DID NOTHING BUT MISLEAD US TO POVERTY AND NOW WE HAVE NOTHING!

Terrible company
In October, 2008, I signed up for Countrywide's PayPlan/26. This program drafts 1/2 your monthly mortgage and in doing so, my savings would have been $70, 942.00 in interest by applying essentially an additional month's payment each year.

The first draft was taken out of my checking account on 10/16/08. On November 11, 2008, I received a letter from them stating that my PayPlan/26 service has been discontinued because a special data condition exists on my account. No one that I spoke to could tell me what this 'special data condition' was, and I made a payment of $2, 574.62 over the phone, plus they charged me $12 to take the payment.

Since that time, Countrywide has failed to get the PayPlan/26 program working on my account, and they failed to take the bi-weekly payment from my checking account.

I chose to wait to see what they would do. This past week I received a letter from them, return receipt requested, which I signed for at my local post office. It seems that someone can take the time to send a threatening 'Notice of Intent to Accelerate' but the same person can't take the time to investigate the history of the account.

Sorry for you Countrywide, but I'm not doing your job(s) for you.

I'm sending the equivelant of what they were supposed to take from my checking account, minus what's already been paid, and minus the $12 fee they charged to take a payment over the phone when they failed to automatically draft from my checking account.

It's clear to me that they are deliberately sabotaging the PayPlan/26 program in the hopes that they can collect bogus fees and late charges, and hoping that I'll stick with the original 30-year fixed mortgage, thereby collecting the $70, 942.00 in interest that the program would save me. Guess again, Countrywide.

I'll be filing complaints with the Better Business Bureau, the United States Congress, the Office of the Comptroller of the Currency, to name a few. I'm quite certain I'm not the only mortgage holder that Countrywide is trying to dupe. I am, however, not going to sit by and do nothing.

I'm very interested to hear from anyone who has had similar problems with Countrywide.

Countrywide Rips off Elderly
I am writing this letter on my father’s behalf due to his macular degeneration. After the death of my mother we found that she had refinanced the loan on their home that they have lived in since the 1960’s. She refinanced with Countrywide Loans over the phone in 2/06. She was 80 years old at the time and not in the best of health.

We knew she was thinking of applying for a reverse mortgage, but Countrywide ended up giving them a 30 Yr Conv Jumbo Arm (NonConf Arm Libor 7/1 EC IO) an interest rate of 6.375%. If any of the family had seen this loan we would have put a stop to it. But she kept it from us because she knew she had made a big mistake and carried this burden with her to her grave. In reviewing the loan papers the family was appalled at the conditions of the loan. Payments are $2077.07 interest only. This was more than 50% of their income at the time. The $2501.55 P&I option was completely out of the question based on income. My mother’s passing has decreased my father’s income even more. As I understand legitimate loans have a 28% ratio to income. Who ever approved this loan did not even bother to ask for verification of their income (information verification is blank on the loan documents), nor did they take into consideration my parents were on a fixed income. Where did they think the money is going to come from once the payments jump to $2938.51?

Countrywide Home Loans had the house appraised at $642, 000 by an appraiser from their approved list (Landsafe which Countrywide owns). In going back over 10 years their home has never been worth more than $580, 000. In fact, when this loan was originated by Countrywide, in 2/06 the value of the home was approximately $540.000 NOT $642.00. Due to the drop in real estate prices its value is now at approximately $405.00 with prices expected to drop 21% in the next year.

My father applied for a loan modification on 12/11/08 we were told that it would take about 45 days. We were also told to fax a letter to the office of the president. After no response I called the other day and they said he didn’t qualify for a modification because they had sold it to the Bank of NY. On another occasion I talked to a supervisor and told him that this loan was based on their good credit and no one EVEN VERIFIED their income. The supervisor told me they weren’t responsible for misinformation on the loan papers, or the fraudulent appraisal (done by Landsafe – a company they own) as that was the broker’s part (there is no broker listed on the loan documents). I was also told by Countrywide, another time there was no broker…different stories different times. The supervisor said nothing could be done because he isn’t delinquent and his payment doesn’t jump until 2013 so call back then.

The other option they gave me is to try to refinance. There is a prepayment penalty which even if my father (who has great credit) wanted to refinance, it would cost him approximately another $10, 000.00. More money for Countrywide?? He has paid over $70, 000 in interest plus close to $10, 000 in closing costs, not a cent coming off of the principle. The loan balance is $390, 000.00., As you can see by the info……they were totally ripped off.

My Father is 86 years old a retired veteran of WW11. He has lived his life with up most decorum and has never even received a parking ticket. He has worked all his life to have a decent retirement. At this point in his life I feel he should be able to live out his life (which his family has a history of longevity) without having to deal with the “disgusting” conditions of this loan.

At this time my father is going to have to claim bankruptcy just to survive. This loan is causing him extreme hardship both emotional and financial. This loan was not above board and given to them by an unethical loan person who decided an elderly couple would be a good target to make a great commission. I hope this person can sleep at night. I consider this whole situation elder abuse.

refusal to work to keep our home
this may sound like the same sad story but true, my husband was in a major care accident in Dec (NOT HIS FAULT) This was 1 of 3 this one took everything including our home, when Countrywide was called in December since we had no savings (I called right away so we could work something out our mortgage was 3100.00 mo.) Countrywide was so rude to me, each month I would call asking for help of some sort to drop our payments they asked what we could afford I told them 2000.00 that was not good enough...as the months went on the calls got worse to the point I was crying and upset, my blood pressure went up so high (I DO NOT HAVE HIGH BLOOD PRESSURE) I could not believe the way I was being treated like a criminal...Our credit was perfect after all, our home was 400.0000.00. The bad thing is I would call them to resolve this they would tell me wer'e taking your house, you need to move, then they stated we abandonned the house, we were there until the end, they changed the locks the day after court which we did not go...The house is now listed at 207, 000 we now got 1099A'd foe FMV of 320, 000. what a joke...Stay far away from Countrywide, we had this bank for 11 years and still did n ot mean a t hing that we were never late, , , , EVER. Thanks for reading, I sure hope nobody else gets treated so poorly, WHY DO WE WORK SO HARD...for what to lose everything and get NO HELP.

using bad credit to give loans
We tried for a regular home loan in 2007 and was turned down to having low credit scores and a bankruptcy as well. Then we were contacted by Challenge Financial a broker for Countrywide and was told they could get us a VA loan no problem. We filed the paper work and were turned down the first time cause we didn't have enough income. Then they called back and was told if we could use my husbands overtime and my income combined it would be ok. My husbands boss at the time even signed a form stating that they could use it. We later found out they even used my husbands previous employement as income as well. Anyway, Challenge Financial called the realtor and they Supposedly sent out a VA inspector and the inspector was supposed to go by the VA's rules and regulations. It needed some repairs including having a new roof replaced and the basement possibly having drains put in it cause there was standing water at the time of inspection. The repairs to the roof was done, and the old out building was tore down and was to be hauled away, that is what was stated in the receipt from the contracors, however they shoved it over out hill for us to later haul away, and the basement was never fixed. The roof leaked right after we moved in and destroyed our ceiling tile as well. We were also told that we didn't need an inspection of our own cause the VA was very tidy on their inspection and would find faults to be fixed. Well in the mean time, my husband lost hours and overtime. Then eventually his job and I lost mine the same year. We are both working now, however our income is alot less then before, we have contacted CW on this and all they want to do is raise the payment. We've even asked to extend the loan to 50 years instead of 30 and they won't do it. We've contacted WV attorney general and they only helped people with balloon payments, not people like us. No lawyers will help either for they say it's a waste of time. Since this has all happened, we found out that our plumbing isn't hooked up to our septic tank, it runs down over the hill and when it backs up, it goes into our basement floor. We also found asbestos tape on our furnace vents and was told that is totally normal and at the time of inspection, noone was trained for that type of thing. We have no record of any inspector other then a form stating what needed done and I believe that was done by the appraiser only, not a VA inspector like we were told in the beginning. The realtor has since left and can't be found to explain why we weren't told of these things as well. The house was in the same family for years since 1938 and never changed hands till we bought it in 2007. We have even contacted the VA and no help there was told to sell despite with all these repairs and having to have the asbestos removed first the home might sell for 20000 and the loan was for 160000. There doesn't seem to be anyone out there to help with any of this at this time and we are going to foreclosure I'm sure. I thought they were supposed to do all remodifications for homeowners who were behind no matter what, but we were told recently we didn't make enough money despite, we had 300 dollars left after everything is paid. They also use a credit card as a payment despite we don't have credit cards and an old phone bill despite we don't pay it either. They figure it in on our monthly bills. I'm not sure how this is fair to us or to anyone. I just wish I could find help and save my home from these people. They won't get what they want out of it and noone will buy it with the repairs it needs.

If you want to keep your home, if you want to put a stop to the criminal activities by this compay, then it's time to DECLARE WAR ON COUNTRYWIDE HOME LOANS NOW!!! Contact your congresspeople, the President, every homeowner's advocate you can. the FTC and the FBI, HUD, and, if possible, an attorney, and write them again and again. If we act en masse, we can bring down these creeps and put them where they belong - IN PRISON!

I apologize for the length of this, but I think you will find it good reading, but don't just read it. TAKE ACTION!! The home you save may be your own!!

You must understand that YOU are NOT their customer, the lending companies and investors are their customers. Part of what they do (which comes from mortgagetrap.org) to steal people's homes and much of which is happening to me now is this:

When the servicer pays your property taxes late, the adds their late penalty to your account without your knowledge.

Any or all of these processes result in at least one month of the account being past due and a negative note is made in the credit report (which effectively prevents the borrower from refinancing). "

I pray that you will withdraw any and all bailout money from Countrywide Home Loans and allow them to die, as they continue their abusive behavior toward borrowers. They are not using the bailout funds for the purpose intended, in fact they are attempting to steal people's homes rather than keep people in their homes. Below is my story.

SECOND LETTER

I sincerely hope you can understand my anger, fear, frustration, and
confusion at the situation I face as detailed below. I apologize for
the length of this. Please read the bottom as well. Thank you.

I received a voicemail from Countrywide this morning asking for a
return call. I am very leery of doing this without a third party
involved to make sure we are ALL on the same page, and for good reason.
Whatever is going on with the accounting at Countrywide makes zero
sense to me. First of all, just a month ago, the system showed me well
ahead on my payments, and papers to put me in a lower interest fixed
rate loan were on their way soI was told by a CSR. But this week, I get
a notice of intent to accelerate letter from CW telling me my loan is
in serious default and that I owe now for December, January and now
February. So what you are telling me is I have missed THREE
payments???? Or more???? That is absolutely NOT true. Furthermore, your
letter of intent to accelerate mentioned "other fees" I may owe but
said NOTHING about what those fees were nor how much. So how exactly am
I to tell where I stand with CW??? What do I owe, why do I owe it and
when??? I have no idea what to believe or that whatever is told to me
is correct or not.

I never ever received any letter stating I was behind, no calls or
anything else indicating there was any problem with my account. In
fact, I had a good relationship with the Countrywide CSRs and found
them cordial and at least appearing to be helpful.

I would like to again have a good relationship with Countrywide, as I
did for a couple years...but I cannot be blindsided by this sort of
thing. I need to know.

I did hear from Lori with the MO Attorny General's Office, and thank
her for her help. Hopefully this can be straightened out. I know I
cannot do it alone.

As I said before. I am sure there are many very fine people who work at
Countrywide who care about their jobs. But there appears too to be some
who either don't know what their doing or don't care, regardless of the
people whose lives are unneccesarily ruined by their unwillingness to
do their jobs.

I am not trying to be a jerk here, I'm really not. I just love my home
and wish to keep it, and it makes no sense to lose it just because
someone isn't doing their job right or intentionally manipulating the
system.

I'd like to get this straightened out as soon as possible. Thank you

Countrywide admits to LYING!


To Countrywide,

Just a month ago, according to your system, I had no payment due to you
until March of 2009 (as a result of a loan modification and advance
payments made by me), and you were supposedly in the process of moving
me into a low interest fixed rate loan. So imagine my surprise when I
got a letter from you tonight of an intent on your part to ACCELERATE
my loan, DOUBLING MY PAYMENT AND charging me late fees!!! How can you
charge late fees on payments not even due?????? Could someone there
explain to me exactly what the heck is going on???? You don't even have
a representative available after 5:15 PM Central Time!!

Further, your website says you have not received a payment from me
since 10/31/08. That is completely untrue!! In spite of the fact that
you showed me three months ahead on my payments, I still made payments
faithfully, only skipping last month after your CSR told me my payments
were not being applied to my balance, but put in a holding account
while the loan workout was going on. He explained I might as well wait
since the package - which never came - was to be sent out shortly.

So would someone please explain to me exactly what your intention is
regarding my loan????? Do you want to foreclose so you can sell my
house and keep my equity, is that what this is all about? Since this
isn't the first time you've done this sort of thing - such as holding
payments late so you could charge a late fee, for example - what
exactly is your endgame here? Well I will tell you what mine is. This
is my home. I love my home, and have done absolutely nothing to deserve
losing it just because someone at your company, whether they be
completely incompetant or unbelievably evil or not giving a rat's
behind about their job or the people it affects, cannot or will not do
their jobs right. I have every intention of keeping my home - and I
WILL KEEP MY HOME - NO MATTER WHAT IT TAKES! If that means my cold,
