Countrywide ignorance
My mother has recently for the first time in her life had some recent financial dificulties. She purchased a new home over three years ago and has always had Countrywide as her leander. At the time her loan was taken out, her weekely salary that she cleared was $1.076.85 per week. She know currently make $1, 298.47 per week after taxes. She is still current with her mortgauge but knew she would be short for her October payment. She called Countrywide with me sitting with her in her home office. She reached a rep and informed her of her situation. The rep said she would note the account and they might be able to help. She told my mother she would need all her finacial info and that she might be able to defer the payments until January 2009. After giving the rep all her info, my mother was informed they could not help her. When we asked why, Country wide explained taht she did not make enough money to make good on the payments in the future. She said this decision was based soley on her monthy income.
I could not belive the ignorant statement that was comming for the reps mouth. She now earns $225.00 per week clear more than she did when the loan was taken out. This is still the orginal loan, nothing has changed. We then asked the rep, if she didn't make enough money why was the loan ever approved in the first palce?. She could not answear that question and simply said the policies may have been differnet before she was with the company.
It makes me think. Why was the loan approved if she didnt qualify for the income? No one at Countrywide can answear that question! She also recived one of those letters stating that a Countrywide employee stole her personal information.
Countrywide is a very unorganized, unknowledgeable, and ignorant company. I hope they get whats comming to them!

Overcharged
Countrywide is raising millions by charging fees for refinancing your home and they have no intention of closing the deal. During the appraisal, they will so under value your property you will be in a reverse mortgage situation. Most will seek other mortgage companies or bank, however you will be out hundreds of dollars. Fees for running your credit, paperwork, and the appraisal fee. DON'T WAIST YOUR TIME. Go to another bank to refinance. Countrywide rates and fee will always be higher. And there customer service is terrible. The agents do not return your calls nor do they inform you on possible lower rates. Due to the financial troubles on Wall Street, they have no intention on giving you a good deal. They are only in this to make money off of you. They do not have your best interest in mind.

Terrible experience
I would like to know if the following occurred to any customers of countrywide home loans beside myself. I have (two) Mortgages with countrywide home loans and have then now for 2.5 years. I noticed that in July I did not receive a statement from countrywide for my first mortgage. I got the statement for the second mortgages as usual.
They said they will send one out to me soon. Ok, I waited nothing. Now August 2008 comes in and no first mortgage statement again. Yet for August I received the second as usual. I called Countrywide in August again and expressed to them my concern not receiving the statement for my first mortgage.
Here is what I was told...
We blocked your account because we sent a duplicate and it was returned to us. It was sent back to countrywide stating "WRONG ADDRESS" I said wow that is strange because that has never happened before. So I spoke to a Supervisor to see what can be done since this incident occurred twice already. (July and August 2008 Statements)
I explained to countrywide that I have a 2nd mortgage with them and to verify the address and they will see that everything is the same and I am still living in the home that was purchased.
To their surprise the second loan and first loan had EXACTLY THE SAME ADDRESS! They said why do not know why you are not getting your not getting your 1st mortgage statement. I told them I am going to file a compliant with the post office because tampering with someone mail is a federal offense and I told them that.
My local post office could not understand why this was happening and took the necessary steps to assist me. My calls continued to countrywide and still they were not able to give me any duplicate statements or tell me why my statements have not arrived. I continued pressing them and still nothing.
Now, to my surprise I get the statement that needs to be paid in October 1, 2008. IF ANYONE HAS ENCOUNTERED THIS SITUATION PLEASE MAKE COMMENTS. MAYBE WE HAVE A CLASS ACTION LAWSUIT.
Please, be aware that now October 1, 2008, there is the new housing bill that was signed by the president of the USA in order to assist struggling homeowners.

Scam and cheating
On September 6, 2008 we were notified by Countrywide Home Loans that a former employee breached information on many of Countrywide's customers to a third party. My question is WHAT exactly, besides giving us two years free credit monitoring, is Countrywide going to do about this? This can potentially ruin many of Countrywide's customer's lives, and they think that two years of credit monitoring will suffice?? The thieves will just be warming up!!
Do we, as consumers, after surviving the mortgage crisis, how have to just 'put-up' with this? How would the 'fat-cat' executives at Countrywide like their personal information breached? You spend a lifetime working on your good credit, and good name, only to have it breached, just like that? Where is a company's personal responsibility?
And, why don't we get specific information on who the thief is, & the ongoing investigation. Maybe some of us affected would like to see that these people pay for their crimes. And, what is the District Attorney doing for us? Not just for the state, but for us? Can we get a lawsuit together, so that we can oversee our needs? Certainly, due to this injustice, many of us will pay for this, many years to come. Countrywide, and the District Attorney's office overseeing this case should contact each and every one of us, in writing, expressing our rights... not just giving us two measley years credit monitoring. As our District Attorney, we DEMAND that you send us information on our rights. Where is your responsibility to us? We should band-together, because who knows who now has YOUR personal information, and WHAT they will do with it. We should be compensated for this breach of trust!!!

Bad service
Countrywide Home Loan's Full Spectrum Lending division is a disgrace to an increasingly disgusting mortgage business.
Last April, my wife and I decided to refinance our home. So, we made a few calls and settled on Countrywide's Full Spectrum Lending because we liked the agent we dealt with. His name was John Donaghue, and he suggested getting an interest only loan because we were only staying in our house another year or two and we wouldn't be paying off much principal balance anyway. This way we could save more money. I checked into it, and he was right - the money we could save by paying off an interest only payment was dramatically higher than the money we could save paying off a 30-year fixed.
So, we went with it. John Donaghue was able to lower our monthly payment by an astonishing $500 a month! We were so happy! So, we signed the paper work.
Imagine my surprise four months later when we looked at our principal balance and it was FOUR THOUSAND DOLLARS MORE than what it was after refinancing.
Now, I admit, we did not thoroughly examine the contracts. And that is a mistake we will NEVER make again. Because if we had thoroughly read the contract, we would have seen that the reason our payment was so low was because John Donaghue roped us into a negative amoritization loan. Which basically means that we pay only PARTIAL interest and the rest of the interest is getting added to our principal balance every month.
So, we were saving $500 a month in payments, but $600 a month was being added to our principal balance! I admit, we should have picked that up when signing the contract, but shouldn't Mr. Donaghue have TOLD US THAT WHEN HE WAS TELLING US ABOUT THE DAMN CONTRACT?!?!?!? What kind of company allows their sales force to do that kind of crap?
So, we had to refinance again. We're back to where we started and have had to pay closing costs twice in the past year. Not good times.
I wish the story ended there. But, on Christmas Eve we found out that our new mortgage company (Allied Home Mortgage) had sold our mortgage to another firm. Take a wild guess who they sold it to!
You guessed it - COUNTRYWIDE!
So, now we're dealing with this deceitful company again and we have no recourse, but to bend over and take it from them. (Not unless we want to refinance yet again)
To make a long story short, Countrywide Home Loans and Full Spectrum Lending are two companies that you should avoid at all costs.

Illegal/unethical practices, predatory lending
First, let me say that Countrywide's criminal and unethical practices need to be stopped and all of us that have mortgages with them need to be compensated for damages. We also, have been financially damaged by them. To name a few, they did a classic bait and switch to our refinance loan; we were promised in writing a credit come back loan, yet we found out after the fact that they locked us into a sub prime 2 year hybrid libor adjustable rate loan, they falsified information on documents, did not provide us with a copy of a good faith estimate and truth in lending prior to closing, several inconsistencies between the loan application and the final documents, dragging the refinance over a 4 month period despite me providing all the documentation that they require at the first visit, pulling 4 "hard" credit reports as a result of their dragging their feet, lost payment. They also verbally promised us that we could refinance to a better loan at a fixed rate 6 months from refinancing. We received harassing phone calls several times during the day and night, even on Sunday mornings saying that we were late on payments despite me holding copies of my receipts and canceled checks written out to them. And the list goes on...
I refused to tolerate their abuse and took matters into my own hands when customer service started to give me the run around. I filed complaints and sent in all the required documents with the Office of the President (Countrywide), Federal Trade Commission, New Mexico State Attorney General Office, and the New Mexico State Licensing and Regulation for Financial Institution's departments. I also went personally to see CEO of my local credit union and also with the mortgage specialist at my local bank with all my documents to see about refinancing with them and bring my loan local.
Something that is not made public is that magical number (972) 608-2434/(800) 669-6020 ext. 6441 to the office of the president. I raised hell and demanded to speak to the CEO. Of course he's always busy, so I was passed off to one of the first vice-presidents. He told me that either he would try to get help for me through the Work-Out program, or try to refinance. Because this process is taking too long to resolve, it prompted me to file complaints with the other agencies.
I have not heard back from the FTC to date. When I spoke with the NMAg, they were very interested in my complaint and stated that they have received several complaints against several lending institutions regarding predatory practices. I was dissatisfied with the response from the regulations department and was advised from the NMAg's office to send in an amended complaint to the licensing department with additional documents. I was referred to a couple of law firms in Santa Fe from a friend that is a prosecutor. Both law firms wanted to take the case, however, they required a $4500.00 retainer. I had to pass it up since I cannot provide the retainer due to financial setbacks recently.
The CEO and mortgage specialist at my credit union and bank both reviewed all my documents. They advised me that they are not lawyers and cannot give legal advise. However, they showed me several inconsistencies and evidence of predatory lending that are violations of lending laws on my documents. I am forever grateful for these two individuals that are helping me out of this mess.
If I were you, do the following:
1. Go to your bank and/or credit union and let a mortgage specialist review your documents to look for inconsistencies and violations.
2. File a complaints with the following: your state AG's office; your state regulation licensing office; Countrywide's Office of the President, Janis Allen, 6400 Legacy Drive PTX-320, Plano, TX 75024; the FTC; and other pertinent agencies.
3. If you type in the Google search engine "Countrywide complaints, lawsuits, " etc, you will see that there are several states such as California, Florida, New York, Illinois, Virginia, that their AG has filed class action lawsuits. See if there is one in your state and if so, get in contact with the law firm that is doing it.
I hope this helps.
