Colorado Springs Co I answered an add on rentclicks which stated "RENT TO OWN OR YOUR MONEY BACK". The add was for the Delmor Investment Group. My wife and I met with Colm McCormack at 3311 Pensylvania Ave to look at the house. After Colm avised us that is was rent to own with a 100% money back garuntee we decided that we would likt to try and get into that house. We filled out the credit app and Colm called us a day later and said that we were approved and that if we wanted the house that he would stop advertising it. We signed paperwork on the 18th of January 2006 hoping to move in on the 10th of Febuary 2006. As we went over the rental agreement we were advised that the 100% money back garuntee was a hoax. We were told that we only get our money back if we make all of our lease payments and we didn't qualify to buy the home, or if we cleaned up our credit and we didn't qualify to buy the home, but Colm and his mortgage broker were certain that we would be able to qualify at the end of the two year lease. Our agreement was that we would put down $5000 towards the purchase of the house($1000 up front, another $2000 plus the first month rent by move in, and the remaining $2000 at $500 amonth for the next 4 months). I was planning on using my tax return as part of the original $3000. Then I was informed by the IRS that I wouldn't be recieving my tax refund. I advised Colm of this and he said that he would work with me. I had told him several times that I would have to wait until the 10th of March to move in. Then I started getting calls From Colm telling me that I needed to put the utilities in my name weeks before I was originally scheduled to move in. I kept Telling him that we were not able to move in yet but he kept pushing so I told him that I would try and borrow the money. Colm kept setting appointments with me to move in weeks before I told him I would be able to. He kept telling me that he was in trouble with his boss because we were not in the house and kept asking me if we still wanted it and I kept telling him yes. On February 25th Colm called me and left a recorded message on my phone (that I still have saved) telling me that he was still getting calls on the house ( the house that he told us he had stopped advertising) and was going to put someone else in the house and that I wouldn't get my money back. Now since Colm McCormack and Delmor Investment Group defaulted by backing out of the deal I would like my money back. I feel that this can be resolved by Delmor Investment Group refunding my $1000 deposit. If not I am prepared to take further action by contacting the Real Estate board, the Channel 11 News, ( I have already contacted Channel 13, and now the BBB) and taking legal action with an attorney. If I recieve my money by 3-9-06 then I will drop my complaint and consider it resolved. If not, then I will take further action. Any help from you resolving this matter would be greatly appreciated.
