Unathorized ACH Charge of $500 to bank account
This company(DSH also known as Qaulity Homes) is a factory that sells manufactured homes online. They offer them slightly cheaper than going to a manufactured home retailer. I talked with the salesman from there back in April 2007. I was told there was a $2500 deposit for the home to be built. In August of 2007 another salesman called me back and told me that they would build the home with only $500 down. I agreed to the $500 down and had to fax them a completed ACH form with my bank account routing number and account number. I had no problem with this until they changed the original date it was supposed to be taken out. They did not call me to tell me they were doing this. Since I live on disability income, the ACH that they put thru too early caused my account to be in the negative for $400. I called them and told them that they changed the date on the original form and bounced my account like a rubber ball, this also caused the bank to charge me fees. I called and spoke with their supervisor, who said he would put the $500 back into my account. The bank still charged me a NSF fee, which I told them they would have to reimburse to me on top of the $500. They only put the $500 back into my account. Now it's December 2007 and I checked on my bank account and discovered they took $500 ACH debit from my bank account without me being aware of it. I called them and they said I was overpaid. They did not send me any letters of the overpayment nor did they contact me concerning it. They just helped themselves to my money and having to live on a budget and pay my bills this once again sent my account into the negative plus the bank is charging their fees. I did not do business with this company after they changed the date on the paperwork I faxed them, I felt they were a shady company and told the supervisor to cancel the paperwork and destroy my bank information as I decided not to purchase a home from them, since the supervisor told me that I still needed to put down $2000 more to equal $2500 down payment. I told him I could not afford the down payment and that I would NOT be purchasing from them. Of course, they did not destroy my bank information as requested. I called my bank immediately and they told me the charges were pending and I cannot do any thing about it until it clears, then I can file a dispute. Banks need to change their procedures and notify their customers when a large ACH debit is being taken from their account to see if it's been authorized or not. Now I am at the mercy of the bank and how long it will take them before the funds return to my account. In the meantime I am being charged a lot of fees for returned checks and NSF fees. I would've appreciated being notified by DSH in writing or by phone concerning any overpayments that they felt happened in error. I called the supervisor today to ask him why I wasn't notified of this error sooner and they lied about the whole thing saying I authorized the charge. I believe they used the old ACH and got my routing and bank account numbers and helped themselves to what they believed was an overpayment.
