Scammers and liars
We had a perfect record of paying all of our obligations to DirecTV on time for all four years of service. We did not knowingly enter into any contract or agreement with DirecTV other than our monthly service subscription which began in 2003. They are now billing us $125 for terminating our 4 years of service.
We Listed our Placer County home for sale in June, 2007, fully furnished including TV sets and the DirecTV satellite dish and equipment (which belonged to us). The home sale closed in August, 2007. We asked DirecTV to terminate our service effective the end of August, which they did. We paid for all billed services to the date of termination.
The buyer of the home resumed DirecTV service after close of escrow with a simple phone call to DirecTV. So there was almost no DirecTV service break to the address.
DirecTV has since billed us $125 as a penalty fee for terminating our service. They assert that we had entered into a long-term contract with them in July (after we had already listed the house for sale) and that we were breaking that contract. We did not knowingly enter into any kind of contract or agreement and obviously would not when anticipating the sale of our house. We did, however, accept "Your Complimentary Gift" (their words) of $5 off the monthly fee for 12 months. We realized a total of $5 saving on our August bill. The "Gift" was offered to us as a reward for being a loyal customer for 4 years and we believed also because Dish TV was campaigning in our neighborhood to capture DirecTV business. There were no evident conditions attached to the "gift".
We moved to a sparsely furnished one-bedroom apartment with no TV set where we lived for 2 months. We had no need for TV or TV services, as family medical emergencies (which prompted selling our home and moving, in the first place) took all of our time.
DirecTV has repeatedly billed us for the $125 penalty even though we offered to repay the only $5 saving we did realize as a result of "Your Complimentary Gift". DirecTV has turned our account over to a collection agency and both have threatened to "ruin" and "negatively affect" our perfect credit rating.
We believe that the $125 penalty is unreasonable, unethical, unfair, and based on a misleading offer of "Your Complimentary Gift" (quoting DirecTV). There were no conditions specified with their offer.
We have corresponded and telephoned both DirecTV and the collection agency. They have simply repeated their assertion that we have breached a contract and we owe them $125 or they will destroy our credit rating.
We are seeking help from consumer fraud agencies to intercede on our behalf, end DirecTV's unethical and misleading consumer practices, end the DirecTV and collection agency letters, and help us maintain the perfect credit record that we have enjoyed for my entire life (75 years).
We currently reside in El Dorado County.

Terrible company
On February 11, 2005 I had DirecTV installed in my home. I agreed upon and signed 1 year contract for programming. Within 60 days, I began having service issues with the equipment. DirecTV would attempt to repair issues over phone, but would not be able to do so. They sent me new equipment each time. AFTER receiving and installing these receivers, I would get a letter stating that accepting new equipment obligated me to new 1 year contract. I contacted the company with names of people I had spoken to, but they still would not remove new obligation from my account. I believe this practice of supplying replacement equipment for the defective ones they supplieds to begin with is fraudulent. After servicing one unit that I had for a short time, they attempted to charge me for the service call. After contacting them, they agreed to waive fee if I signed up for monthly protection plan. When I received plan in the mail, it stated that I was obligated to keep that for a 1 year period also. No employee has ever told me about any contract extentions when I have called. At this rate, I will never be able to discontinue their service, because I was warned that if I did, I would be charged a hefty cancellation fee for breach of contract. But I believe they breached the contract when they could not provide me with a reliable service, then by misleading practices. Over-Charging Debit card
Cancelled DirecTv due to poor customer service, poor quality, and poor buisness parctices EVEN THOUGH I knew the cancellation fee would be THREE HUNDRED DOLLARS PLUS.
Making monthly payments on the cancelation fee, I called and authorized DirecTv to charge 40 dollars to my debit card. The following morning I had a charge for 180 dollars to my account.
When I called DirecTV to to complain, the first call I was hung up on, the second call I was told a supervisor was unavailable and there was nothing they could do as I had authorized the paymant, when I asked for copies of the recoreded phone conversation they said they had none, the third call said it would take between 8-16 buisness days to refund the 140.00.
DirecTv is essentially stealing, as they were only authorized 40 dollars. I have filed a complaint with the BBB.

Sales/time commitment
While inquiring about an upgrade in service, a DirecTV telephone representative confirmed that there would be no renewed two year time commitment attached to an account if there was to be a service upgrade to that account. Acceptance of the upgrade hinged on the fact that there would be no renewed two year time commitment.
After installation, DirecTV did establish a renewed two year time commitment that cannot, it seems, be removed. Even if there was a timely return of the items/services purchased, the time commitment will not, it seems, be removed.
This is a most unethical, deceptive and deceiptful practice.

How to beat DirecTV's Early Termination Fee
Like the several other thousand of you on here, I was charged an early termination fee by DirecTV when I canceled their service. I had the service for 8 months, after being told when I joined there was no contract. When I quit, they charged me $200, saying I had an 18 month term agreement. I'll spare you all the details of how I fought on the phone with them and their so-called managers over this, and just tell you how to resolve it. I filed a complaint with the Better Business Bureau, which I also encourage all of you to do. Granted it got me no resolution, DirecTV still refused to refund my money, but if enough people file with them, eventually they will have no choice but to take a look at it. It only takes a couple minutes filling out a form on the BBB website. At this point, I filed online at my Attorney General's website. Again, nothing came of it, but it can only help if we pile on the complaints.
So then I filed a small claims court case at my local district court. It only cost like $30 to file. A week before our court date, I received a call from DirecTV's legal department, she was nice as could be. She actually asked ME if I would be willing to dismiss the case if they refunded my $200 early termination fee. She also said they would reimburse me $40 for my court costs. My money has been refunded, and now my nightmare with this horrible company is over.
I encourage ALL of you having similar problems with early termination fees or any other bogus charges they've nailed you with to do this as well. I did not have my credit card company reverse the charges, because DirecTV will send you to collections, and that's a whole other nightmare to deal with. Instead, just file a small claims case if you have a legitimate cause, and if they show up you will then likely win anyway, but chances are they will call you and settle up.
There are hundreds of thousands of people they are hitting with these bogus fees. If even a fraction of a % actually call them on it in a court case, it is not worth their time and trouble to try to fight it, they will gladly refund your money as they are making millions of dollars on those people who just do nothing. Don't be one of those people, fight this company back!!

unauthorized draft
Long story short Directv took $1300 out of my checking account for early termination fee plus cost of receivers. The service was not being canceled.I was then told it would take up to 30 days to get my refund of which they did not process correctly twice. After getting tired of talking to a call center of which all of their customer service centers are, with people that can' t really do anything to help. I called the home office in El Segundo Ca and spoke with Helen @ 310-353-5000. She has my refund processed and should be returned in 1-2 business days. Much better than the 30 days I was originally told. Once I get my refund Directv will never have the opportunity to do this to me again, or anyone else that I know or can help. I will never have anything else from them again.

Billing
I am really pissed off with Directv. I owed the $183 which was my current bill, and one past due bill, and they automatically drafted $467 out of my checking acct. I call to get a refund of the difference which was like $267 because I moved, and no longer need the service. I requested my refund in May, and I've been lied to and pushed from customer service rep to customer service rep just to hear 10, 000 different excuses as to why I don't have my refund yet. These people are ripoffs. I need my money now to pay bills I currently have, my money is doing no good sitting in Directv when I don't even have service with them.

Bad Customer Service
One of my four receivers stopped working. I called to inform Directv.
They told me that they would gladly send a replacement, for a fee of 19.99 and a service agreement (which I never had for the previous 9 years) would be contingent. I was in total diagreement with this arrangement for several reasons, (which did'nt really matter much to them), so I decieded to discontinue my service immediately. The service rep assured me that my service was discontinued effective at midnight. that was four month ago and I am still receiving a bill for the service that I thought was discontinued. I put in a request again to day (after having to pay for the unwatched service, no receivers connected, and no refund for unwatched service.) FRANKLY I feel that they sent a signal to that box to blow it out so that I would have to receive a new one, so that they could place the service agreement. IF so I think that it's very poor marketing skills. All this is because I refused an upgrade on the old receivers. I heard somewhere " If It ain't BROKE, don't fix it.

money taken for recievers
I had directv for about 3 years and my contract had fulfilled. First they tryed to tell me that i still was under contract when i clearly wasnt when i tryed to cancel my service. When i finally got the account canceled they said that i must return the recievers in the boxes they provided. Simple enough i thought. first of all they were ask to deliver the boxes to my new address and of course didnt. I myself had to track down the return boxes to ship back the recievers. I called and notifyed directv that the boxes were being shiped after a big hassle of returning them and they debited my accout 330.00 for the recievers ne way. Finally apon arrival of my recievers they told me it could take up to 6-8 weeks to get my money refunded. I went thru the process of talkin to a manager and applied for a speedy return and was told it would take 10 days. I have called them 6 times now and spoke with a manager every time and they all assured me it would be 10 days...well sorry but 4 weeks is not 10 days!! i am going into week 5 and still no refund!! These people at directv only waste ur time take ur money and tell u lies to get u to leave them alone!! i even had two managers hang up on me!! People stay away from this satilite company!! They will find someway to get u!

Fraud
I had been a Directv customer for 6 years when I asked to be upgraded to a HD Receiver. They sent me a receiver. When I tried to connect the receiver a message popped up on the screen telling me to call customer service. When I did they informed me that I needed a new dish, so I scheduled an appointment
for a technician. The technician arrived and told me the new dish which was much larger didn't fit on my balcony in the city and didn't get "Line of Site", so I cancelled my account and returned the receiver. A month later I received a bill for $413.84. I called and they told me I broke the verbal (which is questionable legal practice anyway) contract because I didn't complete the 2 year service. I wrote them two letters and called them over 20 times, and every time they told me it was a valid charge. There were four or five representatives who told me that I shouldn't be charged, but they said they were powerless to do anything about it. One person who seemed to try very hard was a person by the name of David in "Retainment". His DirecTv employee number is #413235 (his manager is named Basil). HOW COULD IT BE A VALID CHARGE WHEN I WASN'T ABLE TO EVEN USE THE EQUIPMENT THEY PROVIDED ME AND BASED THE CONTRACT AROUND...
Now they have a collection agency calling me twice a day, and I am left helpless. I will probably get a bad mark on my personal credit report because I cannot in good conscience pay hard earned money to a company whose engaged in fraudulent practices.
UPDATE: After almost a year a collection agency is still bothering me up to twice a day trying to collect these unfounded charges. DO NOT DO BUSINESS WITH DIRECTV!
