defaulted school loans
My name is Colleen F. I am having a very hard time with DCS due to the fact that my school loan account was turned over to them. About 18 months ago, I became homeless with my family (3 daughters, son, and 2 wk old granddaughter). I was living shelter to shelter, and had no means of a steady address, and no money for a P.O. box.
In October 2009, I received a letter stating that my school loans had went into default, and they wanted to help me with a payment plan to get tham back on track. They gave me an option that I was unable to accept, and I explained the situation to them about becoming homeless, and until then, my loans we up to date and being deferred accordingly with my loan company.I also explained to her that I am unemployed and recieve only $240 a week, and that with rent, electric, gas, and other expenses with my children, I had not been able to make any payment plan, and that I usually file my taxes in Febuary, and that I aould make a large lump some payment at that time. She told me that that was NOT an option being that my social security number and name have been submitted to intercept my tax refund for the year 2010. I was upset and crying because my tax refund was my means of money to get through the first few months of the year, being I could barely make it on umemployment, and was not eligible for any assistance. The woman on the phone told me that it was not their problem, and that they coulod provide me with another option for hardship situations. I was then told that the only thing they could possibly do to help me was, make a payment plan of $292 a month, for approximately 9 months, and that my loans would POSSIBLY come off the tax offset hotline.
They continually call me and ask the same questions about the offer of $292 at the time of that particular phone call, and monthly payments of $292. I asked several times if I could mail in a little bit at a time, and the representitve continually tells me no, and that they bare going to document that I am aware of this debt, and refuse to make any payments.
If somebody could please help me, please let me know if it is possible to get the loans out of default, or of any other known options that are out there.

Miss leading actions/Misrepresentation
I received a letter from this company stating that I owed a delinquent debt from the State of Louisiana Department of revenue. The letter looked official enough so I call them and spoke with Alyssa @ ext 3710. I must admin that it did cross my mind that I could have messed up something on my taxes but then she explained that it was for Tax year 1999. This seemed od since I lived in Texas at from late '98-2000. When I told her as much, she said that they were going to file a levee against me in 2 days unless I paid the debt in full. She added that I would have 2 full years to dispute the claim, but I must first pay the debt. This all sounded a bit shady fo rI contacted the Louisiana Department of Revenue Collection Division.
Here is were things got interesting, they told me that the fees were from failure to file a tax return for the year 1999. I let them know that I was a Texas resident that year and she told me to simply provide proof of residency in Texas and all would be good. I expressed concern about DCS filling legal proceeding and she told me they had no legal right to. I called DCS back and explained this to Alyssa. She came up with a story about only dealing with computers and never talking on the phone with the people that hire them. Then she said that they are still filling legal action tomorrow. I must admit I lost my cool at that point.
When I settled down, I looked on the BBB's site for DCS and found 190 complaints. Make that 191 as of 30 minutes ago. They show an A rating somehow so I looked and it seams that when challenged, they tend to fold. Most scams do. I contacted the Louisiana Attorney General's office and am contemplating contacting the California Attorney General's office. If they file and legal proceeding against me, I will sue them, although I doubt it would matter much.
I do not understand how this is legal...

Taking Tax Refund
I don't understand how DCS still intercepts your tax refund after you have payment plans set up with them and pay diligently without fail! As hard as times are, why is it that NO ONE seems to care that services like this are putting the poor people in even worse shape!!! I could see if you didn't have a payment plan or wasn't paying like you should be but that's NOT the case.
What's REALLY wrong with this picture!!! Something has to be done!!!

Loan Collection
DIVERSIFIED COLLECTION SERVICES IS AN ABUSIVE SCAM COMPANY. They contacted me about an overdue student loan. Jen Decker told me my paycheck would be garnished this week unless I joined a repayment option/opportunity. I wanted to pay the loan more than I wanted my check garnished so I gave them allot of personal contact information. At the end of the call I was told they needed a $400 "deposit" to gain acceptance. The company that they say they got my loan from isn't correct and doesn't appear on google anywhere. When I asked for them to put the agreement in writing and I would sign and return it with a check they said they wouldn't mail a letter (even after stating they have made several attempts to mail me one, lie) and needed my checking account #. This loan has been in default for years. My address and phone # have not changed for 10 years. They said they got the loan a year ago but couldn't contact me. When I spoke with the manager HAILEY PERRY she told me she would not give me the contact information of the co. they got the loan from and urged me to give her my checking account # to be approved tonight or have my check garnished tomorrow. I told her I would contact the attorney general and the loan originator and get back to her. She was not happy, was harassing and abusive over the phone demanding my credit card or checking acct. # This is a nasty unethical business at best and should be avoided by all business and personal interests. Repeatedly calling wrong number
I just received my umpteenth call for someone named "Joshua Myers." I have no idea who this person is. At first it was non-stop calling from a Student Loan Company. Now it is from "Diversified, " but the guy calling wouldn't tell me what "Diversified" was, nor would he tell me why he wanted to talk to "Josh." I told him there was never a "Josh" here, never would be, I never knew any "Josh." I asked him how he got this number. "Josh gave it to us." I found the guy to be uncooperative, deceitful. He never gave up and still would not give me any information. I finally hung up. BTW, I told Student Loans to take his name off of my number (I do have a Student Loan, and I am on top of it).

Misleading informtaion/Unproffesional Service
I have been behind on school loans for a few years.I received a letters from Diversified Collection Services explaining i needed to set up payment arrangement sent me letters and called me repeatedly harassing me about paying them.They repeatedly called me until a employee named Bob Miller tricked me into agreeing $90 a month so my account wouldn't go into default to where the government would take my yearly income tax refund. I explained to them several times that the choices they were giving me to pay them were not under my standards and my ability to pay. I'm a single mother trying to pay my bills on time and they wouldn't understand that. They wanted too much money down which i could not afford to pay.I then recieved a letter from The U.S. Department Of Eduction stating to give them a call to work out the debt. I then spoke to an agent named Jose that was willing t0 help me out in my situation. He offered to send me a Financial Status Statement application to help me with a better plan to start paying my loans off directly to them and not the collection agency. He suggested that i call them and cancel any type of payment arrangement with them. I called diversified collection agency to cancel monthly payments and a very unfriendly agent named Tony Cardozo would not assist me to cancel payments. He was underestimating my intelligence and basically saying that i did not talk to the U.S. Department of Education.Well they were all lies and they were deceitful too. This is not a company to be trusted what so ever.

Harrassment
Diversified has contacted my dad who is very ill with cancer and continues to harrass him, my father-in-law and myself. They stated they would refinance my loan for $50 a month but upon receiving the papers, there was no mention of this and they stated they did not have to put that information on there and in the next sentence stated it was on there. They were asked to make all contacts by writing and they said they did not have to. I asked for the address to request them to stop calling and they told me to find it myself. So I did. And so the saga continues...

Explanation
I have read through all of the complaints regarding DCS and their alleged harassment and third party disclosure tactics. Please, learn the law, read it thoroughly. They can call you at work, that is perfectly ok and right for them to do. UNLESS, you tell them verbally or in writing that you can lose your job if they call again. They can call your family, neightbors, landlord, even the corner bar all in the hopes of getting you to call them. They cannot disclose your personal business, however the person they contact assumes it is a bill collector or looks it up on line that is not DCS' fault nor is it their disclosure. I see the nasty customer service comment all over the place in these blogs. One answer: they aren't customer service they are bill collectors, they don't have to be nice or accomadating. They do have to be respectful and give you full knowledge of what you are facing. That means when they tell you about the Treasury Tax Offset Program or Administrative Wage Garnishment, they aren't threatening you, they are informing you. BIG DIFFERENCE!! Also, look up every major collection agency in America, they ALL get sued because of misinformed debtor's becoming money hungry and thinking that the bill collector has done wrong. Nobody is perfect, i will admit that however most of these cases are settled not won, due to the money saved with settling not because they collection agency cannot win their case. Please again read the FDCPA and learn your state collection laws, most of you are highly misinformed.

Harrassment of Neighbors
Leah at 1-800-927-7667 x 3743 harrasses neighbors, family members, and threatens me to pay a debt that is not mine. I grew up in a town with three girls with the same exact name and now this person Leah feels that it is ok to call everyone in my hometown and now in my new neighborhood, because she happened to get someone that knew me. I don't know or care where the other two girls are with my same name, but if the harrassment doesn't stop I will get a lawyer and sue Diversified Collection Services and Leah.
