Class Action Lawsuit
I must admit, I was only slightly miffed at this company until I read all of your posts. Now I am royally PO'd. It seems that the practices of these people are highly unethical and boarderline illegal and need to be brought to the attention of the authorities and numorous other resources like the Better Business Bureau and the Attorney General.
My Story - Last summer I was placed in a loan with Drive Financial by an auto dealership without my consent. I signed a set of loan papers with the dealership the day I purchased the car and drove off with my new vehicle. I get a call two weeks later from the dealership stating they forgot to have me sign "a" piece of paper. So I go to the dealership in good faith and find out they have completely reworked all of the loan documents with a new lender (Drive) and I now have a higher interest rate and higher car payment each month. (Can you say kick back to the dealer?) Anyhow, I had already surrendered my other vehicle to the dealership at trade in, so I had no other choice but to sign the new documents, or literally be forced to walk home. The dealership stated that the prior lender had backed out of the loan, two weeks AFTER the original signing when they realized I'd gone through Chapter 13. The dealership left this little tidbit of information out when they called me back in to the office. Everyone I have spoken with who works in the auto industry says this is a lie. Once financing is in place, ITS IN PLACE!! A lender can't and won't back out of the loan agreement two weeks after the paperwork has been signed.
I am now six months into the loan and the calls are non stop from Drive. The latest my payments have ever been is by a few days and yet the calls are a daily thing! They began immediately after we signed the loan with them and have been a dialy thing (multiple times a day) ever since. Of course I ignore them because I don't have two hours a day to talk to an automated system. So now they have begun calling my mom and all of my other relatives numbers. As soon as I found this out, I went into terminator mode. This is now WAR!!
I have been a paralegal for over 15 years and I can smell a scammer from miles away and this company wreaks. I have taken this matter to one of the highest powered trial attorneys in Dallas and he agrees that his looks like a scam between the dealership and Drive. He told me it is not uncommon for the lender to give the dealership kickbacks for placing people into subprime loans (people that may not necessarily have to be subprime).
I am going to meet with the attorney later next week to discuss strategy and determine if he wants to pursue this case. At the very least this is fraud on the part of the car dealership and harrassment on the part of Drive. After I meet with the attorney and see if there is a chance to pursue a class action case against Drive, I will post what I find out and a contact number for you all to call if you want to join in the suit. If there is anything at all I can do about it, I don't plan on EVER letting these people take advantage of me or anyone else out there who is struggling.
Keep in mind, if you DO genuinely owe these people money and you ARE months behind on your payments then they do have the right to contact you and in some cases, repossess your vehicle. I am speaking more about the predatory lending, verbal abuse by the CSR's and harrassing phone calls to the workplace and family and friends AFTER they have been told not to call. Late payments and repossesion are other issues entirely that you will have to take up with legal counsel on your own. My issue is with predatory lending and abuse of the client/banker relationship.
This kind of predatory lending needs to be stopped especially when it is being forced on you without your knowledge or consent! This is EXACTLY what got our country into the mess that it is in now. In the interim I would strongly encourage each and every one of you to keep a log of the calls that come in with date and time. If at all possible, record your conversations with these people and then file a complaint with the Better Business Bureau and the State Attorney Generals Office regarding the harrassing phone calls at work and to your family and friends. It is not legal for them to call these places once you have informed them not to. Write a letter to Drive, outlining the numbers they are NOT allowed to contact, and send it certified, return receipt mail so you have proof that you told them in writing to stop. You will HAVE to have this if you decide to file a lawsuit.

This should be illegal!!!
I was 9 months prego with #3 driving a Monte Carlo. Well very long story short, we were desperate and needed a van. Geoff Roger Motor Company (A## hole) ripped me off selling me a van that he was selling for 10, 000 for 14, 000 and got me into a 24.99% loan for 4.5 years at 435.47/mo.!! Anyway, I have frequently been late in past 6 months. The people who call me, almost every one of them are the most ignorant lying idiots I have ever spoken to in my life!! They threatened this and that if I did not post date a check and I told them it was winter so I don't know from one day to next if my husband would be working in concrete and I am disabled and need surgery. So they got me to post date it with threats and my husband got laid off 3 days later. Funds were due to come out of my account 2 weeks later. They refused to cancel the EFT and a so called manager said he would only move it up a week for me. He lied, it came out on the original date and caused me all kinds of fees with my bank and on other bills. They talk to you like you are a piece of #### and are stealing their last piece of meat in their freezer at their home!!! They call and call even after arrangement has been made. They call every number you gave them, even if it is a prepaid cell phone that you use for work. They call all numbers back to back after being asked not to call one of them.
They overheard me while I thought they had me on hold telling my husband I felt like telling them to just come get the son of a beep. The man said ok we can do that, what colour is it blah blah and I said no, I am just trying to work with you guys and pay but I cannot pay what I don't have and if I had people to borrow from or other resources I would have used them.
Now, I give up. I called THEM and asked them to come and get van. They refuse! They said it could be 6 months preaching to me about my credit and what will happen. I already bought a 4x4 trailblazer at 330/mo for 2.5 years from insta credit auto mart! The van won't get me out of my country road and tranny is bad and tires are bald bc of alignment, and sometimes it don't start and I have 3 kids and I cannot have that happening. They want me to get someone to take over payments or something~!! Yeah right. The payoff right now is 11, 500 and the van in excellent condition is worth 8000 and it is no where near excellent condition and I have taken very good care of it for the 17 months I have had it!
All of this stuff put together just built up and built up, especially the way I am treated, and I choose to not deal with them and they can have it. I just know they are going to try and charge me 20, 000 before it is over AFTER they get the van for all I know. I just hope they don't garnish my family's wages. They had no business loaning 14, 000 on an 8, 000 vehicle in the first place, especially when come to find out it was a company vehicle with excessive miles on it and a wreck too! I should have done my homework and not jumped into the deal but I did so it is too late now. I should have looked them up on this site anyway.
I wish the people sitting at a desk harassing my family for money we already made arrangements about would get a real job and get on their knees and rub concrete all day like my husband or do any one of the jobs I used to do before my injury and then we can talk. I am not a piece of **** that don't pay my bills. But there is a way to go about getting money from people and their way will no longer work for me!!

harrassing me and not posting payment correctly
This company has repeatedly harrassed and threatened me. They have been rude and not willing to work with me. They lie about payments being made and continuely over charge. Can anyone help stop these actions?

Awful company
Like those filing reports against Drive Financial, at the time I purchased my car, I had less than stellar credit.
My husband had come home from Iraq and had medical problems which made him unable to work for more than a year. Previous to this we had a credit score over 700.
Needless to say, we needed a car and ended up being financed by Drive. What a nightmare! They engage in predatory lending practices, making loans for people they now have no choice and squeeze every dime they can out of them. They engage in harassment and deception.
We finally had cleaned up our credit and decided to refinance our car only to find out that the first two years we had made payments went strictly to interest. We had not paid any principal and owe basically what we purchased the car for after two years of payments. SO now we are stuck with a car that we can't trade in, sell otherwise get rid of!
When we called them to talk to them about it, they blocked our phone numbers and we had to make calls from other peoples phones, even to make payments! We can't contact them from our cell phones, or our home phone.
These people should be ashamed of taking advantage of people who are dire straights.
Not all people have bad credit by choice and preying on them is a shameful act!

Blood Suckers
I have had the most horrendous experience with this company in the history of financing companies. Last year, I needed to utilize Drive Financial to purchase a vehicle because my credit was less than stellar. Needless to say, had I known then what I know now, I would not have done it. Since the purchase, we have made all of our payments on time until the economy faltered last fall.
My DH and I are self employed in construction no less and frankly were doing extremely well up until the economy took a dump. When that happened and money became tight, I informed Drive Financial that I wanted to voluntarily surrender the vehicle so that I could rid myself of the car payment. What an idiot! I wanted to do the right thing!
Drive Financial has ignored ALL requests to allow me to retunr the vehicle. They have told me that I will continue to rack up late charges and interest on the account until they choose to come and get it. Subsequently, I will have to pay all of those late charges and finance charges and whatever else they decide to throw on top of it when the car is auctioned off.
The DH and I are well aware of the fact that we signed a contract and well aware of the fact that we will have to pay the difference of the auctioned vehicle. We will, if we can, pay those funds. I have never disputed that with Drive. In fact, I gladly told them that when the bill came, if we had the money, I would gladly pay them.
Their response is continually, there is nothing we can do about it because they are a finance company not a storage house. I said, let me take it to your storage house. They said no.
It’s blackmail, it’s fraud, it’s not right to not allow somebody to do the right thing! We want to help them get their money back in some fashion. Now it just feels like we’re being sucked dry by another company that will benefit from a stimulus package.
In the future, I will not use Drive Financial and I will not recommend them to anyone! I will tell anybody thinking of using them to run far and fast and find somebody else to finance their vehicle.

Harrassing Telephone Calls
This company constantly calls you when you are one day late. The calls continues even after you make payment arrangements with them. This company have called my home number, work number, mobile number, my wife's work number, and mobile number two to three times daily after we made payment arrangements with them until the date of the arrangement. In one instance, this went on for a period of three weeks.
I have been informed by a consumer advocate attorney that this know as beng "Harassment." If anyone have experience this type of harassment from this company, please email me with your contact information.

write off / never late
I purchased a car through Road loans in August 2008. The loan was quickly sold to Drive Financial. I have made payments on time since then. Yesterday I got an email notification from my credit monitoring service that a change had been made to my credit report. I checked it out and Drive Financial has written off my loan! The credit report states "written off/ never late". I tried calling Drive several times, and I get hung up on, or now one knows what is going on and they send me to a recording that gives me the name and number of the credit reporting agencies. I don't know what has happened to my loan.
Has this happened to anyone else?

Please file your complaints directly to the US Dept of Justice at : [email protected] < [email protected]>
And this agency will start an investigation.
You may also contact the State Attorney General of Texas and the US Postal Service Inspectors in Dallas.
If everyone here complains directly to the US DOJ they will take care of the problem.

Scam and cheating
I was Was with another financial service and some how drive financial ends up being the new financial service. i'm pretty up set because the keep lying and saying the have not received any of my payments and i have my bank statement prove that they getting the monies i sent.
Now some how I'm 14 days late with my payment when i sent them a payment 11/03/08 and 11/24/08 and another on the 30th november. which put me behind in my rent what I'm i to do?
Each time i got statements from my bank with a conformation numbers. oh yea just sent them a payment on the 5th of December 2008. there is no grace period nothing, give the people something to work with
Please somebody help! they can see how everything is happening with the people around the world it's like they don't care and always talking about picking up somebody car. i don't care any more i had stress so much i'm getting sick.

I became a customer of Drive Financial in December 2007. after making 11 payment (which I also paid over my required payment amount) I contacted Drive Financial to do a deferred payment due to financial hardship in this economy. I was told that I could not defer a payment until I was behind. I explain to them that I did not want to place my account in a negative standing so I was being proactive and just needed one month of deferred payments. I also explain to them that my electronic payment was sent out by my bank, and they would cancel the payment (since I called them before check tried to clear) so Drive Financial would just need not to send the check back. This way no fees would be charge to my account and everything would stay in good standing. Everyone was ready to work on this with the exception of DRIVE FINANCIAL. This company did not care that their customer who was being proactive in keeping her account in good standing needed assistance and help from them. I not only spoke with a customer service rep, but also with a supervisor who sounded like a record saying the same thing over and over again. No assistance just want to charge my account the extra fees.
I have paid off two cars before (NOT WITH DRIVE FINANCIAL) and I have NEVER received this poor customer service. Deferred payments are not just options when and account is past due, but in many financial companies it is away to help keep their customer's in good standing. I guess this company just don't care about their customers.
DON'T USE THIS COMPANY IF YOU HAVE OPTION AND ARE DOING YOUR RESEARCH IN ADVANCE!
