Stay away
We have an interest only loan with Wells Fargo. Our home has been 'under water' for the past two years and because of that we have been trying to get a loan modification. About a year ago we engaged EM Lynch Marketing and Associates of Scottsdale. The BBB shows that this is not the first complaint. We signed a contract with a money back guarantee for six months guaranteeing results in that period. After six months at their urging that they were very close to a result we signed another contract extending for an additional four months again with the money back guarantee. After four months, no reply from them and no call backs from our numerous calls to their office. Two months after the four month contract expired we drove down from Sedona to their office and asked to speak with their officer in charge of refunding our money. We got the run around from a junior associate and told them we would return in the afternoon and wanted to speak with David, the person with whom we had signed the contracts; which had been signed by Mr. Eric Lynch, Owner. David Vanoverberk was there in the afternoon and told us that he would have to speak with the owners but that he could get us our money back. To ensure us of is good faith he promised to call us weekly to keep us updated. He has not called us since then and because of that we filed a complaint with the BBB on 8/17/10. Interestingly enough, apparently at the same time EM Lynch had sent us a refusal on grounds that we had contacted the bank with which they were negotiating with; which, during the time of the contract, is patently untrue. After the contract extension expired in the first part of June, we did indeed contact Wells Fargo, but not until then, and began our own application for a Loan Modification; which by the way was unsuccessful. At this point our re-courses are this complaint, our continuing complaint filed with the BBB and the media; along with answering EM Lynch directly.
