Health spending account ESG republic is a payroll company employee leasing company. The employer I worked for used them for HR and employee leasing. I separated employment with my employer; I asked the HR dept (ESG) to suspend the deduction for my HSA. My last check they deducted 1900.00 for my HSA, and now they say I have forfeited the money because I needed to choose cobra, which I did. They claim the HSA box was not checked so they can’t process claims through the eflex account. (There was no health spending acount election.)They stated I have lost the money. Turns out ESG gets to keep any unused portion of the HSA, so in a 45 day period they 1) against my direction, deducted money from my HSA 2) Claim my COBRA account was not properly administered by them 3)through e-flexgroup denied medical bills that were submitted 4)Failed to return 1900.00 taken out of my chack and now claim it will be retained ESG Republic which I feel may be a theft of my funds. I have called over 17 times to correct this, they have not refunded the money.
Your Desired Resolution:
I feel taking $1900.00 out of my last paycheck and not returning it may be considered a theft of my funds. I want the claim paid or my funds returned. It must be illegal to take funds out of a employees paycheck for health spending account and not return it?
