bought item, but seller never sent item
My wide and I purchased this item, the mocha commercial 46000 btu patio propane heater in Dec 2010. The delivery date was to be around Dec, 27th 2010, about a week and a half or so from when we bought it. The day after we bought the heater, the time frame for delivery was to be sometime in late January 2011. We also noticed that their price went up from 179.00 to 379.00. We contacted the seller via email on Ebay and he quickly called us on our home phone. He said that if we wanted our money back, then we could get it. We said we would like to still have the heater. He said that he was going to contact the manufacturer and try to get one sooner for us. I said that was great. After this call, we left it and didnt think much about it for a a couple of weeks. We decided to go on Ebay to find out if the item had been shipped only to find out that etminds Ebay page had been changed and it now said that over ten were available and that the shipment date would be Jan. 21-27, 2011. We tried to contact the seller and he did not email us back. We waited and waited until we finally decided to pursue action via Ebay. It is now Feb. 2, 2011 and we now find out via our Ebay page that the seller wants to cancel the sale and refund us our money. I replied back to the seller and said that we just want our heater. The company responded and said that the heater was on backorder and wouldnt be available for a while. We of course asked why his Ebay selling page for this item said that they have over 50 available for immediate shipment. This sounds like the seller wanted to cancel our heater sale because we bought it for 179.00 and now he is selling them for 379.00. Of course etmind did not like this and instead of following the rules of the contract between the buyer and seller, he cancelled the order and put our money back into our paypal acct. By the way, we had started a complaint with Ebay and they were supposed to be looking into this matter. They said to give them 72 hours and then we would hear from them. We never did so we called them up and found out that the seller, etmind, had cancelled the order prematurely and closed the sale like it never happened. Ebay said that he has a strike against him now and that if he gets another one, he will be banned from selling on Ebay. The seller, etmind, completely defrauded us and I think that Ebay also defrauded us because of the contract that was broken by the seller. Who can protect the people that want to use Ebay from fraudulent sellers like etmind. Something has to be done about this. We are so upset. Of course, etmind is a big time seller with Ebay, so I bet that Ebay doesnt want to cause a problem with that comany or they will lose his business. Oh by the way, when you cancel an order like etmind did, the buyer cannot make a comment on his page for others to see. It is like nothing took place and that there are no unhappy people out there. This is crazy. We need to spread the word about these sellers on Ebay. Please help.
