Fraud Practices
Upon reading all about the Festiva scams on your website, we decided to add our input..
We also have been burned by this company last year and we feel while
complaining is a nice way to vent what about everyone teaming together to stop others from being taken.Regulations should apply to these practices and all the people we can
together to do so will help.We have stopped any monthly payments and we have told our credit card company to change our card numbers.We plan a trip within the next month
to this area and you can believe we will visit each and every establishment that promoted or supported this process right down to the Restraurants, Welcoming Centers and Tour agents who sell this crap.Letting this go on only allows them to legally steal from people so please consider emailing us at [email protected] Making their lives miserable
like they have ours will be a start.Also call the Attroney Generals Office of the State you
purchased the timeshare and Better Buisness Bureau's too.We are currently working with our credit card company to reverse some payment charges back to us.We do have more information please feel free to email. Thanks Dan & Ann

Misleading sales pitch
My husband and I were told that our points could be carried over an unlimited number of years. Tonight I called to carry over our points (again) to next year and was told I could not because the points had already been deferred once. I advised this was not what we were told during the sales pitch. All I was told is this is what is stated in the owner's guide and on the website. The only information I could readily find on the website said that points could be deferred to the following year by December 15th. We only get 2000 points every other year - that might get you a weekend at one of the resorts. We paid off the mortgage and we paid our first year maintenance fee on time and in full. I really regret getting this timeshare now.

Time Share Deposit
On November 17 I paid my maintenance fees online. I then called customer services to deposit my week with Interval International. The person I spoke to was unable to deposit my week. He said my switch from the Adventure Club, to a deeded week, had not been made with II, despite this change having been done 15 months earlier. He assured me he would take care of it and it would only take a day or two. Three days later, I called again, and it was not completed. Today, a week later, I called and spoke to someone else. I was told the issue was with Interval International, not Festiva. I called II, and the problem was Festiva. Another call to customer services at Festiva, and this time the person was able to deposit my week with II. However, when I checked online, the deposit was there, but it was a yellow week, rather than a red week for which I have a copy of my paid-off deed. Once again I called Festiva, and was told it will take 24-48 hours to correct the problem. We'll see.

Additional Reservation Charges
We bought with Festiva 3 years ago. I wanted to believe this company was "different" from other timeshare companies. However, in the last 3 years, more and more deception and misrepresentations have occurred to now I deeply regret buying my timeshare from them. First they convinced that we had to convert over to points or else lose the value we had originally purchased, we paid several thousand dollars more to not have the benefits we did before - unbelievably! We can now no longer deal directly with the location we purchased from to begin with, but rather are forced to deal with the Adventure Club (Festiva), who charge $89 every time you want to make a reservation (after the first call of the year). The whole sales pitch about benefits of points was to make those "last minute" calls and save point value... but if you have to pay for the call, you've lost your savings. I'm sick to think of how much I am paying for less benefits that we had originally (not to mention $300 more in maintenance fees - which they didn't tell us until we were just about to sign our name to the contract) - DO NOT BUY from these people - they are crooks.

Will not refund my money after they cancelled due to "overbooking"
We booked a week "festiva getaway" for the Peppertree Atlantic Beach. It was a promotion in which you had to take the time share tour by the second day of your arrival. We own a time share at a gold crown RCI resort in Hilton Head, so this was not a big hassle for us. However, Festiva contacted me 4 days before my planned vactaion(on tuesday afternoon), and stated that they had "accidentally overbooked". They wanted to have me to change weeks. I am unable to do that, as I have to preapare well in advance to arrange time off from my medical office. The next thing they wanted me to do is change resorts. However, they did not have anything to offer in the outer banks area. They could offer me orlando or a resort 3 miles from the beach in Myrtle Beach. This was not feasible for us, as we were traveling thru Raleigh to stop for family, and you cannot do that to go to either locations. Plus - I shouldnt have to go somewhere I have no desire to go just because they messed up!!!
I asked for a refund, and the man stated he would have to ask his supervisor. WHY do you need to ask supervisor to give me a refund on something their company is unable to provide? Anyway, he eventually said that this had been ok'ed, and he obtained by card info to apply the refund.
That was June 16th- 2 and a half weeks ago. I STILL HAVE NOT GOTTEN MY MONEY! Someone from the Asheville office - Jessie somebody - called me the following 2 days to say " they were trying to work something out and needed to discuss my refund" I have called him and left messages 6 times. Last week, I finally got to speak with someone else, and she said that I would have to speak with Jessie. I told her I had left him repeated messages and he would not call me back. She then said he would, and I asked when? She said I do not know. I then said, "will it be by the end of business day today?" and SHE HUNG UP ON ME!
I have called again today, and left more messages - this time for a Julia Shirley in the finance department.
This is absolutely ridiculous!!! I have contacted a lawyer, my local state representative, and the local news station of Asheville to run a story on this fradulent company. I have a long time friend that happens to work for this station, and he will put me in contact with the reporter that handles their "scam revealed"stories.
If I do not get my money back in the next few days, it is going to get VERY ugly.

False/misleading sales tactics/BBB
We own Festiva usage every other year (EOY)and after being pushed to change over to point system, we wanted to upgrade to "every year"(EY) BUT we requested to NOT upgrade if we couldn't get financing which THEY were going to arrange. They AGREED we could stay EOY and the sales guy wrote our OLD contract number on a form. Long story short, when we could NOT be finaced, they upgraded us to EY anyway. We had been disapproved the SAME day we were in the sales office. Now we have complained to BBB (we recommend this as well complaining to the State Attorney General of NC). They KNEW about the non-financing but didn't mention it. They told us other things which turned out to be lies --like you can "walk away"from this contract which actually meant you will be defaulted and ruin your credit!!). After stonewalling us for months(ignoring our "letter of dispute"), NOW they want to revert to us to EY, the old contract. They cannot be trusted. Watch those sales guys at Banner Elk!! DO NOT DO BUSINESS WITH THESE PEOPLE. MO attorney General took them to court and they were found guilty. Go Missouri; hope NC Attorney General follows suit!!! Do not buy timeshares unless you check the Internet FIRST!!! What a hassle!!!

Time Share
We were visiting downtown Charleston (we had just moved to the area). I went into a building titled "Welcome Center" though I thought I was going into the visitors center. I feel like Festiva misrepresented themselves by putting “Welcome Center” on their sign. Believe me, whenever I have a chance, I will sit outside their door and warn people of their misrepresentation. As well, I will be contacting the Charleston City Council and Better Business Bureau. Once in the Welcome Center, I was told that I could get 3 coupons for free attractions and 2 nights free stay at the Church Street Inn if I gave them $20 cash (refundable) and would just listen to what they had to say about their Inn. I thought it couldn’t hurt. So we did.
Once at the place we were directed to go to, we filled out some paperwork including information regarding our income (WARNING…if they ask your income…BEWARE). We were taken for a walk by a man named Matt Anderson and spent the next 2 hours under high pressure sales pitches. I wasn’t sure I wanted to purchase the timeshare until Matt told us of the website and vacation packages (I now know as Platinum Rewards). Once I saw the benefit of the Platinum Rewards and that I could get vacation packages to my hometown cheaper, I was sold. I mentioned this to Matt multiple times that this is what I was most interested in. In passing, Matt said we would get the first 2 years of the Platinum Rewards membership free with our timeshare purchase. He said a few other things and quietly he later said that there is a $79 a year fee to stay in the Platinum Rewards. When I looked at him about this, he said not to worry, we did not need to pay for it after the 2 years—all we would need to do is contact them and get the benefits of the vacations. AGAIN, WE SHOULD HAVE BEEN SKEPTICAL AND WALKED AWAY!
Matt and the old man working with him came and went over pricing. When they determined the overall cost, they played around with numbers and told us that we would get 4000 points on every even year and would get a discounted rate from $13, 000 down to $9, 400. AGAIN, WE SHOULD HAVE WALKED AWAY! And, they would throw in 4000 points for 2009. Once we had agreed upon this, Matt said, there was a maintenance fee of $650 to activate the 4000 points. AGAIN, WE SHOULD HAVE WALKED AWAY!
Finally, Matt said that we can sell our 4000 points and would make about $3, 600. When I asked him how we could do that, he said, “We will help you do that, just call me.” He gave me his phone number. At the completion of the transaction, Matt told me he would call me the next day to answer any questions.
After the purchase was done, I mentioned to Matt and the old man working with him that I was promised 2 free nights at the Inn. They looked at me like I had a 3rd head. I could tell by their non-verbals that they were not happy. I told them that it was written on the piece of paper given to me at the Welcome Center. They told me that they would have to call me about it later. I was uneasy then…I should have cancelled the whole thing then and there. Over the next 24 hours of purchasing the Festiva Timeshare, I continued feeling uneasy about everything.
I did not get a phone call the next day as promised. Two days later, I got a phone call. I SHOULD HAVE CANCELLED IT THEN!
Now that I have researched everything fully, guess what…I feel it was a rip off!!! In addition to paying $9, 400 for the timeshare, I must pay $650 for the 4000 points (every other year). Something they did not tell you is that whenever you make reservations you will be paying an $89 processing fee.
Remember the key to me buying this timeshare was the Platinum Rewards???!!! Well, guess what, you can purchase a lifetime member ship for $1, 499 now that will give you access to this program or you will be subject to paying $300 a year (if not more) for it once the 2 year free membership is over.
I have tried to call Matt (on the number he gave me), and apart from one time where he answered, he never returns my phone calls. The time he did answer, he acted disgusted and shocked that I called. I tried calling other times with no return calls. Today I called his number, the phone was answered, and then I was hung up on. When I tried again, I just got a voicemail and left a message. I tried calling the office at 843-853-5029, and never get an answer.
DO NOT BUY INTO FESTIVA!!! IT IS NOT WORTH IT! In fact, after investigating, I found that I can save as much money (or more) on vacations and hotels by doing online searches by myself.

Promotion Fraud
Festiva Resorts just moved their sales office to New Orleans and they are using a fraudulent scam to bate consumers to their dispicable sales pitch. They retain a company called SMG doing business as awards claim center. The telemarketer specifically told me on the phone I would have a one in three chance to win a grand prize of either a new 2009 Ford Explorer or $25, 000.00 cash at my option. I recorded the conversation. After she set up an appointment during hours in which the Festiva sales office was closed, she called back and re-assured the specifics of the promotion and rescheduled an appointment. Once I sat through their shameful sales pitch, they never honored the promotion that they described in detail. I am filing with Louisiana Attorney General and the N.O. District Attorney for violating Louisiana Consumer Protection Act and False Advertising Law. This company is also charging little old people almost 16% interest to finance $30, 000.00 packages. Their whole business model is shameful and disgusting. I look forward to doing everything I can to shut them down or get them out if my town.

additional reservation charges
I just purchased in Festiva Resorts last year and I made one reservation this year so far. I just called to make another reservation for Thanksgiving week and I was told there would be a $89.00 fee for making another reservation the same year. This is gouging and is rediculous. I was told in order to avoid this additional charge I had to roll all my points over to next year, call back nest year and make all my reservations at one time. Who knows that far in advance when and where they might want to go? Things can happen and sudden changes can make those early reservations void. The more I learn about this company the less I like it and I am in deep consideration of giving my ownership up. I am not satisfied with this company one bit.
