I ordered a free sample of two diet products which were mentioned on Oprah. I received the Aqui Berry sample which included a disclaimer that stated I had "14 days to cancel this program otherwise I would be charged monthly for a new supply". I immediately cancelled this prgram as the "Cleanse" free sample I ordered never came in. I researched both items before ordering and knew I needed both products for the diet to work properly. I waited for the "Cleanse" sample to come in, which never did. I checked my charge statement to see if the postage was ever billed for the free sample and it wasn't. On 1/6/09, I again did a routine check of my charge statement. Two seperate charges were applied to my account for the next supply of the "Cleanse" through Fit Factory. I immediately contacted Fit Factory and asked about the charges. The gentlement only stated that there is a disclaimer online which stated I would automatically be billed for the next supply if the program was not cancelled. He continued to state that I accepted the terms of this agreement. As I am an intelligent women, I then stated to him that Fit Factory failed to submit the free sample to me as I had ordered and therefore there was NO agreement entered. That the disclaimed is not valid unless both ends fulfill their parts of the original agreement. I ordered this free sample, however, they never billed me the postage charge nor did they ever send me the product. I asked the gentlemen what day did the original order go out and he stated it never did. I then asked when the ordered for this new supply went out, and he responded it hadnt gone out. The charges for the second supply were on my account dated 1/6/09, but for the second time, Fit Factory failed to submit a product to me. I immediately requested a refund for the two charges applied towards my account. As of today, a credit has not been to my account by Fit Factory.

I too have a complaint about Fit Factory. I ordered the free trial of Acai Berry and paid only the shipping and handling of $3.95. I cancelled my subscription with them immediately after reading they would automatically charge my account each month in the amount of $85. A few weeks ago, I noticed on my bank statement a charge of $29.95 from a company I had never heard of. I called the number provided on my bank statement, which no one ever answered. I followed up with others who had complaints similar to mine and found a cancellation phone number 800-685-2713. When I called that number the woman asked for even more personal information which I refused. She said upon ordering the free trial I was enrolled automatically in Fit-Factory even though I read the fine print and don't remember anything about this company. The woman cancelled my subscription so I would not receive any other charges, but I'm still concerned about the $29.95 that I did not authorize, does anyone know how to get that charge reversed?

I was charged $19.95 for "FIT FACTORY 8006608489 NV" and I never bought this. What the hell?! Please refund my account in the amount of $19.95 and remove my credit card information from your system. I am also sending this complaint to my lawyer. We'll be in touch if I don't receive a refund.

I received an unauthorized charge on my credit card by Fitness Factory for 29.95. This is related to a free trial of Acai Berry supplement. I canceled the free trial offer within the time allotted and then received the unauthorized charge to my credit card.

Fit factory has charged my account. I did not give them permission to charge my account. I have requested the charges to be removed and yet they have not responded at all. Any assistance would be great.
