banking information
The Fitness One location at Main Square closed suddenly and my banking information was sold to Premier Fitness who started then taking fee out of my bank account without every contacting me. I have contacted both gyms and asked them to cease and disist in using my banking information. Premier Fitness stopped but immediately Fitness One started again even after in writing I asked both of them to stop. I have not used either gyn since November 2010 when my location closed however have still been charged. I have now put a stop payment through by bank. These seem to be criminal practises.

Balance owing after a cancelled contract
I cancelled my memebershiop after the 1 year contract in 2006. Now in 2010 Fitness One has sent me to collections for over $1000. They can not seem to find my cancellation form. Apparently seacrhing the web I found that I am not the only person who has been called from CSC collections agency for the exact same issue!!

asking for money
I had cancelled my account one year ago and paid my owing to them. Last month I got a call from collection to pay almost $300.00 because they have not cancelled my member ship and the manager who cancelled my membership was fired. And I don’t have a copy of cancellation. These people are very rip-off and I never would suggest any one to go to fitness one.

I have also been contacted by the NCR and the above lawyer with regards to “unpaid membership fees” for a Fitness One (Toronto, ON) membership that was cancelled approximately 3 years ago.

To former clients of Fitness One who have been contacted by Vijai Sookhai, Barrister & Solicitor, please be advised that it is indicated on his letterhead that he is certified by the Law Society of Upper Canada as a specialist in the area of civil litigation.

I have contacted the Law Society of Upper Canada to confirm this and he in fact, is not a certified specialist by the Law Society in any area of law.

Vijai Sookhai is misrepresenting himself as a leader in the field of civil litigation.

Secondly, Mr. Sookhai’s business contact information provided on the Law Society’s website does not match the address indicated in his correspondence.

Lastly, Mr. Sookhai’s communication with former clients of Fitness One is intimidating and threatening and contradicting to the Rules of Professional Responsibility set by The Society of Upper Canada.

“2.02 (4) A lawyer shall not advise, threaten, or bring a criminal or quasi-criminal prosecution in order to secure a civil advantage for the client.”

I encourage all those affected by this scam/quick cash grab, to not only submit your complaints of Fitness One, but to also put forward a complaint regarding the unethical nature of the lawyer who has been retained by Fitness One.

Employee NEVER PAID
I, Jessica Lundy, am filing this claim for the reason of un-paid wages and not receiving minimum wage when I was told and signed documents telling me I would be receiving minimum wage of $10.25. I haven’t received my Record of Employment or vacation pay either. It has been almost one month since I last worked for them.

First off, I started working at Fitness One of May 25th, 2010. I did paid training from May 25th-31st at their Head Office (I did 25 hours in total at Fitness One Head Office). I then started at one of their clubs (the Fitness One Dufferin Mall Club) for three days (15 hours in total) for some in club training. I then returned to Fitness One’s Head Office for final testing to complete the training. (Total of 3.5 hours.) They then hired me for full time to work at their Main Street Fitness One Club.

Once entering the Main Street Fitness One Club, some employees informed me of how Fitness One has treated them in the past. The employees told me that they have had their paycheck bounce on them. That sometimes they wait weeks to be paid. Then the MEMBERS of Fitness One who come and sign up to be work-out at the club, were telling me that when they sign up at Fitness One and give Head Office their banking information so their payments can come out of their bank accounts OR come off their credit card ONCE A MONTH are having various different payments come out spontaneously each month, that they are being charged DOUBLE, TRIPLE some times FOUR TIMES what they suppose to be. This was a red flag for me.

I am a student at York University trying to get an education so that I can get a good job to support myself for the rest of my life. I got this job to help support me through the summer while I was out of school until next September. I can’t stress how much I needed a job that actually pays me so I can live and eat.

When I was doing training, Fitness One had PROMISED me my first pay would be on June 20th, 2010. I was told I was going to be getting on that day EVERYTHING they owe me from May 25th- June 20th.

I worked at Fitness One, not missing one shift, getting their on time, DOING EVERYTHING I PROMISED I WOULD DO WHEN THEY HIRED ME. On June 20th, 2010, there was NO CHEQUES FOR ANY EMPLOYEE OF FITNESS ONE. A lot of the employees, including myself, got a hold of the person in pay roll at head office, and my supervisor Kathy. They informed us that the checks would be held another few days because they were “training” a new finance guy, Pierre. Because they had to train him, for some reason the checks couldn’t be given to the employees of Fitness One until June 25th.

So, while we were all waiting to get paid, I was at work one day and a Bailiff came in and informed me with a legal document that Fitness One Head Office owes the landlord of the Main Street location $80, 000 in rent in 5 days or else they would lock the doors and sell all the equipment in the fitness facility.

That was the last day I worked. Not because they had to shut down but because I was literally down to my last $5.00. I had to work on Friday, June 25th. This was the same day the pay-checks were suppose to be arriving at the Main Street Fitness One location so I could get paid. I was supposed to work at 11 am. I called in before I went into my shift to make sure the paychecks would be there. I needed the paychecks to be there because I only had $5.00 to my name left and it would cost me $3.00 to get to work on the TTC and $3.00 to get home. Plus, I needed to eat, since I was literally STARVING myself because I HAD NO MONEY. The lady working at the time told me that some employees at the Main Street Location had received their paychecks, however I was one of those UNLUCKY persons who did not have a check in that day!!!

I told the girl who was working that I need that check to be able to come into work and get home. That I only had $5.00 left and that wasn’t enough to get there and home without having that paycheck. She understood and told me to call Kathy at Head Office and inform her.

I called Kathy; I left her a message explaining what my situation was. I told her I was starving, I told her I had $5.00 left, I told her I need this pay-check to continue to be able to get to work. I called back many times but heard nothing. I waited 4 hours till I called back to the Main Street location because I hadn’t heard anything. The girl working told me that Kathy had told her that the checks would be in later on that night. I told her to call me once they get in. They came in at 10 pm that night. I thought how convienient, all the banks are closed now, Money Mart won’t cash ANY Fitness One checks because they are known to bounce. Fitness One screwed me again. Still without money, still starving. My next shift was supposed to be on Sunday. A girl from Fitness One Main street location told me she might be able to bike (like a 1.5 hour bike ride to my house) to get me my check on Saturday so I could get into work for Sunday. It poured rain on Saturday. She never brought me my check. I had no way to get into Fitness One for my shift on Sunday. But it didn’t even matter because on Sunday Kathy fired me from Fitness One because I didn’t show up for my shift on Friday.

I finally was able to borrow enough money off a friend to get down on Monday to get my check. I get it and open it up. It was only for $237.97. THEY HAD ONLY PAID ME FOR MAY 25TH-31ST!!! IT WAS NOW JUNE 28TH! PLUS, GUESS WHAT, they weren’t even paying me full minimum wage. They were giving me $10.20! I know it’s a 5-cent difference, but think about it. If they are paying ALL of their employees that, they are saving quite a bit of money! WOW THEY ARE CHEAP!

I called them and they informed me I would be getting my ROE, VACATION PAY AND THE REST OF MY PAY buy July 5th (which was suppose to be the next pay period).

It is July 20th now and I have received NOTHING. Last week I had talked to the pay-roll guy he said he was sending me SOME of my pay last Monday. It has been a week and I have received NOTHING. I have warned them that I was going to the Labor Board unless I get my money, NO ONE HAS RETURNED my calls.

I CAN’T STRESS HOW MUCH THIS COMPANY IS SCREWING PEOPLE AROUND. Google them and you will see countless complaints online by members, previous members, and employees. I am sure you have gotten a claim from other employees from Fitness One.

I really need some assistance in getting my money from Fitness One. Like I said, I am a student and I currently have NO money. I’m hungry again and I have rent coming up. I really need this money. I know it is not a lot of money, but when you have waited POOR for weeks, anything can help my situation. Since I thought I was going to be set for the summer with this job, it has really made it hard to live and has made me very depressed.

cancelled membership
This company is not honourable. I cancelled my membership over three years ago. And now, they have sent it to a collection agency saying I owe back fees?! I am appalled at their lack of integrity. I tell everyone I know to stay away from them and am launching a formal complaint against them with the Ministry of Consumer Services.

Account paid in full gone to creditors
Fitness One is one of the SHADIEST companies I have ever had the displeasure of dealing with. Anyone reading this, STAY FAR FAR AWAY. My girlfriend is currently dealing with an account that has been paid off for about 2 years that we are only NOW getting calls about saying she never paid them. We're getting sent back and forth between head office and the collections company, and she now has to deal with having bad credit due to this incompetent company.

Our drama started back in November when my gf received a letter from the collections company. Of course, without delay, she called to find out what the issue was. She was informed that it had to do with her Fitness One account. She explained that it had already been paid, and the gentleman told her that apparently, the company had been bought out and this was happening to a lot of people. She was relieved, thought the issue was resolved, and forgot about it. She is now dealing with the same issue again, but this time, nobody knows anything.

We will probably end up having to pay another $260.00 to these people as she can no longer find her receipt. Too bad for us. Lesson learned.

Lost Money
I live in Canada, everything that is being said about Fitness One is 100% true. I joined and I got their deal as they call it and when my contract was up I preferred to not renew. I tried to talk to someone at the gym but when I tried to they told me I have to call the head office in the states to get them to help me. Well, ... let me tell you I called numerous times and they NEVER returned my phone calls. Yes they steal your money and add interest on top of it.. they are liers and thieves.Their head office in Concord doesn't have a customer relations dept as I sent them an email as was suggested on their recording to contact them for help. I sent them an email and it returned to my inbox thesame day, so they don't even have such an email address as they said. Now they have sent the collection agency after me and they have added extra funds saying I owe them much more. Which infact they owe me money. How do we expose their devious unprofessional ways? How do we report them? I think we need other women to come forward and tell their complaints so we can expose Fitness One.

Stolen money
Two years ago I have registered to Fitness One club. During the time of sale I was unsure I needed to spend all that money, but the salesperson was pressuring me to get the 'deal' the same day before the 'sale' was over, and showed me at the contract that I am allowed to cancel my membership within 10 days for a full refund.

Withing less than 48 hours I did cancel the membership and was told that a check will be sent to my home within a month. Two years later and still did not get the check.

During these two years I have tried to make contact with the 'head office' many times, but no one has replied so far to the messages I have left on their voice mail or email I sent them. I have even went back to the club trying to talk to a manager, but somehow every time I get there there is no manager on site. When I have joined the club the salesperson got me a 'special deal' from the manager that strange enough was on site just that time.

These thieves count on us people not spending our time in court for $220, and you know what - they are right. Why would I spend hours to get this little money? But, I would most definetly spend a few minutes letting everyone know about their scam!

Not sure you want the membership? Don't trust them about the refund. Just walk away from the sales pressure. The 'special deal' would last for years, don't worry :)

These scam artists have stole my money and kept it for two years now.

AVOID them for your own good!

Refund not received after 4 months
Last September ('07) I took advantage of the 10 day trial at Fitness One a the location near my home (2575 Danforth Ave) and joined on the payment plan deducting the monthly fee from my bank account. Five (5) days later, I decided I did want to join but chose to pay by credit card as it would save me money. The contract for the monthly payments was cancelled, or so I thought. For months (Sept to June) the monthly amount was being deducted from my account. When I questioned this at my location, a rep phoned the head office and determined that yes, there was a full payment in Sept. but they were also deducting the monthly payment from my account. She was able to stop the deductions for me and cancel that membership and told me it would be 6-8 weeks before I received my refund $300+. That seemed reasonable to me.

However, here it is the end of October 4 months later and I still have not received my refund. I have called and left messsages and no one returns my call. I happened to get a real person once and her attitude with me was, I would say downright rude and not helpful at all. I emailed their customer service without any reply from them.

They do not seem interested in returning my money. I left messages that my membership expired in Sept. '08 and one of the reasons I did not renew was their poor customer service practices.

I am considering filing a small claims complaint, but that will cost me, so I am thinking about it. Perhaps other disgruntled customers of Fitness One would consider joining me in doing a class action.

I would like to know, if you can help me regarding what other avenues I might have. I have contacted my credit card company about a charge back. I would have had to do this within 90 days of the problem, but I am filing a complaint with the disputes department of my credit card company and they might try to get Fitness One to come across by threatening to do a charge back. I won't know for a while if this will be successful. I am thinking of contacting the Sun or the Star or City TV about alerting other unsuspecting clients of Fitness One, out there.

Thank you. Still trying to get my money back.
