victim of misleading information
I'm one of those people who has become a victim of such misleading information

First of all I want to voice my disgust with Flexi Club consultants who go out and do presentations to potential customers on false premises. I'm one of those people who has become a victim of such misleading information. In December 2010, I was called by a consultant of Flexi Club. She used the Port Owen premises and gave me a business card from another consultant - Winnie Nel. But the lady who presented the special to us gave her email address: [email protected] Needless to say that I don't get any response on this email address.

She scheduled a meeting with myself and my husband on a Sunday during our holiday at Port Owen. She told us that flexi club is running a special package for valuable customers (as we already belong to Flexi Club and already own points) So therefore we qualify for this perceived special, we were required to pay what was said to be a once of fee of R 3863 and a service fee of R1660 (annually) less R600 discount for members who pay via debit order. So we signed a debit order form for this annual fees of R1060. She told us that the other figures reflected on the contract were not part of the special, therefore they will not have any bearing on the deal, but the form they use was just a standard form.

In March I got a call from one of the consultants asking for a payment of R171.00 that was still due, I then question the amounts that she was referring to. She told me that this was a short payment of what we paid that day. I have asked her to send me a statement and bank details so that I can sort this out.

The next month they called me again about a monthly payment of R2890 that did not go through per debit order. I told her that I don't know about any further costs and I surely don't know about this R2890.00. She told me that this is a monthly payment for 11 months as per the contract we signed. I told her that we did not sign for any additional costs, as we were told by Iqrah Solomons we only had to pay a once of payment of R3863 and for the next year Flexi club will use our points as the need points for other members. By doing this our account will be credited. Also with this special we will receive 4 free weekend away holidays as she has to give them away. This we haven't received either !

When I checked my bank statements I saw that there have been two deductions from Flexi Club in April'11. One of R3263 and another R2890.00. In May one of the ladies phoned me again and I told her that I am still waiting for a copy of that contract and the signed debit order where we agreed to pay R2890.00 for 11 months, because I know we haven't signed for any of these amounts. I informed her of my intention to cancel and she told me it cant be done. They will summons me and I have to go to court to state my case.

For May I have stopped the debit order and emailed Iqrah Solomons to contact me and explain to me why she sold us a special with a once off fee, if this was actually false information and illegal. But I have not received any reply from her, so I believe the email address she gave me was also false. All I have is a business card of Winnie Nel from Port Owen, where the deal was done.

I want to know why Flexi Club send consultants to use false premises and give false information to people and when we query this, no one is able to assist and sort this out.

I request that this false contract must be cancelled and the two debit orders in April taken out of my account must be refunded. And I still request a copy of the signed contracts and debit orders where it states that we will have to pay another R31 790, after we were told we only have to pay a once off fee of R3863.oo. I will take this to court if I needed be.

Winnie Nel, sorry to involve you in this, but your office and business card was used for this illegal sale.

Who said that your company can process my details
On my way to Century City I receive a ticked that I won something from club Flexi. I when to them they took my details and I signed a contract but what Ii told Daren is that he must not process the contract because I would like to discus this with my wife before confirming if I interested or not. Darren the Consultant said that he will freeze the Contract and that I can decide. On 09032010 I tried getting some money and found out that I have insufficient funds avail and that I owe the bank money. I went to the bank and got a statement and found out that FLEXI has deducted R1, 944, 25 from my account. I then Went to club flexi that same day and spoke to Daren and he said that there was some confusion with the contracts and that some one put my contract with the ones that needs to be processed .he said If I want to cancel my account I need to fax flexi in Durban a letter saying that I wan to cancel my account and that they will refund me with my money. I ask him if he could fax the form because I had no money and he agreed and he said he faxed the form and that some one will call me. Its 3 days now and yet I have not received a call.Please Help i have faxed teh form myself.

After the presentation we were told that flexi club is running a special package therefore to qualify for this percieved special, we were required to pay what was said to be a once of fee of R 7670 and a service fee of 1250 (annually). when i noticed other funny amounts on the contract, i then question these figures and the consultant ( Tshemise Mondli ) and his supervisor told me that the figures reflected on paper were not part of the special, therefore they will not have any bearing on the deal, but the form they use was just a standard form.

I got a call from one of the consultants asking for a payment that is overdue, i then question the amounts that she was refering to. The day after I looked at my bank statements to see how much money has been deducted to date. I phoned the customer services to inform them of my intention to cancel and they told me it cant be done. Is this legal.

Bullied and threatened into paying for an oversubscribed lifetime membership
This is most probably the only supplier who does not want his own 'product' back -even if it is returned for free!! Points sales and levies derived from NEW lifetime memberships are clearly the drivers for sustaining this lucritive bussiness venture -very similar to a pirimid scheme you might say? Companies like these should be exposed and taken to task!

If you are lumped with your lifetime purchhase and have run-out of of options, I suggest that everyone lodging an official complaint also copies ALL of the following Watchdogs i.e. National Consumer Forum, South African National Consumer Forum and the Department of Trade and Industry .

These institutions will very quickly realize the magnitude of this problem and how consumers are continually being ***, bullyied and threatened into paying for an oversubscribed lifetime membership.

Non existent customer services
I to feel the same way as many of you do on the unsatisfactorynon existent service recieved from Flexi club. i have been trying for sometime to get there cancellation policy or termination notice which they are refusing to send tthrough. After numerous phone calls to them and promises of returned calls i am still waiting, We have been members of Flexi club for some 10 years now. i cannot see anywhere on the contract that this is a life time policy, i also cannot believe (As i was told) that the board will decide wether or not they feel like cancelling the contract.

Has anyone been able to succesfully cancel there policy?

we are now in a position where incentive leisure group are willing to take over our contract, which would cost more the R60 000. Does anyone have any experience with that company.

flexi club booklet
when sitting for the presentation the sales consultant say that we will receive a booklet with that he had showed us, but we still did not receive the book.we did phone to enquire but now they say we not going to get the book.in that book we can see the places were to book but now that we don't have the book we don't know were to book out.it rely creates a problem for us because we also don't have much access to the internet to view the places we want to go.if we have the book it will make things so much easier.

Cancellation
We have been trying to cancel our membership with Flexi Club since October 2009. We have not used this product since 2007 and had to pay the annual membership fees every year, which is close to R5, 000. We were told by the consultant who sold this to us that after the loan is pay off for the timeshare it is ours and we can sell or transfer it to someone els or do anything we want with it thereafter. Then we started making some sums, we had to pay R5, 000 for annual membership fees and you still have to pay a fee when you booked a holiday. The points you get have stayed the same since we bought the timeshare but the annual fees goes up every year as well as the points for the places. We have asked them to cancel the timeshare and that we do not want it anymore, they then send out a consultant to come and see us to show us how to use our points "proberly" or we can pay additional points or we can upgrade. We said that we are not interested in this anymore and do not want it. The consultant then told us he will forward the paperwork to sell the timeshare. We never received anything from him, we kept on phoning him and he told us that he will forward the paperwork. Then we received an account for the membership fees for 2010-2011, we told them that we are selling it and do not want the timeshare. Finally we were handed over to Transunion for non-payment and told them the whole story, just to find out from them that Flexi Club has a No Cancellation Clause in their contracts, but if we pay the outstanding amount we can then cancel with them. We have never received a contract from them, and have asked for a copy of the contract we signed and we are still waiting.

FLEXI CLUB CANCELLATION
I have been trying to cancel my flexi club account now for a year, as they lied to us on the presentation.
i have handed the situation over to my lawyers and he has sent letters to them telling them not to contact us, but they refuse to revert back to the lawyer. they have told my wife and me that they will call even though they are not supposed to.
they are enfringing on our human rights as by the law we are supposed to be under the protect of our lawyers.
They are not proffessional when they call and are very rude and abrupt, they often say that we don't have a lawyer and that we ar lying. But they refuse to take the lawers number when we offer to give it to them.

Hidden costs
When I joined Flexi club I was told ONLY about the monthly fees and a "user charge"...to be paid WHEN I WANTED TO GO ON HOLIDAY.
now I get letters from them telling me about yealy fees...amounting to thousands.
I just don't have that kind of money.I need your help/advice on how to deal with this problem

USER CHARGE
I CONTACTED FLEXI CLUB'S OFFICES TO ENQUIRY WHY MY STATEMENT REFLECTS A SUBDSTANTIAL SMALLER AMOUNT UNDER USER CHARGES THAN WHAT WAS PAID OVER TO THEM. THE ANSWER WAS THAT MY MONEY HAD EXPIRED. KINLDY EXPLAIN TO ME HOW MONEY PAID OVER TO FLEXI CLUB AS PROVISIONAL USER CHARGES EXPIRES AND WHAT HAPPENS TO ALL THIS EXPIRED MONEY AS I AM SURE THAT I'M NOT THE ONLY MEMBER WITH EXPIRED MONIES???<br />
