Unauthorized billing
Ordered the Free Trial over the phone, not over the internet. The rep that took my order did not mention anything about the product not being free and that after 14 days I would have to return it if I didn't like it. She actually reiterated to me many times that the product was for Free and all I was being charged for was the shipping. I ordered the product on Nov. 16. I didn't receive the product till after Christmas. I live in a building and apparently my super intendant received the package on Dec. 16 but because I was away on holiday she just held on to it until I returned home. She gives me the package, I open the box, they sent me the wrong cream, they sent me the cellulite one and there was nothing in the box regarding this being a trial period and that after 14 days I would be charged full price for the product. So, this past week-end I finally have time to sit down and review my bills and I see charges that I did not authorize. $89.95 that they charged me before I even received the product, and the product costs $79.95 on their website, the difference is shipping. So basically they charged me for shipping twice. Once when I initially ordered the free trial and now when they billed me for the full cost of the product. That was my Nov. statement that I received in Dec. Now I just got my Dec. statement and I see more charges from them. So I called and they basically gave me the same bull that they have been giving everybody. This Terms and Conditions that is at the very bottom of their website, I didn’t even order it off the website. I got a pop up ad and that’s where I got their tel #, so I wasn’t even on their site to see the Terms and Conditions. Who ever looks there anyways? I told the supervisor that I didn’t order the product off the internet but he just said he has an IP address for my file. I think he just made that up. The terms and conditions should be stated clearly stated on their website beside the actual product you are ordering. The rep should also reiterate the terms and conditions. It should be something that pops up like their stupid "FREE TRAIL" ads do. I argued with the supervisor. He wouldn't refund me the money. I asked him to at least refund me for double charging me for the shipping. He wouldn't even do that, he actually laughed when I pointed it out to him. I asked him to send me the recorded conversation of when I originally ordered this product. Something has to be done. These people know that they are scamming the public. My credit card company said they couldn’t do charge backs with this type of company, but I think that since they require our credit cards that we should force our credit card companies to better protect us and I think that if we get enough people together we should consider some sort of class action. This is an obvious case of fraud. These people should be charged criminally and they are taking advantage of the fact that on a person by person basis we won’t do anything legally because it would cost too much, more then what we are out on this fraudulent charges, but together, I think it would be worth it.
