We have given the business Global Telecom, LTD more than ample and reasonable time to resolve an erroneous equipment order and shipping issue. We have searched online Complaint boards and looked at Global Telecom, LTDs Better Business Bureau file and found nothing of a negative nature. It is not our intent to damage a commercial business reputation without first allowing the business to resolve the issue. Because we have made numerous communication attempts with no follow-up for a resolution, we are submitting and posting this formal complaint. We will also contact the Texas State Attorney General to file a formal complaint and further submit a negative report to the BBB of Metropolitan Houston. We will also review options for further legal action subject to any damages caused by Global Telecom, LTDs negligence and possibly fraudulent business practices.
Our office received an unsolicited fax on June 16, 2010 with no referenced return fax number. They were selling equipment we generally provide to our customers. We followed up to this unsolicited fax with a telephone inquiry regarding the status of the model numbers and availability. We spoke with a Joe Hill who indicated he had been in business for 25 years, which included extensive experience selling to government agencies and branches. We asked how his company acquired our fax number and his response was they have special tools for acquiring fax numbers. Joe represented himself as a wise, friendly and honest person with whom to deal in business. He chatted up freely on the first call offering bits of wisdom, tips and more. Joe further communicated that our company should never accept orders from government agencies for less than (x) amount and that their company systematically train procurers to do business their way or they don’t do business with them at all. As he put it, “They’ll take advantage of you if you let them.” We informed him we would review our options and possibly call back with a first order of a single business telephone for our client. He then informed us that we had to purchase at least (2) telephones at a minimum in order to process the order. He further agreed to ship one single unit directly to tour client and the remaining unit to our business address.
We followed up with a second telephone call which was answered immediately by Joe Hill. We agreed to purchase (2) 20-button Tone Commander telephones model 6220T. Joe indicated that they did not accept credit cards, but will do Net 30 terms because as he stated, "We trust you". On June 22, 2010, we forwarded our purchase order for the two phones as agreed upon. Expecting the order was already processed and the shipping tracking number was to follow, on June 28, 2010, we received an urgent feeling telephone call from Joe Hill communicating that the payment terms were not Net 30, but COD upon delivery. He went on to state that he could not split the shipment and that both phones had to be delivered to our location. He said that his partner told him these are the terms and that it was a misunderstanding on our part. We challenged the original terms and shipping conditions previously communicated to us adding that it was our impression that he is the principal business owner. He denied that understanding and stated that it was the call of his partner and added that he had to get our approval to release the equipment for immediate shipping today and rushed us off the phone to complete the shipping transaction as time was running short. Too much time had passed since first submitting the order so we agreed to have them release the equipment as soon as possible as the Independence Day holiday would slow delivery to the client. The next business day we sent an email to the provided address on the faxed solicitation '[email protected]' requesting both a tracking number and a copy of the invoice for our records. No one responded to the request for an invoice, but a FedEx tracking number was provided via email reply.
On July 2, 2010, the package arrived to our relief days later and the COD check was handed to the shipping carrier in exchange for the purchased merchandise. Upon inspection of the package contents, we discovered that the wrong model was shipped. Instead of (2) 20-button 6220T phones the box included (2) 10-button 6210T phones, which was not what we had discussed or requested in our purchase order. We immediately contacted the seller alerting Joe Hill of the shipping error. Joe Hill apologized profusely to the error communicating that most orders are for the 10-button phones and that the error was on their part due to assumption. Joe then committed to shipping out the correct equipment (1) unit direct to the client split shipping (1) to our address on the next business day. He added that he could not ship on that day, as there was no one in the office to perform the task. He would ensure it would be shipped out on the next business day. We would receive instruction on returning the erroneous equipment. Several business days have passed without further action on the part of the seller.
We have made numerous telephone calls and left several messages seeking a resolution to the error with no response in over two weeks to date. Global Telecom, LTD continues to ignore our calls, voicemails and emails. We have paid their price for the larger 20-button phones, but were shipped the lesser-priced 10-button phones and our bank will not cancel our check, reverse the funds or return our money. So we have no alternative, but to pursue other recovery actions. It has been determined that a registered letter to this effect be sent to Global Telecom, LTD.
