Loan
For the past few years we been asking all the paperwork on our Mortgage . They tell they will send it but they have not ... I do not know why they will not send it ... I was thinking today if everyone stopped buying GM Car's that might open their eyes .

Follow Up
Our attempts to contact any key management or decision makers of GMAC Mortgage has been unsuccessful. For those of you that have wanted to simply have a conversation with anyone from this company, you know that they only provide their customer service line or an online form to complete. It wasn’t after I filed a complaint with our Attorney General's Office (Mr. James D. "Buddy" Caldwell) and the Department of Justice, that I received a response from GMAC Mortgage to the Attorney Generals' office, that I received some viable contact information. Yes, GMAC Mortgage continues to lie about the events of April 27 and 28. But more importantly, I now have the name of a real live person who is an "Advocacy Resolution Specialist" for GMAC Mortgage (yes, they actually have one of these!). Mr. Bryan Duggan can be reached at 1 -800-627-0128 extension 2365373 or directly at 319-236-5373. I'm confident that if GMAC Mortgage has an advocacy specialist, then they certainly would welcome calls from their customers, the people that keep them in business, regarding their experiences, concerns and dissatisfaction with their business practices. The way we deal with such entities as GMAC Mortgage, is by not doing business with them. And write to every consumer group and elected official you can find regarding GMAC Mortgage’s business practices. Remember, it was our government that gave GMAC a whole bunch of our tax money. But of course, we now have Mr. Bryan Duggan to listen and act on our inquiries. I know I feel so much better just knowing that GMAC Mortgage is "there" for me! There are numerous reports of GMAC Mortgage's unethical business practices available online with consumer report groups. Even if what GMAC Mortgage does is not on paper, illegal, there is a moral side to what sort of business practices they subscribe to. If GMAC Mortgage would lie to a Baptist Minister and his terminal wife, no one is safe.

didn't honor contract
I was contacted by a company, Refinance.com, who was working for GMAC Mortgage to "clean up" some of its mortgages so they could get help from the government. I was told by this company that GMAC would rewrite my mortgage to lower the percentage and pay off all my existing credit cards, even pay off my auto loan. I was not able to meet the income level so they added on my parents who were promised the same thing (pay off their credit cards). We were provided a contract stating everything they were going to do, all in the name of GMAC Mortgage. We had several closings that did not happen for little problems. We even paid for an appraisal on our home. When we realized that we were not going to get any place with them I called GMAC and was told that Refinance.com should not been promising anything of the kind to us. I have since filed a complaint with the Better Business Bureau in our state, the Attorney General of our state and talked to several lawyers who state that we have a case but we do not have the thousands of dollars they require to fight them. I never got a note for my mortgage which the attorneys say is illegal. I am disgusted with the whole system that allows big corporations to take advantage of the little guy.

Dishonest
I have been documenting my experience as a 52 year old Slidell, Louisiana woman who is disabled and trying to acquire assistance with housing with an eviction looming from GMAC Mortgage.
My husband and I taped an interview with "Action Reporter" Bill Capo, from WWL-TV Channel 4 (New Orleans). On Thursday, June 16th, 2010, this feature aired on the 10:00 p.m. news. This whole interview took about 3 hours to complete. I was able to tell my story in its entirety to Mr. Capo and he was ready with all the right questions. Of course, it was edited and much of our lengthy interview was omitted due to the constrictions of television. The edited result can be viewed on line at the WWL-TV web site under "Action Reports".
Our foreclosure took place on April 28, 2010, right after we celebrated our 8th wedding anniversary. Now we await the forthcoming eviction notice from GMAC Morgage...any day now.
I began my research after the sheriff came to our door in January of this year with a foreclosure notice from our mortgage company, GMAC. Since then, my efforts are continuing to learn about my options as a disabled individual and trying to find programs that could save our home. We knew there were programs out there, and we trusted GMAC to submit us to any programs that may assist us in keeping our home.
We provided our income information to them as soon as the foreclosure process began. The sale of our home was set for April 28th, 2010. On the 27th, GMAC informed us they needed more information. My husband scrambled around to fulfill their request, faxed 9 pages to GMAC, and then called to confirm that GMAC had received the information.
The next day, we were told that we were "denied" by everyone and we lost our home. I was a little suspicious, as they certainly didn't have enough time (literally overnight) to submit us anywhere. I have repeatedly asked for the documentation of who they submitted us to and why we were denied, to no avail. One day, I got Mary on the phone from GMAC. She informed us that we were never submitted to anyone...so there was no denial! Conveniently, she did state that they had received the paperwork they requested, but it was dated the 29th--the day after the foreclosure! We knew that we provided this on the 27th.
The funny thing is, Mr. Capo spoke with the attorney representing our mortgage company, GMAC. She confirmed that our home had been foreclosed on and we will soon be evicted. Mr. Capo asked what will happen to our home, will it be put up for sale? Her answer shocked him--our home is becoming a HUD home! He has suggested to all parties involved that we be allowed to stay put and has now reached out to HUD about this situation. We'll see...
This email was sent to everyone in my address book, asking for my story to be forwarded to everyone they know. And it was sent to any federal, state and local government offices, and every organization that I could find that deals with advocacy, disability issues, and consumer affairs. I also contacted our local media, as well as newspapers, magazines, talk shows and news programs nationally.
At the age of 52 and disabled, I am facing homelessness. Thanks, GMAC.

In May of last year I received a mailing from a company called First Rate Capital Corp. Melville NY, which I answered. We refinanced our home for $380.000, paid off an existing mortgage, credit cards, and cleared the way for our son to finish his last two years of collage. At the closing, several things happened, one the title search company collected $4400 to pay for the last half of our 2009 property taxes, and there was $2500 placed in an escrow account to help pay for the first half of the 2010 property taxes. The most important thing that happened was that both my wife and my self question the loan officer about the monthly payments; we thought that they were to low. It was explained to us that because of the lower interest rate and the extra monies going into the escrow account, the $2400 per month was the correct amount. A letter arrived a few weeks later, telling us that the account had been bought by GMAC Mortgage; this was something that was not supposed to happen, again we question the loan officer at the closing about keeping the mortgage in a local bank. We have found over the years that keeping our banking local is much more productive. And it states in the mortgage papers that First Rate Capital would not sell the mortgage. And our first bill came a few weeks later which was the agreed monthly payment ($2390.00). I set up an online account and continued to pay on or about the first of each month between July of 2009 and April 2010.
In April I received a letter from GMAC stating that they were increasing my mortgage payment to $3523 per month, but if I sent them a check for $6422, they would only increase the monthly payments to $3255 per month. This is due to a shortage in the escrow account. This was something that was not to our doing; in fact we tried to prevent it from happening. This is a problem that was created, I would assume by the loan company, as I have read that they are no longer in business, and have been called into court for misrepresenting loans, with many of their accounts being refinanced already.
Since the letter arrived from GMAC, I have called; I don’t know how many times trying to come of some sort of agreement on how to pay for the shortage. I have been told to sell our home, borrow the money form our kids, and several other equally stupid comments, from the GMAC’s representatives. I have sent in three copies of a financial analysis forms to the loss mitigation department, the first response said that we were not in eminent default, so we did not qualify for a reduction, the next letter said we did not earn enough money to qualify for a reduction?. The next two letters we received one dated 04/12/10 stated that we were to pay $3255.48 starting May first, the second, dated 06/02/10, stated that we to start paying $3166.28 as of May first. The last letter we received which was sent certified mail stated that if we didn’t send $9752.14 by the 07/09/10, we could lose our home.
In review, we have been requested to pay $3523.09, $3255, 48 or $3166.28 per month, plus send a check for $6422.66, or $9752, all of which must come from my $3800.00 per month fixed income, or my wife’s $40, 000 a year job. There are two numbers that have never been discussed; the first is $2953.04, which is the monthly payment that appears on the payment letter to borrower, which is in the signed mortgage papers. This is the payment that the GMAC should have charged, or the $2390.83 per month which is what the GMAC did charge, and accepted as payment for the better part of a year.
There is a question that we think should be answered. How did the GMAC allow this mistake to happen? At the closing, there was the loan officer from First Rate, their lawyer, and a representative of the title search company, all of whom sat on their hands while my wife and I signed the mortgage papers. In speaking with our own attorney, in his experience with mortgage closing, he reviews the papers to ensure that there are no last minute errors, such as what happen to us. Then there is GMAC, who loaned out $380, 000, and never bothered to look at the mortgage that they had bought, and allowed the error to continue for almost a year.
As I have stated earlier, I have tried to speak with the representatives from GMAC about finding a solution to this problem, I offered to continue to pay the$2390 per month, which is the full interest and principal plus $400 a month towards the escrow until we could come to some sort of agreement, and I was told that GMAC only accepts full payments. I offered to open a credit card account to pay for the shortage, and the current property tax, sending GMAC the full principal and interest each month, and paying the taxes ourselves. We were told that this was an FHA mortgage, and by law GMAC had to escrow the tax monies. We have also spoken with the FHA (Ref.#109149) about different programs that the government has, we were told that we earn either to much or to little money to fit into these programs, one even stated that we earned both to much and to little for the same program? We have even tried to refinance without any success. There are two other suggestions that may made a difference, one is to take the contracted amount of $ 2953.04 and use the amount of reduction that GMAC has already stated, about $355.00, this will increase the loan monthly payment from $ 2390.00 to about $2745 per month, which allows for the full payment of the interest and principal, and an increased amount to work off the shortage in the escrow account. This along with a supposed reduction in our property tax based on our ages and my wife’s retirement should allow for this problem to resolve itself in a year to eighteen months. The second suggestion that we had was to escrow the $2390 each month, paying the $3166.28 every other month. This again allows for the full amount of interest and principal to be paid, along with an amount to pay down the escrow shortage. In reviewing the loan documentation we have found mistakes. On the truth in Lending Form the amount that is stated is $2139.84 not the $1985.10, principal and interest.
On a personal note, I don’t think that my wife and I are stupid people. We tried to ensure that this loan was well within our budget. If we would have known that the payments were not as stated by First Rate and not what GMAC bill us for, we would never sign the papers. Again this loan was suppose to improve our position not ruin our 30 year credit history, or to have people calling and writing letters, telling us that we are going to lose our home.

Bad Customer Service
For the past few months I have been dealing with the customer service line at GMAC Mortgage. I find their customer service team and their business practices to be very misleading and shady. They will claim one thing but the next time you have someone else on the phone it's something very different. When you call them on it they claim that you misunderstood that individual or that you can't understand their documents and y0u should read it again. How about maybe you did not write the document correctly in the first place. I will never do business with this company and it's amazing they keep trying to up selling me on their other services. If you plan on doing business with this company think twice about it.

Loan modification FRAUD
I have had a GMAC mortgage for seven years. Never been late on a payment. Never had an escrow account with them for taxes or insurance as I pay that myself. They contacted me recently to do a loan modification. I agreed and sent them the zillions of forms and papers they wanted along with my hardship letter. I was denied by the Obama program so they told me to apply for their own program. I again did all the paperwork, tax copes etc. I was again denied with them saying I make enough to make the payments. I am in the hole each month by about $1, 300.00. Next I get a new statement and letter saying they have now set up an escrow account for me. they paid my property tax that was not yet due, they paid my homeowners insurance bill which had already been paid. Plus they now want my tax payment for next year in advance. Mind you, never late on taxes period! so their help was raising my payment from $727.00 to $1287.00 per month. They now know that I have a large amount of equity in my house as I had to disclose all that with the modification papers, they know I have a hardship, so there you go. Now I can not make my payment and they will take my house.
I verified with the tax collector that my tax payment was made in full by me. But, GMAC also paid so now there is a credit. The tax people have been trying to contact GMAC to give them a refund, but they will not return their calls. My insurance co sent me a refund as I was already paid and GMAC has also paid, so now all my paperwork shows that I now have an escrow account which I do not. GMAC finally sent me a letter saying they have reversed my escrow account, but today I get a statement in the mail wanting me to pay the $1, 287.00 for my June payment. They are sick sick people.Writing to your state department of Justice is a start. Fair lending companies, I have filed a formal complaint but at this point am looking for an attorney to file suit. This should become a class action for all the people that have been harmed by these fraudulent and illegal actions against Americans. They took money and are supposed to help us not cuase us un-due stress, financial ruin and harm.

REMODIFICATION PROCESS
I filed re modification papers thru a legal firm in November of 2009. GMAC has given the legal firm the run around since day one. For 2 months they haven't recvd any faxes. Once the paperwork was finally recvd
they keep coming back stating either something is missing or they need more paperwork. They are now
foreclosing on my home and still show no signs of accepting the re modification. The legal firm says that GMAC
is the hardest mortgage company to deal with...the government needs to step in and fine them large $$ and maybe they will get on the program. What a joke...

non-compliance of Loan Modification Program
The government has outlined a program to save unemployed or underemployed people from foreclosure which would really screw up the economy for everyone except the RICH. So the RICH corporate types (like GMAC Mortgage) are determined NOT TO COMPLY with the guidelines and are getting away with it. In every state in the US people are being jerked around by these guys who won't take a phone call from the very people whose life is in their sweaty little hands. Yet, I have not heard of a single Attorney General filing a class action suit against them for NOT acting in good faith, even though they received billions in bailout money (yours & mine) & they even get a $1, 000. reward for giving loan modifications, they still are on a conscious, methodical plan to default as many loans as possible or force their customers to sell their homes - the biggest investment in most of our lives.
Hard working people who do the right thing for 40 years, like myself, are being pushed into unemployment, followed by loss of self-esteem, self-sufficiency, isolation, despair and finally homelessness...all so GMAC and the other disgusting financial giants can make more money. The money it takes to run a Federal program like the Loan Modification program is as good as flushing it down the toilet when the people you depend on making the program successful are Republicans out to do whatever it takes to make the Democrats look bad. These people are criminals and deserve to be behind bars with petty thieves, child rapists and murderers!
When will someone in power wake up and do something to help those of us who are trying to do all the right things but are being hit in the face with one obstacle after another by these masochists? Maybe never. I've always been optimistic and patriotic but can't find anything good happening in this country except for the change of guard in the White House. Unfortunately, those who are really in power due to their $$$$$$$$$$$$$ are keeping them from doing their work 24/7. Costa Rica is looking better everyday. Give me a tent, take my computer & cell phone and just leave me the hell alone! Thanks for letting me vent ;-)
