Insurance Fraud
In 2007 my mother had purchase a 2nd home (My mother being a single women with one income this was a high risk loan, just keep this in mind as you read on) . For our family with the intention of one of us purchasing it from here within a 5 year period.
NORMAL PRACTICE:When any buyer goes to closing they must bring proof of 1years Paid homeowners insurance to the closing table for the home to close. This is Normal practice.
NORMAL PRACTICE: With-in 6months of closing our original lender sold our Loan to GMAC Mortgage.
GMAC did contact us saying they were the new holders of the loan.
NOT NORMAL PRACTICE:1 month later GMAC Mortgage contacted us saying they did not have a copy of our homeowners insurance, so of course we mailed them a copy, after a couple weeks again they said they did not have a copy so we faxed them a copy, certified mailed them a copy, and had our State Farm agent send them a copy.
NOT NORMAL PRACTICE: 3 months later GMAC sent us a letter stating they are going to start the foreclosure process because we were behind on our Mortgage payments.. Of course you could understand the shock because we had not missed a payment and we had it set up so GMAC took the money directly out of an account every month. GMAC did take the full mortgage payments every month. HOWEVER they were applying the mortgage payments toward HOMEOWNERS insurance GMAC Placed on our home...THIS IS NOT NORMAL PRACTICE..
We spent hours on the phone with GMAC trying to get them to reverse their IMPOSED mortgage insurance because we already had our own in place. They also added on fee's such as late payment penalties, lawyer fees and any other fee they could dream up..We got no where because we NEVER talked to the same person more then once and nobody knew what the other person was doing over there...
Long story short we hired an Attorney who "Never heard of such a thing", we should of known then to find a new one..
Thousands of dollars later GMAC got what they wanted. The foreclosed on our home and we now have to move by the end of June..
I tell this story to people and it is very unbelievable to them..and there are many similar stories across the country like ours.
GMAC Mortgage achieved in getting a high risk loan off their books and because of PMI (private mortgage insurance) the government paid for 80% of the loan value. This is why Mortgage companies will not do loan modifications. THIS HAS BECOME STANDARD PRACTICE ACROSS THE COUNTRY
I am writing this NOTE for the Simple cause of AWARENESS. This is why we see so many vacant homes and why there are so many SHORT SALES (which hardly every go through, banks will not approve them)
This problem is not going to get any better, we are going to see a turn for the worse. I would hope this story of ours if anything will help someone else...

Phone payment debited twice,run-arround about refund
Did a phone payment on my mothers account with gmac on march 9, 2010 for 1, 114.15 (amount according to system)no confirmation number for the first payment, it transferred me to customer service.i explained, that i just made a payment but did not get a confirmation number and the rep said "it did not post I'll transfer u back to the automated system so u can do it again". did another payment for 1, 147.90(per statement )been told differnt things by reps. a manager phoned me on 3/15/2010 stating my money should be in my account on 3/16/2010 no later than 3/17/2010. 3/20/2010 no money !took 2 days for gmac to get ther money. now a rep says it'll be 7-10 business days!they have proof from my credit union off funds paid to gmac on 3/11/2010. they have given my mom n i the run-around, have names of everyone i've talked with from 3/12/2010 when it started .

Horrible repayment program/modification
My husband and I were put on a repayment program from nov.2009-march 2010 for our mort. with gmac. was told only thing we could do because they had our mort. even though we have a hud fha loan.I called in jan. to sent paperwork to them because i this was the 2nd time i have sent it, they said i didn't complete it right or couldn't read it.was told we were 3 months behind and defaulted on repayment program.I have original copies of all payments and statements that we were approved each month on the repayment program, and copies of all of they payments we sent to them for each month. we paid all of them on time within the guidelines of the agreement. I was also told that the paperwork to be sent to them for the modification that we were trying to get approved for didn't have to be in at a certain time.On jan.12th, 2010 when i called gmac mort. to let them know i had all the paperwork done and was going to send to them again because they said that the 1st time i sent the paperwork for the modification was wrong. i was told that i had to get the paperwork in by the 19th of jan. I called gmac the next day and they said paperwork had to be in on the 17th to be approved for review for the modification. I sent out to them on the 12th. called gmac mort. back on the 12th to make sure again that it had to be in on the 17th now. gmac mort. told me to send it priorty mail so it would be sure to get to them on time. I sent it priority mail and again after i sent it out i called them. I called gmac mort. everyday between 12th and 16th to make sure they got the paperwork.Sat.16th of jan. it was delivered to gmac mort. loss midigations dept. in Pennsylvania. On tues. jan. 19th i called gmac mort. loss midigations dept. because mon. jan. 18th was a holiday and they were closed. I Asked them why they would ask to have a package to be delivered on a sun. the 17th to begin with because they are not even open.Gmac mort. said that that was the deadline for the modification paperwork to be in.Gmac mort. said that that they did not receive the paperwork yet. Gmac mort. told me to call the post office in Pennsylvania to find were it was because they wouldn't except it on the weekend.Which again i was very confused because i was told that it had to be in on the 17th of jan., which i clearly stated earlier was a sunday. I Called the post office in horsham, penn. they said it was sent to them in the morning of 16th of jan. and gmac rejected it and sent it back to post office.I have confirmation it was sent to them by the post office of the morning of 16th of jan. At that time i was toldwe were 3 months behind on our mortgage payments.We owed for the months of oct.2009 to jan. 2010. Gmac mort. said we defaulted on our repayment program. I have statements and original receipts of all payments made to gmac mort. on the repayment program amount due for each month, made on or before the 8th of each month starting nov. 8th. Sent all of these copies about a dozen times, faxed and mailed 2 separate copies to gmac loss midigations dept., payment research dept., collections dept. and the money dept. and have confirmations that they were received.I have talked to every dept. and probably just about everyone and from one minute to the next our account balance changed, that we are approved for a lower rate of our mort. but not themodification, and we have credit on our account. In i day i talked to 1 person in the loss midigations dept. told me i owed over 6 thousand dollars. Ten minutes later i talked to another person in the same dept. saying i owed 4 thousand dollars and qualified for a lower rate on my mort.All of our statements between nov. and jan. say that we were approved each month for the repayment program and that when each payment was due, the amount due, and no outstanding balance due on the repayment program for each month, but i was told that did not matter that we had original receipts of payments that we made each month on time.Now we are going to be in foreclosure by the end of this month if this doesn't get resolved. GMAC HAS RUINED OUR CREDIT, MORTGAGE, FAMILY.

$204 over charge
For the third month in a row, GMAC Mortgage has charged me a higher payment for a problem that they admit was their fault, and in our last phone conversation, they begged me to give them more time. I am being scammed to the tune of an extra $204/month on my mortgage payment. They have repeatedly assured me this would be taken care of after multiple, painfully-long phone conversations (using up my for-pay cell minutes, and my time to solve THEIR problem). As I just paid my mortgage online today, I see the issue still has not been resolved, and for the third time, I forked out an extra $204. This is pure fraud.

messed my account up
i was going after a loan modication they said okay payment went from $1295.00 to $713.59 i as a single mother was crying i was so thankful...I called a dozen times making sure I was doing everything right they said yes then i get a call my house is in forecloseure I said I've never missed a house payment nor ever had a late payment he said u have to put your house up for sale by tomorrow i just cried and cried. went home and called the lady said no your modication didn't go thru I said I called a dozen times and they said yes. She said you have to start again and your have alot of late charges and your credit is a mess because of this I cried . So we started again she said by Feb 26 to send $759.50 I called and paid it so it would be early. I get a fed ex letter new payment $1206.03 new modication. I called said I can't pay this with what I make now he said send two new pay stubs and we will look again put your house is in forcloseure. I never knew this was what happens or I never would of started this. They said modication just means your interest rate gets lowered...Can someone please help me...

I lost my home....
Over the last several months my husband and I have been trying to work with GMAC Mortgage to save our home. I am unemployed and my husband is self employed and as many others have...we too have fallen on hard times. I wanted to share with you my horrible ordeal . The easiest way to do this would be a time line.
In September 2009 I contacted GMAC to explain my hardship. They were kind enough to give us a 4 month forebanrance taking us through December 09. (We trully appreciated this. I had hopes that within the next 4 months our business would pick up and I would be able to find a job. Unfotunaly this did not happen)
December 22, 2009 we received a letter from Orlans/Moran (GMAC's Attorney's) stating that our Mortgage was in default and that we needed to contact GMAC to make some kind of arrangements. I contacted GMAC immediatly and asked what the process would be. They stated to submit paper work for a Loan Modification..
January 11, 2010 all necessary paper work including a financial analysis for loss mitigation workout, a financial hardship affidavit, request for transcript of tax returns, bank statements and the sourse of income (which was Massachuetts Unemployement) was faxed. I called and confirmed that they received all paper work.
On January 21, 2010 we were sent by certified mail a Notice of Intention to foreclose on Tuesday, February 16, 2010.
January 22, 2010 I contacted both GMAC and Orlans/Moran (GMAC's Attorney's) to see how I could stop this from happening. Both parties told me two things - That I needed to contact the Loss Mitigation department (which I had already done) and that if we called on Thursday, February 11, 2010 (5 days prior to the aution date) and not any earlier we could ask to postpone the aution. At this point I had high hopes of delaying the aution and saving our home because of the Hope for Homeowners and/or a Loan Modification.
January 26, 2010 I contacted GMAC to see what the Status of the Loan Modification was. They said it was still in review.
February 3, 2010 I was sent a letter regarding some additional documentation they needed. They were missing a copy of the most recent paystub (which I had sent them already), Unemployemnt award letter and 2008 Taxes (which again...I had already sent them.)
February 8, 2010 called to see if there was any update on the loan modification and to explain that we maybe filing for Bankrupcy. Nothing at this point. Instructed at this time to call on Thursday, February 11th to ask to postpone the aution as instructed.
February 11, 2010 I called to asked to have the aution postponed. A ticket was entered. I instructed the gentalmen to make sure that they called me on my cell if they had any questions or need anything. I was adimint about it! I also asked them to put in the notes that I was very very close to getting a job...I am on the 3rd round of interviews and all I was asking was for a couple of weeks to see if I got the job. They told me that they would document that.
February 11, 2010 - At 2:00 Eastern time I received a call from a woman named Maureen who asked me to give her a call. It was late that evening and I had to wait until the morning to contact her.
February 12, 2010 - Called Maureen around 10 AM regarding message left the night prior. (888-714-4622, option #5 and extention - 2365415) I left all the information needed for her to get back in touch with me including my cell phone. About an hour later I trired calling Maureen back and still got voicemail. I finally called the regular call center in which I was told that the request had been denied due to missing documentation. The documentation stated that they did not have the signed 2008 tax form which I had already faxed over twice before. Very upset I stated that I would send the information right way. The representive told me that the fax could take up 24 to 48 hrs to receive and once received I could ask for the aution to be postponed. 24 to 48 business hours would bring us to TUESDAY! This was unexceptable to me and demanded a different solution...she gave me an emergancy fax line. (866-355-6034) I still wanted to talk with Maureen who I was told was a supervisor...I called and left a total of 6 message throughout the day asking Maureen to contact me. I begged her to just call me and update me as to where I stood. I never received a phone call from her. I called the call center at least 5 to 6 different times demanding to speak with a supervisor...NO ONE would put me through to one. Everyone told me that they would need to enter a ticket for a call back and I would be contacted withint 24 to 48 hours! WHAT!!! I was so upset...all I was looking for was answers...all I wanted was for someone to "own" my file so I did not have to speak with 7-8 different represetives who I had to repeat my story to 7-8 different times. Finally at 4:33 while speaking with a woman I was told that my fax was received, that a request to have the aution postponed was submitted once again and I was insured that I would be contacted by a supervisor that evening before closing. I waited all night...NO ONE called.
February 15, 2010 - first thing in the morning I called Maureen and left a message on her voicemail and then I called the call center...at which time I was informed that I would not be granted the postponment of the aution because I was denied for both the Hope for Homeowners and a Traditional Modification because I could not afford to pay the mortgage. I am sure you can imagine how upset I was/am. I tried to explain to the representive that all I am asking for is a couple of weeks to postpone the sale. That I have a 3rd round job interview this week that if I get the job would allow me to pay my mortgage and get me on my feet again. I asked why a supervisor never contacted me and they stated that their was a ticket still open for one to call and I told them it was unexceptable. I told the gentleman that I would not get off the phone until I was talked with a supervisor. The gentleman came back 3 times and told me that there was no one to speak with...but I told him I was not going to get off the phone...finally they placed me with Stacey. (3192365865) I explained to Stacy what I had gone through over the last couple of days, I explained to her how many calls I had placed to Maureen, I explained to her my sitution with my employeement and that all I needed was 2 weeks to find out if I got the job. All I was asking was for 2 weeks. The answer was no.
We truly feel that GMAC has intentially deceved us for the following reason:
They knew that we might file Chapter 13 Bankruptcy which would immediatly hault any foreclosure or aution process.
We feel that they intentionally delayed our request to speak with a superior so we could not esculate the sitiation. We were adamant that my cell phone number be the only contact number and we also stated not to call the house number which is where Maureen left the message.
We were never contacted to be notified that any of our packets were missing documents...the only time we found this out was when I called them to request an update. At which point we did receive a letter of missed items...but only after I had called them days prior and request what info was missing.
We believe that GMAC knew all along that we did not quaify for either one of the plans but chose to tell us only hours before the deadline and on a Federal/State Holiday so we would not have access to the courts to save our home by way of filing the Chapter 13 Bankruptcy.
Ms. Slack - I know that at this time we can not afford the home. I am not nieve to that. All I am asking or was asking for was a delay in the aution...in order to see if I did get the job. 2-4 weeks tops! I am not sure why waiting another couple weeks would hurt them or their investors. (GNMA) If I don't get the job...then we move on. At least I know I had the option and can tell my children we tried.

mortgage modifacation
in sept. 2009, i called gmac mortgage, i told them i would be a week late on my mortgage payment of 1330.49 do to decrease of income. ( i have never been late or missed a payment in 14 years ) iwas told that i was approved for a loan modifaction under the obama stimulus affordable housing program. that for sept. oct. nov. and dec. 2009 my payment would be 682.00. was told that if i am denied, late fees and interest of about $ 4, 000.00 would accumulate during this 4 month program. i replied to the repersentive that i cannot do the program as i cannot pay that large amount of charges in 4 months. she replied " of course we do not expect you to pay that" . i replied " what happens to these fees of 4, 000.00 dollars" she replied "that these charges would be applied to the end of the loan and can be paid if you sell you home or pass away and just sit there, " you don't have to pay them.". at the time of this conversation she made me feel that she was telling me the truth as she was a loan specialist. i summited 3 loan modification applications during this 4- month period, was denied 1st time, was told that i did not make enough money. called gmac and asked, what do i do at this point. was told to apply again and show increase of income, she said " how many bedrooms do you have in your house? i said 2, she said, "then say that you are renting the 2nd bedroom out for like 400.00 a month. go on google and down load a rental agreement and fill that out, send that in with 2nd set of your loan modification application even though your not actually renting a room. was denied 2nd time, was told i don't make enough money after waiting for 6- weeks with -out no word on this. i called again after receiving a statement that i owed 3, 200.00 due 1st of nov.2009, then i called about this statement, was told to keep paying the $ 682.00. i sent gmac 1330.49 my regular payment amount due to fear of getting further behind on these charges even though she said not to. seeing more and more deception on every call to this company! then i called in dec.2009. loan specialist told me that i sent too much and she applied the $ 1330.49 sent in nov.2009 of 682.00 for nov.s payment and $ 682.00 for dec.s 2009 $682.00, she told me to call back in jan. 2010, meanwhile i received a intent to foreclose, certified mail. i was so upset, called gmac immeditaley, was told that i had to do a re-payment plan for 6-months -jan.2010-june 2010 of the amount of $1867.87. i said at this time i cannot afford this amount. was told " it does not matter what you can afford as if you don't pay this, we will foreclose . i continued to call several times after to try to get this amount reduced. i had to agree to the amount of $1768.40 which is just about bankrupting me. no money left for paying normal monthly bills. car, utilities, etc. i feel strongly that false promises, deception, misrepresentation by gmac mortgage has done everything possible to destroy my life. thank you; jeanette singh

Father died but they wouldn't talk
My father recently passed away and I learned his mortgage was sold to GMAC mortgage. There is no equity in the home and all I want to do is have it be gone. I attempted many times to speak with them to make it as easy and quick as possible but they kept giving me a runaround. To the point that I sent in the information so they can speak to me regarding the details of the account but when I called to confirm they received my paperwork, they wouldn't tell me. Ridiculous. There was only one time I received even a modest amount of help and that came from a customer service person who was actually located in the U.S. (Take from that comment what you will.) The funny part is that my father's estate is worth less than $2, 000. Even better is that their threats of foreclosure make me chuckle since now the shoe is on the other foot in that now they want to talk to me - but 2 months ago I wasn't good enough. Decided to finally send back the financial info for the borrower... pretty easy to put $0 of income since the borrower is dead. I'm looking forward to them contacting me after reviewing the paperwork.

Problems with mortgage lender
I have tried to negotiate with this mortgage company. for over 3 months now. I wrote to them and requested a mortgage modification. They stated that we didn't not qualify. My husbands work has decressed and we are financially challenged. They wouldn't even consider lowering our interest rate which is currently at about 7.8%. Now I just received a letter stating that as of 3/1/10 our current mortgage from $1608.00 will now be $3, 3...oo if we couldn't afford $1, 608. how can we afford this much?? Can you help us?

Loan Modification
In June 09, we contacted GMAC Mortgage to apply for a loan modification. We submitted out required paperwork and hardship letter explaining that my wife was laid off and we lost half of our monthly gross income. GMAC responded back with a loan modification that would reduce our mortgage by less than $50. We contacted them back and the person we spoke with could explain how they can to a $50 reduction when we lost half of our monthly income. A week later we were contacted by a very rude representative that tried to strong arm us into accepting the modification. We explained we didn't understand and would someone contact us who could explain. We were never contacted so we got an attorney. Once they attorney got involved, GMAC sent us another modification amount that was still not helpful. So our attorney inquired about the government programs and we were told that since we didn't accept the first offer, less than $50 reductions, we no longer qualify for a government program and we either take the second offer, their bank program, or they will move to foreclosure procedures.
We never accepted or decline the first offer we wanted someone to explain to us how they can to the $50 reduction of our mortgage when we lost half of our income when my wife was laid off.
GMAC recieved a lot of money from the government and are unwilling to work with their customers. A $50 reduction is not going to help us and their refusal to allow consumers the government loan program is terrible and unfair. We will most likely lose our home because we only have half the income now and we were forced to take a modification that will not help us.
Can we get support from anyone out there? Can we sue GMAC for bad business practice and their strong arm tactics and unwillingness to help consumers after they've recieved bailout monies?
