loan modification
i am trying to get somewhere with gmac with a loan modification.. the day that the forms were online from them i filled them out and sent them in (middle of april). of course they claim they got the packet on may 18. no one has called and ive now called them twice. the last time they hung up on me!!!my second mortgage company is sls and we did the modification over the phone with the paperwork now on the way for me to sign. my payment with them went from 985 interest only to 614 interest only. for some reason their people are interested in what the president wants done however gmac doesnt care at all!!! they cant make cars and they cant process paperwork----great company!!! now if anyone would like this home in florida that i paid 460, 000 for in 2006 let me know----it is worth about 250, 000 now!!!

HOW TO STOP ILLEGAL FORECLOSURE
GMAC Mortgage entered into a modification agreement with me. Afer the first payment was collected, I received a letter from them stating that my rate would increase for the next month even though the modification agreement stated that my payments would be fixed for 2 years. I continued to make my payments according to the terms in the signed contract. For over 5 months, GMAC cashed my checks but never credited my account. After collecting payments for over 5 months, GMAC filed a NOTICE of DEFAULT against me. They are outrageous!!
I am an owner of a forensic loan auditing company. I am so upset about what this incompetent company is doing to people who are paying their bills. I have filed a complaint with the FTC, but they do not investigate individual cases. I am willing to do FREE audits for GMAC customers. I am interested in compiling all state and federal violations GMAC commits against its paying customers. Please email me at [email protected]. Horrible Modification Policy
Beware! We were offered a home modification, reducing our payments. They have a trial period of four months, and then if payments are made successfully they will give you a permanent modification.
During the trial period, if regular payments are not made, they will mark the past due balance as 30, 60, 90+ days late on your credit. If you pay the modified amount during the trial your credit will be ruined.
If they decide to add an escrow to your account, you will need to make the new higher payments or suffer negative credit marks.
Negative credit marks will increase your credit card rates, homeowners and auto premiums.
You will be forced to pay the regular payment, an increased payment adding escrow or ruined credit.
For at risk homebuyers not 30 days late, this is a doom.
They need to change their policy before they ruin people's finances.

False reporting of information
Gmac Mortgage sent me a letter received on 21 Apr. 2009 saying my loan was in default. I had talk to GMAC Mortgage in Apr. and ask why my payment had gone up and was told I needed to pay the short fall on my escrow account. I told the person I had in Feb. 2009. The lady check and said yes I had and it had been misapplied and it would be changed. Then the letter on the 21 Apr 2009 came again I called GMAC and found my account had been turn over to collections. I could not understand the lady whom I was connected to and she did not want to hear what I had to say. I called GMAC again and was connected to collections again. The person I got this time was Franz and I could understand him and he could understand me he did take a look at my account and said there had been a mistake made and would correct the problem. I told Franz I wanted to talk to a supervisor and was told me one would call me. That same night I was called by John #13818. I explained what was taking place I also explained that GMAC Bank had entered statement against my credit and before this my credit score was 767. He stated he was sorry and he could see I had made all my payments on time and I would be getting a letter from GMAC, Then on 22 Apr 2009 a lady came to my home and started taking pictures of my house she told my visitor the home was in foreclosure and we needed to contact GMAC. I send a email to GMAC Mortgage asking why was I not contacted until the loan was in default and that I had contacted GMAC to see amount getting a lower loan rate and was not told anything then and I had contacted GMAC twice in Apr and nothing was ever said about my payment being late. I ask why was anything added against my credit before notifying me and was told they regret my bad experience. I feel GMAC is wrong and I may contact legal advice if something is not done to insure my good name and credit is not reestablished.

Loan Modification
My wife and I just filed six complaints against GMAC Mortgage, Three with State reps in the State of Washington, BBB of Iowa, Attorney General of the state of Washington and the Attorney General of the US. GMAC is nothing more than Mortgage Nazi's. They told us to get help with the Housing Education Project then submit the information for our modification. They then modified our loan using old account information and then admitted not using the information we put together through HEP! (Lauren Costill is great!!) Our Payment now is higher than before? What, thanks Nazi's now I can re-default. Oh just an FYI they don't return calls, lie like a politician, have no answers for anything, had the balls to make a fake payment (nobody there can explain how it got there or who made it) as well as changing our payment date and loan terms without notification to us!!! Clinton Harris at 1-800-799-9250 ext.8746915 provides excellent Customer-NO--Service. This company received billions in Federal money. Time for a lawsuit!!!

lender forclosing when all payments are current
GMAC Mortgage is foreclosing on my home and I have made all my payments in full and all on time. I have all my returned checks but GMAC is not interested in discussing it. My profession is a bookkeeper. GMAC is currently reporting me 180 days late to the credit agencies. They have physically gone to the property and told my tenant they are the lender of the property and that I am in default on my loan. GMAC is charging me for these visits to my property. My tenant says he is moving. The rental market in Idaho is terrible. I will surely take a financial beating when my tenant vacates. GMAC calls me 3 times per day from their automated system on weekends. They call around 7am, again mid day and around dinner time, 7pm. I have documentation of this. I have been on the phone with them dozens of times over the last 10 months trying to resolve this and spent many sleepless hours in the middle of the night very upset. About 2 months ago, I started recording my calls to the bank. I have begged them to have someone call me back so we can get this resolved but no one has ever called except their automated collection message prompting me to use my charge card to make a payment. I send in the amount every month that my note calls for but they say it is not enough and don’t apply the payment. They cash my check and put my payment in a suspense account so I continue to accrue late fees and derogatory credit reporting. When I spoke to their collections dept, customer service yesterday they say I owe them $8176.11. I ask which months and they are unsure. Again, I have made all my payments every month in full and have my revisited my returned checks to be sure they have all clear on time, which they have. When I talk to the tax/insurance dept they say I am current on both.

GMAC is ripping my off, running my credit, harassing me on a daily basis and intimidating my tenant. I applied for a non-owner occupied loan. They know I don’t live at the subject property. Why are they going over to the property and discussing my loan with the tenant? Now that they have ruined my credit, I can’t re-fi with another lender.

GMAC Mortgage Fraud
This arbitrarily placed a 12 year old closed account back on my credit report despite knowing that the account had been assumed by another party and despite reporting the account as closed for the last 12 years. They were unwilling to change the information when given evidence of their mistake. They were unable to produce any documentation supporting their placement of the account on my credit report. AS a result, while waiting 30 days for it to come off of my credit report, I lost the house that we had been closing on since my credit score dropped from 775 to 615 because of this one derogatory account. GMAC showed complete lack of customer service or understanding. I can only hope that they go out of business and that the government does not bail out this inept company.

Fraud, fraud, fraud
I took out a mortgage with GMAC Mortgage in 2001. When the initial payment due date was near I did not receive a statement. Not wishing to be accused of making a late payment I contacted GMAC by phone and requested the address to make the payment. I was given an address and sent the payment prior to due date.
I was never given credit for the payment. GMAC kept accusing me of failing to make the payment for over two years. During this period I was in touch wit them numerous times on this matter but never got any satisfaction.
Two years later I took out a new mortgage and paid GMAC off. After the new loan had closed GMAC finally returned my payment by sending it to the escrow company that handled the new loan.
In 2008 I checked my credit reports and found GMAC had been and was still sending negative reports to the credit reporting bureaus. I contact GMAC and asked that this be corrected. I got a letter stating that they need further information. This in spite of the fact I gave them the complete loan number at the time of my complaint.
To this date I have not received any further correspondence from GMAG nor has the credit report error been corrected.
I consider their actions slanderous a damaging to my credit and reputation.

Absolutely terrible service. One of the worst companies that I have ever dealt with in handling inquiries. Call several times and always get a different response. No wonder GMAC is in such trouble.

saying we're behind and we're not
GMAC Mortgage took over our mortgage from MGC Mortgage CO. GMAC states that when they assumed our mortgage we were 3 months behind, which is not true. They keep sending threats of foreclosure, and they are deducting deliquent fees from our regular monthly mortgage payment, thowing our payment short each month. We've been going round and round about this, and I have faxed payment research copies of all our cancelled checks to prove we're not behind, but its been over 3 months and they still say we are. We met with an attorney who said we definitely have a legitimate complaint, but we must front $2, 500 for him to represent us, and maintain $2, 000 in an account with the attorney, and he will deduct $200 per hour to represent us from this account. We can't afford this, but don't want our credit ruined and our home foreclosed upon when we're not behind. I see others have been through the same exact situation. I think we should all try to come together and form a class action lawsuit and try to put enough hurt on GMAC that they'll get their act together. Their Customer Service is horrible, most can't even speak English, they say we CAN"T speak to a supervisor, all they do is put you on hold hoping you'll hang up. Its so unfair and should be illegal for what they are doing. Everyone in America needs to know how horrible it is, and news shows should put this information out there to educate the public in how GMAC really treats their customers!!
