fraudlent charges
Gmac bought my loan from first mariner bank. from day they have doubled charged for home insurance that was already paid. double charged for escrow account and fraudlent tax forcast. Adding charges on my monthly fixed bill. This is a constant, tell me that everthing has been reversed and taken care of. Then a letter a week later telling me I am late and now owe more than the previous letter. Please help as would like to sue for the entire loan amount.

customer service
well this is it i complain about people who are complaining here!! this people are complaining because they are idiots! they complain about something in their loan but the reason for the mistake is of their own doing!! they never read instructions!! Ive heard of a complain about their monthly because of blah!blah!blah etc. but they are just trying to escape their obligations!! they reason out for the mistake they did!! Other people asking bout why their payments were misapplied but the real thing bout that mistake is they didn't write where the payments should be applied then they call and complain and complain and complain but the truth is they did the mistake in the first place!! people please listen and analyze first before you believe in these crap complaints ok??

$10,000. for a remodification
I purchased a condo/townhouse in Nov.of 2005, and my loan was sold to Gmac mortgage. I had gotten a two year arm loan and in Oct. of 2007 I decided to start the process of re modification. My loan was not due to reset until Jan. 1st 2008, however I decided to start early to prevent any problems. Every time I called Gmac I was put on hold for at least an average of two hours, and when I did get to speak to someone I had to explain the entire history of what i was trying to do over and over. This went on for about for about eight months, in that time period I was told to be late with my payment at least two months before they would consider me for the modification. I had already explained to them that with the taxes being increased by $1000. and the rate adjusting, I would not be able to afford the payments hence the reason for my request for the modification. It was like talking to a drunk person. I became so annoyed at their arrogance and total disregard for helping me that I threatened to go to the media and the Better business bureau. With in 10 minutes I was informed of what was needed to modify the loan.
Here comes the good part, ...The cost for the re modification $10, 000. and they also informed me that the remaining debt would be put on the back of the loan, I would start with a $0 balance. I thought finally I could manage my payments, then I get the first bill, there was a charge of $460. ????? they told me it was because the re mod took so long!!! How is that my problem? I'd love to sue them, prosecute them and prevent anyone else from having to deal with them. [email protected]

Delay of Payment of Insurance Claim Checks
My insurance company, TWIA has issued a claim check in my name and GMAC. GMAC's process to get it endorsed has intentionally delayed the release of my funds even after it was inspected by their inspector. I have jumped through every hoop they have put in front of me taking an additional 3 weeks of their "process".
I am now being told that I need a statement from TWIA that they accepted the sworn statement of loss from AmeriCat, LLC, the adjuster firm. THIS MAKES NO SENSE. The check was cut by TWIA, of course they accepted the sworn/notarized statement of loss/adjustment. This is an intentional delay to make money off of the funds that belong to me, again even after their inspector inspected my property and filed a report stating that 99% of the work was completed at my expense.
I have asked repeatedly why they need this information. I was told "You don’t need to know, all you need to know is we will not process your request further until we get it".
I have fixed my home at my own expense and GMAC is intentionally delaying getting me my insurance claim moneys. This is a ploy that is wide spread in my community and is criminal. I would hope someone would
investigate GMAC Mortgage and penalize them in what ever fashion possible for this blatant act of dishonesty and criminal behavior.

RIP OFF
I would strongly urge AGAINST using GMAC mortgage - for two main reasons 1) Absolutely no customer service - they could care less if you have an issue, have no interest in resolving the issue and can not wait to get you off the phone 2) watch your escrow account - they must be using these funds to try and fix their poor financial standing. They are charging us 35% more per year than needs to be collected; and all they continue to do is raise the amount - even though it is absolutely not needed. This must be a way for them to make money...just keep $1, 000's of other people's money to invest, loan out or whatever. I guess the consumer is the new bank. Sorry, but we don't have the money to try and help out GMAC Mortgage - here's an idea - maybe the top execs can cut some of their bonuses and you can start charging your customers the correct amount vs. grossly inflating it. Find someone else to float you the $$ - the government loves to give away free money - get it from them!

Not receiving mortgage statements
I have not received my mortgage statement on time for five months in a row but yet they will charge me late fees. I have called customer service A LOT and get one person named Gabriel who is of NO help at all and will not forward my call to a supervisor. I am so frustrated with this company I can't see straight and am not surprised to see all the customer service complaints that have been posted.
I am taking my fight to the BBB and SEC and encourage everyone else to do the same!

Customer cheat
GMAC acquired my loan from my previous mortgage company on 12/03/2007. At the time when my loan was transferred, my account was current. Payments had been made through November 2007. I was to resume payments with GMAC starting with December 2007. Immediately, after obtaining my loan, GMAC continued to send me statements demanding payments for October, November & December 2007. I submitted my payment history from my previous mortgage company directly to their office and their corporate attorney. During the month of June 2008, their attorney put notes on my account advising that I had already paid my mortgage for November through December 2007 along with a request to update my payment history. As of September 9, 2008, my account still has NOT been updated. Even though the representatives can view the account notes, they still refuse to update my payment history. Now I am receiving collection calls and being threatened with foreclosure for an error they refuse to correct. During my attempt to resolve this discrepancy over the phone, I have been hung up by several GMAC representatives and just treated like crap. They have no respect for their customers at all. Potential customers should be very, very, very careful before deciding to get a loan with GMAC Mortgage company. If your loan gets sold to this company like mines did, I would suggest that you refinance with another mortgage company immediately. GMAC is the absolute worst!!!

Fraud and scam
GMAC Mortgage was helpful when I was trying to sell my home for the market value, which had dropped and was less than what I owed. They did so by a short sale, of which I have to pay them back since it was in 2006 before the cancellation of debt bill went into affect.
Two years later I receive a letter from the IRS stating that I owe them $4, 000 in taxes from a "cancellation of debt" by GMAC. After many letters and documentation from the closing, I was able to prove that I was paying back the amount and it was NOT a cancellation of debt. The IRS letters were not very clear and I had to re-read the entire situation many times before understanding what they thought I owed money for. Most people have to hire a lawyer!
If I am just one person that GMAC mortgage wrote off as a cancellation of debt for $14, 000, imagine 10, 000 other people @ $14, 000 for tax yr 06. That would equal 14, 000, 000 they tried to save by reporting losses incorrectly!

I just filed a complaint with the Federal Trade Commission detailing GMAC Mortgage's apparent practice of scamming their customers (payment processing run-around, incorrect information, lack of accountability).
